1111 1 AN ACT concerning government.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Freedom of Information Act is amended by
1515 5 changing Section 7 as follows:

1818 8 Sec. 7. Exemptions.
1919 9 (1) When a request is made to inspect or copy a public
2020 10 record that contains information that is exempt from
2121 11 disclosure under this Section, but also contains information
2222 12 that is not exempt from disclosure, the public body may elect
2323 13 to redact the information that is exempt. The public body
2424 14 shall make the remaining information available for inspection
2525 15 and copying. Subject to this requirement, the following shall
2626 16 be exempt from inspection and copying:
2727 17 (a) Information specifically prohibited from
2828 18 disclosure by federal or State law or rules and
2929 19 regulations implementing federal or State law.
3030 20 (b) Private information, unless disclosure is required
3131 21 by another provision of this Act, a State or federal law,
3232 22 or a court order.

6868 1 maintained by one or more law enforcement agencies and

7171 4 mental status of one or more individual subjects.
7272 5 (c) Personal information contained within public
7373 6 records, the disclosure of which would constitute a
7474 7 clearly unwarranted invasion of personal privacy, unless
7575 8 the disclosure is consented to in writing by the
7676 9 individual subjects of the information. "Unwarranted
7777 10 invasion of personal privacy" means the disclosure of
7878 11 information that is highly personal or objectionable to a
7979 12 reasonable person and in which the subject's right to
8080 13 privacy outweighs any legitimate public interest in
8181 14 obtaining the information. The disclosure of information
8282 15 that bears on the public duties of public employees and
8383 16 officials shall not be considered an invasion of personal
8484 17 privacy.
8585 18 (d) Records in the possession of any public body
8686 19 created in the course of administrative enforcement
8787 20 proceedings, and any law enforcement or correctional
8888 21 agency for law enforcement purposes, but only to the
8989 22 extent that disclosure would:
9090 23 (i) interfere with pending or actually and
9191 24 reasonably contemplated law enforcement proceedings
9292 25 conducted by any law enforcement or correctional
9393 26 agency that is the recipient of the request;

104104 1 (ii) interfere with active administrative
105105 2 enforcement proceedings conducted by the public body
106106 3 that is the recipient of the request;
107107 4 (iii) create a substantial likelihood that a
108108 5 person will be deprived of a fair trial or an impartial
109109 6 hearing;
110110 7 (iv) unavoidably disclose the identity of a
111111 8 confidential source, confidential information
112112 9 furnished only by the confidential source, or persons
113113 10 who file complaints with or provide information to
114114 11 administrative, investigative, law enforcement, or
115115 12 penal agencies; except that the identities of
116116 13 witnesses to traffic accidents, traffic accident
117117 14 reports, and rescue reports shall be provided by
118118 15 agencies of local government, except when disclosure
119119 16 would interfere with an active criminal investigation
120120 17 conducted by the agency that is the recipient of the
121121 18 request;
122122 19 (v) disclose unique or specialized investigative
123123 20 techniques other than those generally used and known
124124 21 or disclose internal documents of correctional
125125 22 agencies related to detection, observation, or
126126 23 investigation of incidents of crime or misconduct, and
127127 24 disclosure would result in demonstrable harm to the
128128 25 agency or public body that is the recipient of the

140140 1 (vi) endanger the life or physical safety of law
141141 2 enforcement personnel or any other person; or
142142 3 (vii) obstruct an ongoing criminal investigation
143143 4 by the agency that is the recipient of the request.
144144 5 (d-5) A law enforcement record created for law
145145 6 enforcement purposes and contained in a shared electronic
146146 7 record management system if the law enforcement agency
147147 8 that is the recipient of the request did not create the
148148 9 record, did not participate in or have a role in any of the
149149 10 events which are the subject of the record, and only has
150150 11 access to the record through the shared electronic record
151151 12 management system.
152152 13 (d-6) Records contained in the Officer Professional
153153 14 Conduct Database under Section 9.2 of the Illinois Police
154154 15 Training Act, except to the extent authorized under that
155155 16 Section. This includes the documents supplied to the
156156 17 Illinois Law Enforcement Training Standards Board from the
157157 18 Illinois State Police and Illinois State Police Merit
158158 19 Board.
159159 20 (e) Records that relate to or affect the security of
160160 21 correctional institutions and detention facilities.
161161 22 (e-5) Records requested by persons committed to the

213213 2 may be relevant to a requester's current or potential case
214214 3 or claim.
215215 4 (e-10) Law enforcement records of other persons
216216 5 requested by a person committed to the Department of
217217 6 Corrections, Department of Human Services Division of
218218 7 Mental Health, or a county jail, including, but not
219219 8 limited to, arrest and booking records, mug shots, and
220220 9 crime scene photographs, except as these records may be
221221 10 relevant to the requester's current or potential case or
222222 11 claim.
223223 12 (f) Preliminary drafts, notes, recommendations,
224224 13 memoranda, and other records in which opinions are
225225 14 expressed, or policies or actions are formulated, except
226226 15 that a specific record or relevant portion of a record
227227 16 shall not be exempt when the record is publicly cited and
228228 17 identified by the head of the public body. The exemption
229229 18 provided in this paragraph (f) extends to all those
230230 19 records of officers and agencies of the General Assembly
231231 20 that pertain to the preparation of legislative documents.
232232 21 (g) Trade secrets and commercial or financial
233233 22 information obtained from a person or business where the
234234 23 trade secrets or commercial or financial information are
235235 24 furnished under a claim that they are proprietary,
236236 25 privileged, or confidential, and that disclosure of the
237237 26 trade secrets or commercial or financial information would

248248 1 cause competitive harm to the person or business, and only
249249 2 insofar as the claim directly applies to the records
250250 3 requested.
251251 4 The information included under this exemption includes
252252 5 all trade secrets and commercial or financial information
253253 6 obtained by a public body, including a public pension
254254 7 fund, from a private equity fund or a privately held
255255 8 company within the investment portfolio of a private
256256 9 equity fund as a result of either investing or evaluating
257257 10 a potential investment of public funds in a private equity
258258 11 fund. The exemption contained in this item does not apply
259259 12 to the aggregate financial performance information of a
260260 13 private equity fund, nor to the identity of the fund's
261261 14 managers or general partners. The exemption contained in
262262 15 this item does not apply to the identity of a privately
263263 16 held company within the investment portfolio of a private
264264 17 equity fund, unless the disclosure of the identity of a
265265 18 privately held company may cause competitive harm.
266266 19 Nothing contained in this paragraph (g) shall be
267267 20 construed to prevent a person or business from consenting
268268 21 to disclosure.
269269 22 (h) Proposals and bids for any contract, grant, or
270270 23 agreement, including information which if it were
271271 24 disclosed would frustrate procurement or give an advantage
272272 25 to any person proposing to enter into a contractor
273273 26 agreement with the body, until an award or final selection

285285 2 preparation of a bid solicitation shall be exempt until an
286286 3 award or final selection is made.
287287 4 (i) Valuable formulae, computer geographic systems,
288288 5 designs, drawings, and research data obtained or produced
289289 6 by any public body when disclosure could reasonably be
290290 7 expected to produce private gain or public loss. The
291291 8 exemption for "computer geographic systems" provided in
292292 9 this paragraph (i) does not extend to requests made by
293293 10 news media as defined in Section 2 of this Act when the
294294 11 requested information is not otherwise exempt and the only
295295 12 purpose of the request is to access and disseminate
296296 13 information regarding the health, safety, welfare, or
297297 14 legal rights of the general public.
298298 15 (j) The following information pertaining to
299299 16 educational matters:
300300 17 (i) test questions, scoring keys, and other
301301 18 examination data used to administer an academic
302302 19 examination;
303303 20 (ii) information received by a primary or
304304 21 secondary school, college, or university under its
305305 22 procedures for the evaluation of faculty members by
306306 23 their academic peers;
307307 24 (iii) information concerning a school or
308308 25 university's adjudication of student disciplinary
309309 26 cases, but only to the extent that disclosure would

333333 14 but only to the extent that disclosure would compromise

335335 16 (l) Minutes of meetings of public bodies closed to the
336336 17 public as provided in the Open Meetings Act until the
337337 18 public body makes the minutes available to the public
338338 19 under Section 2.06 of the Open Meetings Act.
339339 20 (m) Communications between a public body and an
340340 21 attorney or auditor representing the public body that
341341 22 would not be subject to discovery in litigation, and
342342 23 materials prepared or compiled by or for a public body in
343343 24 anticipation of a criminal, civil, or administrative
344344 25 proceeding upon the request of an attorney advising the
345345 26 public body, and materials prepared or compiled with

357357 2 (n) Records relating to a public body's adjudication
358358 3 of employee grievances or disciplinary cases; however,
359359 4 this exemption shall not extend to the final outcome of
360360 5 cases in which discipline is imposed.
361361 6 (o) Administrative or technical information associated
362362 7 with automated data processing operations, including, but
363363 8 not limited to, software, operating protocols, computer
364364 9 program abstracts, file layouts, source listings, object
365365 10 modules, load modules, user guides, documentation
366366 11 pertaining to all logical and physical design of
367367 12 computerized systems, employee manuals, and any other
368368 13 information that, if disclosed, would jeopardize the
369369 14 security of the system or its data or the security of
370370 15 materials exempt under this Section.
371371 16 (p) Records relating to collective negotiating matters
372372 17 between public bodies and their employees or
373373 18 representatives, except that any final contract or
374374 19 agreement shall be subject to inspection and copying.
375375 20 (q) Test questions, scoring keys, and other
376376 21 examination data used to determine the qualifications of
377377 22 an applicant for a license or employment.
378378 23 (r) The records, documents, and information relating
379379 24 to real estate purchase negotiations until those
380380 25 negotiations have been completed or otherwise terminated.
381381 26 With regard to a parcel involved in a pending or actually

409409 18 examination, operating, or condition reports prepared by,
410410 19 on behalf of, or for the use of a public body responsible
411411 20 for the regulation or supervision of financial
412412 21 institutions, insurance companies, or pharmacy benefit
413413 22 managers, unless disclosure is otherwise required by State

415415 24 (u) Information that would disclose or might lead to

439439 12 include such things as details pertaining to the
440440 13 mobilization or deployment of personnel or equipment, to
441441 14 the operation of communication systems or protocols, to
442442 15 cybersecurity vulnerabilities, or to tactical operations.

444444 17 (x) Maps and other records regarding the location or
445445 18 security of generation, transmission, distribution,
446446 19 storage, gathering, treatment, or switching facilities
447447 20 owned by a utility, by a power generator, or by the

450450 23 bids, or negotiations related to electric power

588588 17 Sec. 7. Exemptions.
589589 18 (1) When a request is made to inspect or copy a public
590590 19 record that contains information that is exempt from
591591 20 disclosure under this Section, but also contains information
592592 21 that is not exempt from disclosure, the public body may elect
593593 22 to redact the information that is exempt. The public body
594594 23 shall make the remaining information available for inspection
595595 24 and copying. Subject to this requirement, the following shall

621621 15 the disclosure is consented to in writing by the
622622 16 individual subjects of the information. "Unwarranted
623623 17 invasion of personal privacy" means the disclosure of
624624 18 information that is highly personal or objectionable to a
625625 19 reasonable person and in which the subject's right to
626626 20 privacy outweighs any legitimate public interest in
627627 21 obtaining the information. The disclosure of information
628628 22 that bears on the public duties of public employees and
629629 23 officials shall not be considered an invasion of personal
630630 24 privacy.
631631 25 (d) Records in the possession of any public body

646646 4 (i) interfere with pending or actually and
647647 5 reasonably contemplated law enforcement proceedings
648648 6 conducted by any law enforcement or correctional
649649 7 agency that is the recipient of the request;
650650 8 (ii) interfere with active administrative
651651 9 enforcement proceedings conducted by the public body
652652 10 that is the recipient of the request;
653653 11 (iii) create a substantial likelihood that a
654654 12 person will be deprived of a fair trial or an impartial
655655 13 hearing;
656656 14 (iv) unavoidably disclose the identity of a
657657 15 confidential source, confidential information
658658 16 furnished only by the confidential source, or persons

660660 18 administrative, investigative, law enforcement, or
661661 19 penal agencies; except that the identities of
662662 20 witnesses to traffic crashes, traffic crash reports,
663663 21 and rescue reports shall be provided by agencies of
664664 22 local government, except when disclosure would
665665 23 interfere with an active criminal investigation
666666 24 conducted by the agency that is the recipient of the

684684 6 agency or public body that is the recipient of the
685685 7 request;
686686 8 (vi) endanger the life or physical safety of law
687687 9 enforcement personnel or any other person; or
688688 10 (vii) obstruct an ongoing criminal investigation
689689 11 by the agency that is the recipient of the request.
690690 12 (d-5) A law enforcement record created for law
691691 13 enforcement purposes and contained in a shared electronic
692692 14 record management system if the law enforcement agency
693693 15 that is the recipient of the request did not create the
694694 16 record, did not participate in or have a role in any of the
695695 17 events which are the subject of the record, and only has
696696 18 access to the record through the shared electronic record
697697 19 management system.
698698 20 (d-6) Records contained in the Officer Professional
699699 21 Conduct Database under Section 9.2 of the Illinois Police
700700 22 Training Act, except to the extent authorized under that
701701 23 Section. This includes the documents supplied to the
702702 24 Illinois Law Enforcement Training Standards Board from the

769769 19 (f) Preliminary drafts, notes, recommendations,
770770 20 memoranda, and other records in which opinions are
771771 21 expressed, or policies or actions are formulated, except
772772 22 that a specific record or relevant portion of a record
773773 23 shall not be exempt when the record is publicly cited and
774774 24 identified by the head of the public body. The exemption
775775 25 provided in this paragraph (f) extends to all those
776776 26 records of officers and agencies of the General Assembly

788788 2 (g) Trade secrets and commercial or financial
789789 3 information obtained from a person or business where the
790790 4 trade secrets or commercial or financial information are
791791 5 furnished under a claim that they are proprietary,
792792 6 privileged, or confidential, and that disclosure of the
793793 7 trade secrets or commercial or financial information would
794794 8 cause competitive harm to the person or business, and only
795795 9 insofar as the claim directly applies to the records
796796 10 requested.
797797 11 The information included under this exemption includes
798798 12 all trade secrets and commercial or financial information
799799 13 obtained by a public body, including a public pension
800800 14 fund, from a private equity fund or a privately held
801801 15 company within the investment portfolio of a private
802802 16 equity fund as a result of either investing or evaluating
803803 17 a potential investment of public funds in a private equity
804804 18 fund. The exemption contained in this item does not apply
805805 19 to the aggregate financial performance information of a
806806 20 private equity fund, nor to the identity of the fund's
807807 21 managers or general partners. The exemption contained in
808808 22 this item does not apply to the identity of a privately
809809 23 held company within the investment portfolio of a private
810810 24 equity fund, unless the disclosure of the identity of a
811811 25 privately held company may cause competitive harm.

825825 3 (h) Proposals and bids for any contract, grant, or
826826 4 agreement, including information which if it were
827827 5 disclosed would frustrate procurement or give an advantage
828828 6 to any person proposing to enter into a contractor
829829 7 agreement with the body, until an award or final selection
830830 8 is made. Information prepared by or for the body in
831831 9 preparation of a bid solicitation shall be exempt until an
832832 10 award or final selection is made.
833833 11 (i) Valuable formulae, computer geographic systems,
834834 12 designs, drawings, and research data obtained or produced
835835 13 by any public body when disclosure could reasonably be
836836 14 expected to produce private gain or public loss. The
837837 15 exemption for "computer geographic systems" provided in
838838 16 this paragraph (i) does not extend to requests made by
839839 17 news media as defined in Section 2 of this Act when the
840840 18 requested information is not otherwise exempt and the only
841841 19 purpose of the request is to access and disseminate
842842 20 information regarding the health, safety, welfare, or
843843 21 legal rights of the general public.
844844 22 (j) The following information pertaining to
845845 23 educational matters:
846846 24 (i) test questions, scoring keys, and other
847847 25 examination data used to administer an academic

869869 11 (k) Architects' plans, engineers' technical
870870 12 submissions, and other construction related technical
871871 13 documents for projects not constructed or developed in
872872 14 whole or in part with public funds and the same for
873873 15 projects constructed or developed with public funds,
874874 16 including, but not limited to, power generating and
875875 17 distribution stations and other transmission and
876876 18 distribution facilities, water treatment facilities,
877877 19 airport facilities, sport stadiums, convention centers,
878878 20 and all government owned, operated, or occupied buildings,
879879 21 but only to the extent that disclosure would compromise
880880 22 security.
881881 23 (l) Minutes of meetings of public bodies closed to the
882882 24 public as provided in the Open Meetings Act until the
883883 25 public body makes the minutes available to the public
884884 26 under Section 2.06 of the Open Meetings Act.

905905 11 this exemption shall not extend to the final outcome of
906906 12 cases in which discipline is imposed.
907907 13 (o) Administrative or technical information associated
908908 14 with automated data processing operations, including, but
909909 15 not limited to, software, operating protocols, computer
910910 16 program abstracts, file layouts, source listings, object
911911 17 modules, load modules, user guides, documentation
912912 18 pertaining to all logical and physical design of
913913 19 computerized systems, employee manuals, and any other
914914 20 information that, if disclosed, would jeopardize the
915915 21 security of the system or its data or the security of
916916 22 materials exempt under this Section.
917917 23 (p) Records relating to collective negotiating matters
918918 24 between public bodies and their employees or
919919 25 representatives, except that any final contract or
920920 26 agreement shall be subject to inspection and copying.
