1111 1 AN ACT concerning criminal law.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Unified Code of Corrections is amended by
1515 5 changing Section 3-2.5-15 as follows:

1717 7 Sec. 3-2.5-15. Department of Juvenile Justice; assumption
1818 8 of duties of the Juvenile Division.
1919 9 (a) The Department of Juvenile Justice shall assume the
2020 10 rights, powers, duties, and responsibilities of the Juvenile
2121 11 Division of the Department of Corrections. Personnel, books,
2222 12 records, property, and unencumbered appropriations pertaining
2323 13 to the Juvenile Division of the Department of Corrections
2424 14 shall be transferred to the Department of Juvenile Justice on
2525 15 the effective date of this amendatory Act of the 94th General
2626 16 Assembly. Any rights of employees or the State under the
2727 17 Personnel Code or any other contract or plan shall be
2828 18 unaffected by this transfer.
2929 19 (b) Department of Juvenile Justice personnel who are hired
3030 20 by the Department on or after the effective date of this
3131 21 amendatory Act of the 94th General Assembly and who
3232 22 participate or assist in the rehabilitative and vocational
3333 23 training of delinquent youths, supervise the daily activities

6868 1 involving direct and continuing responsibility for the youth's
6969 2 security, welfare and development, or participate in the
7070 3 personal rehabilitation of delinquent youth by training,
7171 4 supervising, and assisting lower level personnel who perform
7272 5 these duties must be over the age of 21 and have any bachelor's
7373 6 or advanced degree from an accredited college or university.
7474 7 This requirement shall not apply to security, clerical, food
7575 8 service, and maintenance staff that do not have direct and
7676 9 regular contact with youth. The degree requirements specified
7777 10 in this subsection (b) are not required of persons who provide
7878 11 vocational training and who have adequate knowledge in the
7979 12 skill for which they are providing the vocational training.
8080 13 Notwithstanding any other provision of law or rule, the
8181 14 Administrative Office of the Illinois Courts and the
8282 15 Department of Juvenile Justice shall permit the hiring of
8383 16 county juvenile detention center personnel that possess less
8484 17 than a bachelor's degree, including, but not limited to, the
8585 18 hiring of an applicant who possesses an associate's degree or
8686 19 has completed at least 60 credit hours at an accredited
8787 20 institution of higher education.
8888 21 (c) Subsection (b) of this Section does not apply to
8989 22 personnel transferred to the Department of Juvenile Justice on
9090 23 the effective date of this amendatory Act of the 94th General
9191 24 Assembly.
9292 25 (d) The Department shall be under the direction of the
9393 26 Director of Juvenile Justice as provided in this Code.

104104 1 (e) The Director shall organize divisions within the
105105 2 Department and shall assign functions, powers, duties, and
106106 3 personnel as required by law. The Director may create other
107107 4 divisions and may assign other functions, powers, duties, and
108108 5 personnel as may be necessary or desirable to carry out the
109109 6 functions and responsibilities vested by law in the
110110 7 Department. The Director may, with the approval of the Office
111111 8 of the Governor, assign to and share functions, powers,
112112 9 duties, and personnel with other State agencies such that
113113 10 administrative services and administrative facilities are
114114 11 provided by a shared administrative service center. Where
115115 12 possible, shared services which impact youth should be done
116116 13 with child-serving agencies. These administrative services may
117117 14 include, but are not limited to, all of the following
118118 15 functions: budgeting, accounting related functions, auditing,
119119 16 human resources, legal, procurement, training, data collection
120120 17 and analysis, information technology, internal investigations,
121121 18 intelligence, legislative services, emergency response
122122 19 capability, statewide transportation services, and general
123123 20 office support.
124124 21 (f) The Department of Juvenile Justice may enter into
125125 22 intergovernmental cooperation agreements under which minors
126126 23 adjudicated delinquent and committed to the Department of
127127 24 Juvenile Justice may participate in county juvenile impact
128128 25 incarceration programs established under Section 3-6039 of the
129129 26 Counties Code.

140140 1 (g) The Department of Juvenile Justice must comply with
141141 2 the ethnic and racial background data collection procedures
142142 3 provided in Section 4.5 of the Criminal Identification Act.
143143 4 (h) The Department of Juvenile Justice shall implement a
144144 5 wellness program to support health and wellbeing among staff
145145 6 and service providers within the Department of Juvenile
146146 7 Justice environment. The Department of Juvenile Justice shall
147147 8 establish response teams to provide support to employees and
148148 9 staff affected by events that are both duty-related and not
149149 10 duty-related and provide training to response team members.
150150 11 The Department's wellness program shall be accessible to any
151151 12 Department employee or service provider, including contractual
152152 13 employees and approved volunteers. The wellness program may
153153 14 include information sharing, education and activities designed
154154 15 to support health and well-being within the Department's
155155 16 environment. Access to wellness response team support shall be
156156 17 voluntary and remain confidential.
