1212 1 AN ACT concerning State government.
1313 2 Be it enacted by the People of the State of Illinois,
1414 3 represented in the General Assembly:
1515 4 Section 1. Short title. This Act may be cited as the
1616 5 Commission on Fiscal Responsibility and Reform Act.
1717 6 Section 5. Definition. As used in this Act, "Commission"
1818 7 means the Commission on Fiscal Responsibility and Reform.
1919 8 Section 10. Commission established; members.
2020 9 (a) The Commission on Fiscal Responsibility and Reform is
2121 10 hereby established.
2222 11 (b) The Commission shall consist of 18 voting members, all
2323 12 from the private sector, appointed as follows:
2424 13 (1) 3 members appointed by the Speaker of the House of
2525 14 Representatives;
2626 15 (2) 3 members appointed by the Minority Leader of the
2727 16 House of Representatives;
2828 17 (3) 3 members appointed by the Senate President;
2929 18 (4) 3 members appointed by the Minority Leader of the
3030 19 Senate; and
3131 20 (5) 6 members appointed by the Governor, not more than
3232 21 4 of whom shall be from the same political party.
3333 22 (c) Vacancies in the Commission shall be filled by the

7070 1 initial appointing authority.
7171 2 (d) The Governor shall designate a Chairperson from among
7272 3 the members of the Commission.
7373 4 (e) Members of the Commission shall serve without
7474 5 compensation.
7575 6 Section 15. Duties of the Commission.
7676 7 (a) The Commission shall:
7777 8 (1) conduct an in-depth review of the operations of
7878 9 executive branch State agencies for the purpose of
7979 10 evaluating potential improvements in agency operations;
8080 11 (2) provide recommendations in the following areas:
8181 12 (A) opportunities for increased efficiency and
8282 13 reduced costs to State government that can be realized
8383 14 by executive action or legislation;
8484 15 (B) opportunities for enhanced managerial
8585 16 accountability and improved administrative control;
8686 17 (C) opportunities for managerial improvements over
8787 18 the short and long term;
8888 19 (D) specific areas where further study could
8989 20 result in potential savings; and
9090 21 (E) specific recommendations concerning
9191 22 governmental expenditures, indebtedness, and personnel
9292 23 management.
9393 24 (b) The Commission shall submit a report to the Governor
9494 25 and the General Assembly no later than October 1, 2022. The

105105 1 report to the General Assembly shall be filed with the Clerk of
106106 2 the House of Representatives and the Secretary of the Senate
107107 3 in electronic form only, in the manner that the Clerk and the
108108 4 Secretary shall direct.
109109 5 Section 20. Management office; personnel. The Commission
110110 6 may establish a management office to provide administrative
111111 7 support to the Commission and guide its day-to-day operations.
112112 8 The Commission may hire such personnel as may be necessary to
113113 9 carry out the purposes of this Act.
114114 10 Section 25. Commission on Fiscal Responsibility and Reform
115115 11 Fund.
116116 12 (a) The Commission on Fiscal Responsibility and Reform
117117 13 Fund is hereby established as a special fund in the State
118118 14 treasury. The Fund may receive gifts, grants, and donations
119119 15 from any lawful private or public source. Moneys in the Fund
120120 16 shall be used by the Commission exclusively for public
121121 17 purposes.
122122 18 (b) The Commission shall be funded, staffed, and equipped,
123123 19 to the extent practicable and permitted by law, by the private
124124 20 sector without cost to the State. To accomplish this
125125 21 objective, the Commission shall be organized as a social
126126 22 welfare organization under Section 501(c)(4) of the Internal
127127 23 Revenue Code in order to allow for tax-advantaged donations to
128128 24 the Commission on Fiscal Responsibility and Reform Fund. The

139139 1 Commission is directed to apply to the Internal Revenue
140140 2 Service, on behalf of the Commission on Fiscal Responsibility
141141 3 and Reform, for a grant of standing for the Commission to
142142 4 operate as a 501(c)(4) entity under the federal Internal
143143 5 Revenue Code.
144144 6 Section 30. Repeal. This Act is repealed on October 1,
145145 7 2023.
146146 8 Section 900. The State Finance Act is amended by adding
147147 9 Section 5.999 as follows:
148148 10 (30 ILCS 105/5.999 new)
149149 11 Sec. 5.999. The Commission on Fiscal Responsibility and
150150 12 Reform Fund. This Section is repealed on October 1, 2024.
151151 13 Section 999. Effective date. This Act takes effect upon
152152 14 becoming law.
