1515 1 AN ACT concerning criminal law.
1616 2 Be it enacted by the People of the State of Illinois,

1818 4 Section 5. The Freedom of Information Act is amended by

375375 8 Sec. 5. Definitions. As used in this Act:
376376 9 "Authority" means the Illinois Criminal Justice
377377 10 Information Authority.
378378 11 "Drone" means any aerial vehicle that does not carry a
379379 12 human operator.
380380 13 "Information" means any evidence, images, sounds, data, or
381381 14 other information gathered by a drone. "Information" does not
382382 15 include data gathered under circumstances in which the drone
383383 16 is used over publicly owned property or private property with
384384 17 prior permission of the owner of the private property when the
385385 18 purpose is training peace officers, public relations,
386386 19 conducting infrastructure inspections, or other similar
387387 20 non-law enforcement purposes.
388388 21 "Law enforcement agency" means any agency of this State or
389389 22 a political subdivision of this State which is vested by law
390390 23 with the duty to maintain public order and to enforce criminal

402402 1 "Special event" means a nonroutine activity that is open
403403 2 to the public within a community and brings together a large
404404 3 number of people.

407407 6 Sec. 15. Exceptions. This Act does not prohibit the use of
408408 7 a drone by a law enforcement agency:
409409 8 (1) To counter a high risk of a terrorist attack by a
410410 9 specific individual or organization if the United States
411411 10 Secretary of Homeland Security determines that credible
412412 11 intelligence indicates that there is that risk.
413413 12 (2) If a law enforcement agency first obtains a search
414414 13 warrant based on probable cause issued under Section 108-3
415415 14 of the Code of Criminal Procedure of 1963. The warrant
416416 15 must be limited to a period of 45 days, renewable by the
417417 16 judge upon a showing of good cause for subsequent periods
418418 17 of 45 days.
419419 18 (3) If a law enforcement agency possesses reasonable
420420 19 suspicion that, under particular circumstances, swift
421421 20 action is needed to prevent imminent harm to life, or to
422422 21 forestall the imminent escape of a suspect or the
423423 22 destruction of evidence. The use of a drone under this
424424 23 paragraph (3) is limited to a period of 48 hours. Within 24
425425 24 hours of the initiation of the use of a drone under this

438438 2 drone to the local State's Attorney.
439439 3 (4) If a law enforcement agency is attempting to
440440 4 locate a missing person, and is not also undertaking a
441441 5 criminal investigation.
442442 6 (5) If a law enforcement agency is using a drone
443443 7 solely for crime scene and traffic crash scene
444444 8 photography. Crime scene and traffic crash photography
445445 9 must be conducted in a geographically confined and
446446 10 time-limited manner to document specific occurrences. The
447447 11 use of a drone under this paragraph (5) on private
448448 12 property requires either a search warrant based on
449449 13 probable cause under Section 108-3 of the Code of Criminal
450450 14 Procedure of 1963 or lawful consent to search. The use of a
451451 15 drone under this paragraph (5) on lands, highways,
452452 16 roadways, or areas belonging to this State or political
453453 17 subdivisions of this State does not require a search
454454 18 warrant or consent to search. Any law enforcement agency
455455 19 operating a drone under this paragraph (5) shall make
456456 20 every reasonable attempt to only photograph the crime
457457 21 scene or traffic crash scene and avoid other areas.
458458 22 (6) If a law enforcement agency is using a drone
459459 23 during a disaster or public health emergency, as defined
460460 24 by Section 4 of the Illinois Emergency Management Agency
461461 25 Act. The use of a drone under this paragraph (6) does not
462462 26 require an official declaration of a disaster or public

473473 1 health emergency prior to use. A law enforcement agency
474474 2 may use a drone under this paragraph (6) to obtain
475475 3 information necessary for the determination of whether or
476476 4 not a disaster or public health emergency should be
477477 5 declared, to monitor weather or emergency conditions, to
478478 6 survey damage, or to otherwise coordinate response and
479479 7 recovery efforts. The use of a drone under this paragraph
480480 8 (6) is permissible during the disaster or public health
481481 9 emergency and during subsequent response and recovery
482482 10 efforts.
483483 11 (7) If a law enforcement agency is using a drone at a
484484 12 special event to:
485485 13 (A) prepare for or monitor crowd size, density,
486486 14 and movement;
487487 15 (B) assess public safety staffing; or
488488 16 (C) monitor the safety of the participants.
489489 17 (8) If a law enforcement agency is using a drone to
490490 18 respond to Public Safety Answering Point (PSAP) dispatched
491491 19 calls for service and the primary purpose for the response
492492 20 is to locate or assist victims, or both, identify
493493 21 offenders, or guide emergency response.

508508 1 15 of this Act, the agency within 30 days shall destroy all
509509 2 information gathered by the drone, except that the a
510510 3 supervisor at that agency may retain particular information
511511 4 if:
512512 5 (1) there is reasonable suspicion that the information
513513 6 contains evidence of criminal activity; , or
514514 7 (2) the information is relevant to an ongoing
515515 8 investigation or pending criminal trial; .
516516 9 (3) the information is required to be retained to
517517 10 comply with the Local Records Commission retention
518518 11 schedules; or
519519 12 (4) a supervisor at the agency deems that the
520520 13 information will be used exclusively for training
521521 14 purposes.
522522 15 (b) If a law enforcement agency uses a drone under Section
523523 16 15 at any demonstration, protest, rally, march, parade, or
524524 17 other gathering held for the purpose of expressing political,
525525 18 religious, social, or other views, the law enforcement agency
526526 19 shall destroy all information gathered by the drone within 7
527527 20 days, except that the agency may retain the particular
528528 21 information if:
529529 22 (1) there is reasonable suspicion that the information
530530 23 contains evidence of criminal activity; or
531531 24 (2) the information is relevant to an ongoing
532532 25 investigation or pending criminal trial.
