11	11	1 AN ACT concerning local government.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 5. The Township Code is amended by changing
15	15	5 Section 235-25 as follows:
16	16	6 (60 ILCS 1/235-25)
17	17	7 Sec. 235-25. Tentative budget and appropriation ordinance
18	18	8 and tax for road purposes. In each road district comprised of
19	19	9 a single township:
20	20	10 (1) The township board must hold a public hearing
21	21	11 before adopting a budget and appropriation ordinance for
22	22	12 road purposes.
23	23	13 (2) The township board must, at least 30 days before a
24	24	14 public hearing, prepare or cause to be prepared a
25	25	15 tentative budget and appropriation ordinance for road
26	26	16 purposes and file the ordinance with the township clerk.
27	27	17 The township clerk must make the tentative budget and
28	28	18 appropriation ordinance for road purposes available for
29	29	19 public inspection for at least 30 days before final action
30	30	20 on the ordinance. The required public hearing must be held
31	31	21 on or before the last day of the first quarter of the
32	32	22 fiscal year before the township board. Notice of the
33	33	23 hearing must be given by publication in a newspaper

69	69	2 of the hearing. If there is no newspaper published in the
70	70	3 township, notice of the public hearing may be given by
71	71	4 posting notices in 5 of the most public places in the
72	72	5 township. It is the duty of the township clerk to arrange
73	73	6 for the public hearing.
74	74	7 (3) The , the township board may shall adopt all or
75	75	8 part of a tentative budget and appropriation ordinance for
76	76	9 road purposes, as the township board deems necessary, and
77	77	10 shall levy the amount determined by the board highway
78	78	11 commissioner and certify to the county clerk the amount
79	79	12 necessary to be raised by taxation for road purposes as
80	80	13 provided in Section 6-501 of the Illinois Highway Code.
