1111 1 AN ACT concerning education.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Higher Education Student Assistance Act is
1515 5 amended by changing Section 35 as follows:

1717 7 Sec. 35. Monetary award program.
1818 8 (a) The Commission shall, each year, receive and consider
1919 9 applications for grant assistance under this Section. Subject
2020 10 to a separate appropriation for such purposes, an applicant is
2121 11 eligible for a grant under this Section when the Commission
2222 12 finds that the applicant:
2323 13 (1) is a resident of this State and a citizen or
2424 14 permanent resident of the United States;
2525 15 (2) is enrolled or has been accepted for enrollment in
2626 16 a qualified institution for the purpose of obtaining a
2727 17 degree, certificate, or other credential offered by the
2828 18 institution, as applicable; and
2929 19 (3) in the absence of grant assistance, will be
3030 20 deterred by financial considerations from completing an
3131 21 educational program at the qualified institution of his or
3232 22 her choice or from enrolling in dual credit coursework
3333 23 pursuant to Section 16 of the Dual Credit Quality Act.

6868 1 (b) The Commission shall award renewals only upon the
6969 2 student's application and upon the Commission's finding that
7070 3 the applicant:
7171 4 (1) has remained a student in good standing;
7272 5 (2) remains a resident of this State; and
7373 6 (3) is in a financial situation that continues to
7474 7 warrant assistance.
7575 8 (c) All grants shall be applicable only to tuition and
7676 9 necessary fee costs. The Commission shall determine the grant
7777 10 amount for each student, which shall not exceed the smallest
7878 11 of the following amounts:
7979 12 (1) subject to appropriation, $5,468 for fiscal year
8080 13 2009, $5,968 for fiscal year 2010, $6,468 for fiscal year
8181 14 2011 and each fiscal year thereafter through fiscal year
8282 15 2022, and $8,508 for fiscal year 2023 and each fiscal year
8383 16 thereafter, or such lesser amount as the Commission finds
8484 17 to be available, during an academic year;
8585 18 (2) the amount which equals 2 semesters or 3 quarters
8686 19 tuition and other necessary fees required generally by the
8787 20 institution of all full-time undergraduate students; or
8888 21 (3) such amount as the Commission finds to be
8989 22 appropriate in view of the applicant's financial
9090 23 resources.
9191 24 Subject to appropriation, the maximum grant amount for
9292 25 students not subject to subdivision (1) of this subsection (c)
9393 26 must be increased by the same percentage as any increase made

104104 1 by law to the maximum grant amount under subdivision (1) of
105105 2 this subsection (c).
106106 3 "Tuition and other necessary fees" as used in this Section
107107 4 include the customary charge for instruction and use of
108108 5 facilities in general, and the additional fixed fees charged
109109 6 for specified purposes, which are required generally of
110110 7 nongrant recipients for each academic period for which the
111111 8 grant applicant actually enrolls, but do not include fees
112112 9 payable only once or breakage fees and other contingent
113113 10 deposits which are refundable in whole or in part. The
114114 11 Commission may prescribe, by rule not inconsistent with this
115115 12 Section, detailed provisions concerning the computation of
116116 13 tuition and other necessary fees.
117117 14 (d) No applicant, including those presently receiving
118118 15 scholarship assistance under this Act, is eligible for
119119 16 monetary award program consideration under this Act after
120120 17 receiving a baccalaureate degree or the equivalent of 135
121121 18 semester credit hours of award payments.
122122 19 (d-5) In this subsection (d-5), "renewing applicant" means
123123 20 a student attending an institution of higher learning or
124124 21 enrolled in dual credit coursework pursuant to Section 16 of
125125 22 the Dual Credit Quality Act who received a Monetary Award
126126 23 Program grant during the prior academic year. Beginning with
127127 24 the processing of applications for the 2020-2021 academic
128128 25 year, the Commission shall annually publish a priority

140140 1 appropriation, a renewing applicant who files by the published
141141 2 priority deadline date shall receive a grant if he or she
142142 3 continues to meet the eligibility requirements under this
143143 4 Section. A renewing applicant's failure to apply by the
144144 5 priority deadline date established under this subsection (d-5)
145145 6 shall not disqualify him or her from receiving a grant if
146146 7 sufficient funding is available to provide awards after that
147147 8 date.
148148 9 (e) The Commission, in determining the number of grants to
149149 10 be offered, shall take into consideration past experience with
150150 11 the rate of grant funds unclaimed by recipients. The
151151 12 Commission shall notify applicants that grant assistance is
152152 13 contingent upon the availability of appropriated funds.
153153 14 (e-5) The General Assembly finds and declares that it is
154154 15 an important purpose of the Monetary Award Program to
155155 16 facilitate access to college both for students who pursue
156156 17 postsecondary education immediately following high school and
157157 18 for those who pursue postsecondary education later in life,
158158 19 particularly Illinoisans who are dislocated workers with
159159 20 financial need and who are seeking to improve their economic
160160 21 position through education. For the 2015-2016 and 2016-2017
161161 22 academic years, the Commission shall give additional and
162162 23 specific consideration to the needs of dislocated workers with
163163 24 the intent of allowing applicants who are dislocated workers
164164 25 an opportunity to secure financial assistance even if applying
165165 26 later than the general pool of applicants. The Commission's

176176 1 consideration shall include, in determining the number of
177177 2 grants to be offered, an estimate of the resources needed to
178178 3 serve dislocated workers who apply after the Commission
179179 4 initially suspends award announcements for the upcoming
180180 5 regular academic year, but prior to the beginning of that
181181 6 academic year. For the purposes of this subsection (e-5), a
182182 7 dislocated worker is defined as in the federal Workforce
183183 8 Innovation and Opportunity Act.
184184 9 (f) (Blank).
185185 10 (g) The Commission shall determine the eligibility of and
186186 11 make grants to applicants enrolled at qualified for-profit
187187 12 institutions in accordance with the criteria set forth in this
188188 13 Section. The eligibility of applicants enrolled at such
189189 14 for-profit institutions shall be limited as follows:
190190 15 (1) Beginning with the academic year 1997, only to
191191 16 eligible first-time freshmen and first-time transfer
192192 17 students who have attained an associate degree.
193193 18 (2) Beginning with the academic year 1998, only to
194194 19 eligible freshmen students, transfer students who have
195195 20 attained an associate degree, and students who receive a
196196 21 grant under paragraph (1) for the academic year 1997 and
197197 22 whose grants are being renewed for the academic year 1998.
198198 23 (3) Beginning with the academic year 1999, to all
199199 24 eligible students.
200200 25 (g-5) The Commission shall determine the eligibility of
201201 26 and make grants to applicants enrolled in dual credit

212212 1 coursework pursuant to Section 16 of the Dual Credit Quality
213213 2 Act, subject to the following requirements:
214214 3 (1) A grant may be applied only to the costs of tuition
215215 4 and other necessary fees charged for the coursework.
216216 5 (2) The applicant must complete and submit a Free
217217 6 Application for Federal Student Aid.
218218 7 (h) The Commission may award a grant to an eligible
219219 8 applicant enrolled at an Illinois public institution of higher
220220 9 learning in a program that will culminate in the award of an
221221 10 occupational or career and technical certificate as that term
222222 11 is defined in 23 Ill. Adm. Code 1501.301.
223223 12 (i) The Commission may adopt rules to implement this
224224 13 Section.
