1313 1 AN ACT concerning government.
1414 2 Be it enacted by the People of the State of Illinois,
1515 3 represented in the General Assembly:
1616 4 Section 1. Short title. This Act may be cited as the Local
1717 5 Officer Eligibility Act.
1818 6 Section 5. Definitions.
1919 7 "Federal office" means the office of the President or Vice
2020 8 President of the United States or of a member of the United
2121 9 States Congress.
2222 10 "Judicial office" has the meaning ascribed to that term in
2323 11 Section 7-4 of the Election Code.
2424 12 "Law enforcement officer" has the meaning ascribed to that
2525 13 term in Section 5 of the Law Enforcement Officer Bulletproof
2626 14 Vest Act.
2727 15 "Local office" means the office of a board member of a unit
2828 16 of local government or any other elected or appointed office
2929 17 of a unit of local government.
3030 18 "Office" means a State office, local office, federal
3131 19 office, or judicial office.
3232 20 "State office" means the office of the Governor,
3333 21 Lieutenant Governor, Attorney General, Secretary of State,
3434 22 State Comptroller, or State Treasurer, the office of a member

7474 1 Section 10. Candidacy for office. A person seeking a local

7878 5 Section 15. Local officers seeking another office.
7979 6 (a) If a local officer seeks to become a candidate for
8080 7 another office and any part of the terms run concurrently with
8181 8 each other, the person must first resign the local office that
8282 9 the officer presently holds. Resignation shall be under the
8383 10 following conditions:
8484 11 (1) The resignation is irrevocable.
8585 12 (2) The written resignation must be submitted at least
8686 13 10 days prior to the earliest date to file the person's
8787 14 petition for nomination for the other office under the
8888 15 Election Code.
8989 16 (3) The resignation must be effective no later than
9090 17 the date the local officer would take office in the new
9191 18 office, if elected. The office is deemed vacant upon the
9292 19 effective date of the resignation submitted by the local
9393 20 officer in the letter of resignation.
9494 21 (4) An elected or appointed local officer must submit
9595 22 his or her written resignation to the clerk, or individual
9696 23 holding a similar position, of the unit of local

109109 2 (b) This Section does not apply to a local officer if the
110110 3 term of the office that the officer presently holds is
111111 4 scheduled to expire or to be filled by election or appointment
112112 5 on or before the date the local officer's term would begin in
113113 6 the office that the officer is seeking.
114114 7 Section 20. Seeking the office of the sheriff. A person
115115 8 who is a deputy sheriff, county corrections officer, court
116116 9 security officer, or other person a sheriff otherwise
117117 10 supervises must resign as provided under subsection (a) of
118118 11 Section 15 if the person is seeking to qualify for the office
119119 12 of the sheriff, except that the person shall submit the
120120 13 resignation to the sheriff and the local election authority.
121121 14 Section 25. Failure to submit resignation; penalties;
122122 15 notice.
123123 16 (a) The failure of a local officer to submit a resignation
124124 17 under Section 15 or a person in a sheriff's office required to
125125 18 submit a resignation under Section 20 constitutes an
126126 19 automatic, irrevocable resignation by the local officer from
127127 20 the office the officer presently holds or from the position
128128 21 the person holds in the sheriff's office, effective 14 days
129129 22 after the filing of a petition for nomination for the other
130130 23 office or office of the sheriff, as applicable.

142142 1 automatic resignation has occurred under subsection (a) upon
143143 2 the filing of each petition for nomination. The local election
144144 3 authority shall send a notice of the automatic resignation to
145145 4 the individual and to the office of the unit of local
146146 5 government in which the individual was a officer or was
147147 6 employed. In the case of a deputy sheriff, county corrections
148148 7 officer, court security officer, or other person a sheriff
149149 8 otherwise supervises, the election authority shall also submit
150150 9 a copy of the automatic resignation to the sheriff.
151151 10 Section 30. Federal, judicial, and State officers seeking
152152 11 local office; penalties for failure to resign.
153153 12 (a) A person who holds a federal office, judicial office,
154154 13 or State office may not file a petition for nomination for a
155155 14 local office unless the person first resigns in the same
156156 15 manner as required under Section 15, except that the officer
157157 16 must file the officer's resignation with the appropriate
158158 17 persons or entities to effectuate the resignation. The officer
159159 18 must file a copy of the resignation with the local election
160160 19 authority in which the officer will be filing a petition for
161161 20 nomination for a local office.
162162 21 (b) Failure to submit a resignation and a copy to the local
163163 22 election authority under this Section shall make the person
164164 23 ineligible to hold the local office for which the person filed
165165 24 a petition for nomination. The local election authority shall

178178 2 (c) This Section does not apply to a federal, judicial, or

180180 4 presently holds is scheduled to expire or be filled by

183183 7 seeking.
184184 8 Section 35. Appointive entities. This Act does not apply
185185 9 to a person already appointed to or is seeking appointment to
186186 10 an appointive board, task force, commission, or authority.
187187 11 Section 40. Conflict with other provisions of law.
188188 12 (a) To the extent this Act conflicts with the Officer
189189 13 Prohibited Activities Act, the Officer Prohibited Activities
190190 14 Act controls.
191191 15 (b) Except as provided for in subsection (a), to the
192192 16 extent this Act conflicts with any other provision of law,
193193 17 this Act controls.
194194 18 Section 90. Home rule. A home rule unit that has the
195195 19 authority to set eligibility requirements for local office may
196196 20 not set eligibility requirements for local office in a manner
197197 21 inconsistent with this Act. This Act is a limitation under
198198 22 subsection (i) of Section 6 of Article VII of the Illinois

363363 2 Such sheets before being filed shall be neatly fastened
364364 3 together in book form, by placing the sheets in a pile and
365365 4 fastening them together at one edge in a secure and suitable

367367 6 The sheets shall not be fastened by pasting them together end
368368 7 to end, so as to form a continuous strip or roll. All petition
