1111 1 AN ACT concerning regulation.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Pharmacy Practice Act is amended by
1515 5 changing Section 10 as follows:

1717 7 (Section scheduled to be repealed on January 1, 2028)
1818 8 Sec. 10. State Board of Pharmacy.
1919 9 (a) There is created in the Department the the State Board
2020 10 of Pharmacy. It shall consist of 11 members, 8 of whom shall be
2121 11 licensed pharmacists. One of the licensed pharmacists shall
2222 12 have a primary site for the practice of pharmacy at an
2323 13 inpatient hospital pharmacy. Each of those 8 members must be a
2424 14 licensed pharmacist in good standing in this State, a graduate
2525 15 of an accredited college of pharmacy or hold a Bachelor of
2626 16 Science degree in Pharmacy and have at least 5 years'
2727 17 practical experience in the practice of pharmacy subsequent to
2828 18 the date of his licensure as a licensed pharmacist in the State
2929 19 of Illinois. There shall be one member who is a pharmacy
3030 20 technician. There shall be 2 public members, who shall be
3131 21 voting members, who shall not be engaged in any way, directly
3232 22 or indirectly, as providers of health care in this State or any
3333 23 other state.

6868 1 (b) Each member shall be appointed by the Governor.
6969 2 (c) Members shall be appointed to 5 year terms. The
7070 3 Governor shall fill any vacancy for the remainder of the
7171 4 unexpired term. Partial terms over 3 years in length shall be
7272 5 considered full terms. A member may be reappointed for a
7373 6 successive term, but no member shall serve more than 2 full
7474 7 terms in his or her lifetime.
7575 8 (d) In making the appointment of members on the Board, the
7676 9 Governor shall give due consideration to recommendations by
7777 10 the members of the profession of pharmacy and by pharmacy
7878 11 organizations therein. The Governor shall notify the pharmacy
7979 12 organizations promptly of any vacancy of members on the Board
8080 13 and in appointing members shall give consideration to
8181 14 individuals engaged in all types and settings of pharmacy
8282 15 practice.
8383 16 (e) The Governor may remove any member of the Board for
8484 17 misconduct, incapacity, or neglect of duty, and he or she
8585 18 shall be the sole judge of the sufficiency of the cause for
8686 19 removal.
8787 20 (f) Each member of the Board shall be reimbursed for such
8888 21 actual and legitimate expenses as he or she may incur in going
8989 22 to and from the place of meeting and remaining there during
9090 23 sessions of the Board.
9191 24 (g) The Board shall hold quarterly meetings at such times
9292 25 and places and upon notice as the Department may determine and
9393 26 as its business may require. A majority of the Board members

104104 1 currently appointed shall constitute a quorum. A vacancy in
105105 2 the membership of the Board shall not impair the right of a
106106 3 quorum to exercise all the rights and perform all the duties of
107107 4 the Board.
108108 5 (h) The Board shall exercise the rights, powers and duties
109109 6 which have been vested in the Board under this Act, and any
110110 7 other duties conferred upon the Board by law.
