1 AN ACT concerning finance.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Illinois Procurement Code is amended by
5 adding Section 50-36.5 as follows:
6 (30 ILCS 500/50-36.5 new)
7 Sec. 50-36.5. Prohibited companies.
8 (a) As used in this Section:
9 "Company" means any for-profit sole proprietorship,
10 organization, association, corporation, partnership, joint
11 venture, limited partnership, limited liability partnership,
12 limited liability company, or other entity or business
13 association, including all wholly owned subsidiaries,
14 majority-owned subsidiaries, parent companies, or affiliates
15 of those entities or business associations, and their owners,
16 officers, directors, partners, managers, and agents (hereafter
17 "responsible officers"), and any firm, corporation,
18 partnership, or association in which such company or
19 responsible officers own, control, or have more than a nominal
20 ownership interest.
21 "Foreign terrorist organization" means an organization
22 that has been designated as a foreign terrorist organization
23 under Section 219 of the Immigration and Nationality Act (8

1 U.S.C. 1189) as of the date on which the material support,
2 resources, attempt, or conspiracy occurred.
3 (b) Notwithstanding any provision of law to the contrary,
4 any company that knowingly provides material support or
5 resources to a foreign terrorist organization, or attempts or
6 conspires to do so as defined by 18 U.S.C. 2339B, shall be
7 prohibited from contracting with any unit of State or local
8 government, subcontracting under such a contract, or
9 furnishing of materials under a contract or subcontract, as a
10 result of a conviction under 18 U.S.C. 2339A or 2339B or a
11 finding by the Executive Ethics Commission.
12 (c) The Executive Ethics Commission may adopt rules
13 necessary to implement and administer the provisions of this
14 Section.
