11	11	1 AN ACT concerning education.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 5. The Public Community College Act is amended by
15	15	5 adding Section 3-29.26 as follows:
16	16	6 (110 ILCS 805/3-29.26 new)
17	17	7 Sec. 3-29.26. Federal Public Service Loan Forgiveness
18	18	8 Program.
19	19	9 (a) In this Section:
20	20	10 "Certifying employment" means either completing the
21	21	11 employer sections of the public service loan forgiveness form
22	22	12 or sharing data directly with the U.S. Department of Education
23	23	13 that corresponds to the information required for the public
24	24	14 service loan forgiveness form.
25	25	15 "Employee" means someone who works for a public service
26	26	16 employer, regardless of whether the public service employer
27	27	17 considers that work to be full time, part time, contingent, or
28	28	18 contracted.
29	29	19 "Full time" means, for the purpose of certifying
30	30	20 employment only, working at least an average of 30 hours per
31	31	21 week or at least an average of 30 hours per week throughout a
32	32	22 contractual or employment period of at least 8 months in a
33	33	23 12-month period, provided that if the U.S. Department of

68	68	1 Education adopts a lower hourly standard, that standard
69	69	2 applies.
70	70	3 "Public service employer" means any community college
71	71	4 district designated as a public service organization or
72	72	5 employer by the U.S. Department of Education for the purpose
73	73	6 of the federal Public Service Loan Forgiveness Program.
74	74	7 "Public service loan forgiveness form" means the form
75	75	8 used by the U.S. Department of Education to certify an
76	76	9 individual's employment at a public service organization and
77	77	10 determine eligibility for the purposes of the federal Public
78	78	11 Service Loan Forgiveness Program.
79	79	12 (b) The State Board shall develop materials designed to
80	80	13 increase awareness of the federal Public Service Loan
81	81	14 Forgiveness Program at community college districts. The
82	82	15 materials shall include the following:
83	83	16 (1) a one-page form letter, for use by community
84	84	17 college districts to notify faculty employees who may be
85	85	18 eligible for the federal Public Service Loan Forgiveness
86	86	19 Program, that briefly summarizes the program, provides
87	87	20 information on what an eligible faculty employee is
88	88	21 required to do in order to participate, and recommends
89	89	22 that the faculty employee contact the faculty employee's
90	90	23 loan servicer or servicers for additional information.
91	91	24 (2) a detailed fact sheet describing the federal
92	92	25 Public Service Loan Forgiveness Program; and
93	93	26 (3) a document containing answers to frequently asked

106	106	3 (c) The State Board shall provide the materials described
107	107	4 in subsection (b) to each community college district for
108	108	5 distribution to faculty employees.
109	109	6 (d) A board shall annually provide to all faculty
110	110	7 employees the materials described in subsection (b) in written
111	111	8 or electronic form.
112	112	9 (e) A board shall provide a newly hired faculty employee
113	113	10 with the materials described in subsection (b) within 30 days
114	114	11 after the faculty employee's first day of employment.
115	115	12 (f) A board shall annually provide a faculty employee who
116	116	13 is enrolled in the federal Public Service Loan Forgiveness
117	117	14 Program with notice of renewal and a copy of the employment
118	118	15 certification form, with the employer portion of the form
119	119	16 already completed. A board may not unreasonably delay
120	120	17 completing the employer portion of the employment
121	121	18 certification form.
122	122	19 (g) For the purpose of qualifying for the federal Public
123	123	20 Service Loan Forgiveness Program, a board shall, in completing
124	124	21 the employer portion of the employment certification form,
125	125	22 credit a faculty employee with at least 3.35 hours worked for
126	126	23 each hour of lecture or classroom time. This subsection (g)
127	127	24 does not supersede any higher adjustment factor established by
128	128	25 a collective bargaining agreement or employer policy in
129	129	26 recognition of the amount of out-of-class work that is

144	144	5 hour with no adjustment factor.
145	145	6 (h) When determining whether an employee is considered
146	146	7 full time for the purpose of certifying employment for the
147	147	8 federal Public Service Loan Forgiveness Program only, a board
148	148	9 may not treat any adjusted total hours worked pursuant to
149	149	10 subsection (g) differently from hours worked without an
150	150	11 adjustment factor.
