                            103RD GENERAL ASSEMBLY State of Illinois 2023 and 2024 HB3128 Introduced , by Rep. Anna Moeller SYNOPSIS AS INTRODUCED:  415 ILCS 170/40 new  Amends the PFAS Reduction Act. Provides that the Illinois Environmental Protection Agency shall establish a take-back program for local fire departments and fire protection districts that use and store firefighting foam containing PFAS. Provides that fire departments and fire protection districts that participated in the most recent PFAS survey shall be eligible to participate in the program, but participation in the program shall not be required. Provides that the program shall provide funding and resources to ensure the proper destruction of firefighting foam containing PFAS. Provides that the program shall commence within 6 months after the effective date and continue for a period of 5 years or until the Office of the State Fire Marshall finds that no firefighting foam containing PFAS is reported in the PFAS survey. 1  AN ACT concerning safety.
2  Be it enacted by the People of the State of Illinois,
3  represented in the General Assembly:
4  Section 5. The PFAS Reduction Act is amended by adding
5  Section 40 as follows:
6  (415 ILCS 170/40 new)
7  Sec. 40. PFAS disposal program. The Agency shall establish
8  a take-back program for local fire departments and fire
9  protection districts that use and store firefighting foam
10  containing PFAS. Fire departments and fire protection
11  districts that participated in the most recent survey
12  described in Section 25 shall be eligible to participate in
13  the program, but participation in the program shall not be
14  required. The program shall provide funding and resources to
15  ensure the proper destruction of firefighting foam containing
16  PFAS. The program shall commence within 6 months after the
17  effective date of this amendatory Act of the 103rd General
18  Assembly and continue for a period of 5 years or until the
19  Office of the State Fire Marshall finds that no firefighting
20  foam containing PFAS is reported in the survey described in
21  Section 25.
22  Section 99. Effective date. This Act takes effect upon
