1111 1 AN ACT concerning civil law.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 1. Short title. This Act may be cited as the Public
1515 5 Duty Rule Codification Act.
1616 6 Section 5. Findings; purpose.
1717 7 (a) The General Assembly finds:
1818 8 (1) On January 22, 2016, the Illinois Supreme Court,
1919 9 in Coleman v. East Joliet Fire Protection District, 2016
2020 10 IL 117952, abolished the public duty rule.
2121 11 (2) The public duty rule is an important doctrine that
2222 12 is grounded in the principle that the duty of a local
2323 13 governmental entity to preserve the well-being of the
2424 14 community is owed to the public at large rather than to
2525 15 specific members of the community.
2626 16 (b) It is the purpose of this Act to codify the public duty
2727 17 rule.
2828 18 Section 10. Public duty rule. A local governmental entity
2929 19 and its employees owe a duty of care to the public at large,
3030 20 therefore it does not owe a duty of care to individual members
3131 21 of the public to provide governmental services.
