11	11	1 AN ACT concerning government.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 5. The Freedom of Information Act is amended by
15	15	5 changing Section 7 as follows:

18	18	8 Sec. 7. Exemptions.
19	19	9 (1) When a request is made to inspect or copy a public
20	20	10 record that contains information that is exempt from
21	21	11 disclosure under this Section, but also contains information
22	22	12 that is not exempt from disclosure, the public body may elect
23	23	13 to redact the information that is exempt. The public body
24	24	14 shall make the remaining information available for inspection
25	25	15 and copying. Subject to this requirement, the following shall
26	26	16 be exempt from inspection and copying:
27	27	17 (a) Information specifically prohibited from
28	28	18 disclosure by federal or State law or rules and
29	29	19 regulations implementing federal or State law.
30	30	20 (b) Private information, unless disclosure is required
31	31	21 by another provision of this Act, a State or federal law,
32	32	22 or a court order.

68	68	1 maintained by one or more law enforcement agencies and
69	69	2 specifically designed to provide information to one or
70	70	3 more law enforcement agencies regarding the physical or
71	71	4 mental status of one or more individual subjects.
72	72	5 (c) Personal information contained within public
73	73	6 records, the disclosure of which would constitute a
74	74	7 clearly unwarranted invasion of personal privacy, unless
75	75	8 the disclosure is consented to in writing by the
76	76	9 individual subjects of the information. "Unwarranted
77	77	10 invasion of personal privacy" means the disclosure of
78	78	11 information that is highly personal or objectionable to a
79	79	12 reasonable person and in which the subject's right to
80	80	13 privacy outweighs any legitimate public interest in
81	81	14 obtaining the information. The disclosure of information
82	82	15 that bears on the public duties of public employees and
83	83	16 officials shall not be considered an invasion of personal
84	84	17 privacy.
85	85	18 (d) Records in the possession of any public body
86	86	19 created in the course of administrative enforcement
87	87	20 proceedings, and any law enforcement or correctional
88	88	21 agency for law enforcement purposes, but only to the
89	89	22 extent that disclosure would:
90	90	23 (i) interfere with pending or actually and
91	91	24 reasonably contemplated law enforcement proceedings
92	92	25 conducted by any law enforcement or correctional
93	93	26 agency that is the recipient of the request;

105	105	2 enforcement proceedings conducted by the public body
106	106	3 that is the recipient of the request;
107	107	4 (iii) create a substantial likelihood that a
108	108	5 person will be deprived of a fair trial or an impartial
109	109	6 hearing;
110	110	7 (iv) unavoidably disclose the identity of a
111	111	8 confidential source, confidential information
112	112	9 furnished only by the confidential source, or persons
113	113	10 who file complaints with or provide information to
114	114	11 administrative, investigative, law enforcement, or
115	115	12 penal agencies; except that the identities of
116	116	13 witnesses to traffic accidents, traffic accident
117	117	14 reports, and rescue reports shall be provided by
118	118	15 agencies of local government, except when disclosure
119	119	16 would interfere with an active criminal investigation
120	120	17 conducted by the agency that is the recipient of the
121	121	18 request;
122	122	19 (v) disclose unique or specialized investigative
123	123	20 techniques other than those generally used and known
124	124	21 or disclose internal documents of correctional
125	125	22 agencies related to detection, observation, or
126	126	23 investigation of incidents of crime or misconduct, and
127	127	24 disclosure would result in demonstrable harm to the
128	128	25 agency or public body that is the recipient of the

140	140	1 (vi) endanger the life or physical safety of law
141	141	2 enforcement personnel or any other person; or
142	142	3 (vii) obstruct an ongoing criminal investigation
143	143	4 by the agency that is the recipient of the request.
144	144	5 (d-5) A law enforcement record created for law
145	145	6 enforcement purposes and contained in a shared electronic
146	146	7 record management system if the law enforcement agency
147	147	8 that is the recipient of the request did not create the
148	148	9 record, did not participate in or have a role in any of the
149	149	10 events which are the subject of the record, and only has
150	150	11 access to the record through the shared electronic record
151	151	12 management system.
152	152	13 (d-6) Records contained in the Officer Professional
153	153	14 Conduct Database under Section 9.2 of the Illinois Police
154	154	15 Training Act, except to the extent authorized under that
155	155	16 Section. This includes the documents supplied to the
156	156	17 Illinois Law Enforcement Training Standards Board from the
157	157	18 Illinois State Police and Illinois State Police Merit
158	158	19 Board.

160	160	21 correctional institutions and detention facilities.

213	213	2 may be relevant to a requester's current or potential case
214	214	3 or claim.
215	215	4 (e-10) Law enforcement records of other persons
216	216	5 requested by a person committed to the Department of
217	217	6 Corrections, Department of Human Services Division of
218	218	7 Mental Health, or a county jail, including, but not
219	219	8 limited to, arrest and booking records, mug shots, and
220	220	9 crime scene photographs, except as these records may be
221	221	10 relevant to the requester's current or potential case or
222	222	11 claim.
223	223	12 (f) Preliminary drafts, notes, recommendations,
224	224	13 memoranda, and other records in which opinions are
225	225	14 expressed, or policies or actions are formulated, except
226	226	15 that a specific record or relevant portion of a record
227	227	16 shall not be exempt when the record is publicly cited and
228	228	17 identified by the head of the public body. The exemption
229	229	18 provided in this paragraph (f) extends to all those
230	230	19 records of officers and agencies of the General Assembly
231	231	20 that pertain to the preparation of legislative documents.
232	232	21 (g) Trade secrets and commercial or financial
233	233	22 information obtained from a person or business where the
234	234	23 trade secrets or commercial or financial information are
235	235	24 furnished under a claim that they are proprietary,
236	236	25 privileged, or confidential, and that disclosure of the
237	237	26 trade secrets or commercial or financial information would

248	248	1 cause competitive harm to the person or business, and only
249	249	2 insofar as the claim directly applies to the records
250	250	3 requested.
251	251	4 The information included under this exemption includes
252	252	5 all trade secrets and commercial or financial information
253	253	6 obtained by a public body, including a public pension
254	254	7 fund, from a private equity fund or a privately held
255	255	8 company within the investment portfolio of a private
256	256	9 equity fund as a result of either investing or evaluating
257	257	10 a potential investment of public funds in a private equity
258	258	11 fund. The exemption contained in this item does not apply
259	259	12 to the aggregate financial performance information of a
260	260	13 private equity fund, nor to the identity of the fund's
261	261	14 managers or general partners. The exemption contained in
262	262	15 this item does not apply to the identity of a privately
263	263	16 held company within the investment portfolio of a private
264	264	17 equity fund, unless the disclosure of the identity of a
265	265	18 privately held company may cause competitive harm.
266	266	19 Nothing contained in this paragraph (g) shall be
267	267	20 construed to prevent a person or business from consenting
268	268	21 to disclosure.
269	269	22 (h) Proposals and bids for any contract, grant, or
270	270	23 agreement, including information which if it were
271	271	24 disclosed would frustrate procurement or give an advantage
272	272	25 to any person proposing to enter into a contractor
273	273	26 agreement with the body, until an award or final selection

285	285	2 preparation of a bid solicitation shall be exempt until an
286	286	3 award or final selection is made.
287	287	4 (i) Valuable formulae, computer geographic systems,
288	288	5 designs, drawings, and research data obtained or produced
289	289	6 by any public body when disclosure could reasonably be
290	290	7 expected to produce private gain or public loss. The
291	291	8 exemption for "computer geographic systems" provided in
292	292	9 this paragraph (i) does not extend to requests made by
293	293	10 news media as defined in Section 2 of this Act when the
294	294	11 requested information is not otherwise exempt and the only
295	295	12 purpose of the request is to access and disseminate
296	296	13 information regarding the health, safety, welfare, or
297	297	14 legal rights of the general public.
298	298	15 (j) The following information pertaining to
299	299	16 educational matters:
300	300	17 (i) test questions, scoring keys, and other
301	301	18 examination data used to administer an academic
302	302	19 examination;
303	303	20 (ii) information received by a primary or
304	304	21 secondary school, college, or university under its
305	305	22 procedures for the evaluation of faculty members by
306	306	23 their academic peers;
307	307	24 (iii) information concerning a school or
308	308	25 university's adjudication of student disciplinary
309	309	26 cases, but only to the extent that disclosure would

326	326	7 whole or in part with public funds and the same for

328	328	9 including, but not limited to, power generating and
329	329	10 distribution stations and other transmission and
330	330	11 distribution facilities, water treatment facilities,
331	331	12 airport facilities, sport stadiums, convention centers,
332	332	13 and all government owned, operated, or occupied buildings,
333	333	14 but only to the extent that disclosure would compromise
334	334	15 security.
335	335	16 (l) Minutes of meetings of public bodies closed to the
336	336	17 public as provided in the Open Meetings Act until the
337	337	18 public body makes the minutes available to the public
338	338	19 under Section 2.06 of the Open Meetings Act.
339	339	20 (m) Communications between a public body and an
340	340	21 attorney or auditor representing the public body that
341	341	22 would not be subject to discovery in litigation, and
342	342	23 materials prepared or compiled by or for a public body in
343	343	24 anticipation of a criminal, civil, or administrative
344	344	25 proceeding upon the request of an attorney advising the
345	345	26 public body, and materials prepared or compiled with

357	357	2 (n) Records relating to a public body's adjudication
358	358	3 of employee grievances or disciplinary cases; however,
359	359	4 this exemption shall not extend to the final outcome of
360	360	5 cases in which discipline is imposed.
361	361	6 (o) Administrative or technical information associated
362	362	7 with automated data processing operations, including, but
363	363	8 not limited to, software, operating protocols, computer
364	364	9 program abstracts, file layouts, source listings, object
365	365	10 modules, load modules, user guides, documentation
366	366	11 pertaining to all logical and physical design of
367	367	12 computerized systems, employee manuals, and any other
368	368	13 information that, if disclosed, would jeopardize the
369	369	14 security of the system or its data or the security of
370	370	15 materials exempt under this Section.
371	371	16 (p) Records relating to collective negotiating matters
372	372	17 between public bodies and their employees or
373	373	18 representatives, except that any final contract or
374	374	19 agreement shall be subject to inspection and copying.
375	375	20 (q) Test questions, scoring keys, and other
376	376	21 examination data used to determine the qualifications of
377	377	22 an applicant for a license or employment.
378	378	23 (r) The records, documents, and information relating
379	379	24 to real estate purchase negotiations until those
380	380	25 negotiations have been completed or otherwise terminated.
381	381	26 With regard to a parcel involved in a pending or actually

404	404	13 intergovernmental risk management association or
405	405	14 self-insurance self insurance pool) claims, loss or risk
406	406	15 management information, records, data, advice, or
407	407	16 communications.
408	408	17 (t) Information contained in or related to
409	409	18 examination, operating, or condition reports prepared by,
410	410	19 on behalf of, or for the use of a public body responsible
411	411	20 for the regulation or supervision of financial
412	412	21 institutions, insurance companies, or pharmacy benefit
413	413	22 managers, unless disclosure is otherwise required by State
414	414	23 law.
415	415	24 (u) Information that would disclose or might lead to
416	416	25 the disclosure of secret or confidential information,

435	435	8 could reasonably be expected to expose the vulnerability
436	436	9 or jeopardize the effectiveness of the measures, policies,

439	439	12 include such things as details pertaining to the
440	440	13 mobilization or deployment of personnel or equipment, to
441	441	14 the operation of communication systems or protocols, to
442	442	15 cybersecurity vulnerabilities, or to tactical operations.

589	589	18 (1) When a request is made to inspect or copy a public

792	792	6 privileged, or confidential, and that disclosure of the
793	793	7 trade secrets or commercial or financial information would
794	794	8 cause competitive harm to the person or business, and only
795	795	9 insofar as the claim directly applies to the records
796	796	10 requested.
797	797	11 The information included under this exemption includes
798	798	12 all trade secrets and commercial or financial information
799	799	13 obtained by a public body, including a public pension
800	800	14 fund, from a private equity fund or a privately held
801	801	15 company within the investment portfolio of a private
802	802	16 equity fund as a result of either investing or evaluating
803	803	17 a potential investment of public funds in a private equity
804	804	18 fund. The exemption contained in this item does not apply
805	805	19 to the aggregate financial performance information of a
806	806	20 private equity fund, nor to the identity of the fund's
807	807	21 managers or general partners. The exemption contained in

825	825	3 (h) Proposals and bids for any contract, grant, or

828	828	6 to any person proposing to enter into a contractor
829	829	7 agreement with the body, until an award or final selection
830	830	8 is made. Information prepared by or for the body in
831	831	9 preparation of a bid solicitation shall be exempt until an
832	832	10 award or final selection is made.
833	833	11 (i) Valuable formulae, computer geographic systems,
834	834	12 designs, drawings, and research data obtained or produced
835	835	13 by any public body when disclosure could reasonably be
836	836	14 expected to produce private gain or public loss. The
837	837	15 exemption for "computer geographic systems" provided in
838	838	16 this paragraph (i) does not extend to requests made by
839	839	17 news media as defined in Section 2 of this Act when the
840	840	18 requested information is not otherwise exempt and the only
841	841	19 purpose of the request is to access and disseminate
842	842	20 information regarding the health, safety, welfare, or
843	843	21 legal rights of the general public.

912	912	18 pertaining to all logical and physical design of
913	913	19 computerized systems, employee manuals, and any other
914	914	20 information that, if disclosed, would jeopardize the
915	915	21 security of the system or its data or the security of
916	916	22 materials exempt under this Section.

1123	1123	13 behalf of the public body, and that directly relates to the
1124	1124	14 governmental function and is not otherwise exempt under this
1125	1125	15 Act, shall be considered a public record of the public body,
1126	1126	16 for purposes of this Act.
1127	1127	17 (3) This Section does not authorize withholding of
1128	1128	18 information or limit the availability of records to the
1129	1129	19 public, except as stated in this Section or otherwise provided
1130	1130	20 in this Act.
