11	11	1 AN ACT concerning economic development.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 5. The Department of Commerce and Economic
15	15	5 Opportunity Law of the Civil Administrative Code of Illinois
16	16	6 is amended by adding Section 605-419 as follows:
17	17	7 (20 ILCS 605/605-419 new)
18	18	8 Sec. 605-419. Division on Downstate Economic Development.
19	19	9 (a) The General Assembly finds that the State is a diverse
20	20	10 and vast state made up of different geographic areas and
21	21	11 unique economic environments, and there is a need to ensure
22	22	12 that the Department is prepared to face each unique challenge
23	23	13 with a unique solution. It is the purpose of this Section to
24	24	14 recognize that the needs and priorities of the regions outside
25	25	15 the State's largest urban, metropolitan area are significant
26	26	16 and, indeed, vital to the State's overall success when looking
27	27	17 at the economic success of the State. Therefore, there is
28	28	18 established within the Department a Division on Downstate
29	29	19 Economic Development.
30	30	20 (b) The Department shall provide for, staff, and
31	31	21 administer a Division on Downstate Economic Development, which
32	32	22 shall plan and coordinate existing State programs designed to
33	33	23 aid and stimulate the economic development in downstate

70	70	3 Northern Stateline Region;
71	71	4 Northwest Region;
72	72	5 West Central Region;
73	73	6 North Central Region;
74	74	7 East Central Region;

76	76	9 Southwest Region;
77	77	10 Southeast Region; and
78	78	11 Southern Region.
79	79	12 (c) To fulfill the purposes set forth in subsection (a),
80	80	13 the Department shall assign appropriate duties to the
81	81	14 Division, including, but not limited to:
82	82	15 (1) Reviewing all current Department programs,
83	83	16 offerings, and forms of assistance that exist and are
84	84	17 available to downstate communities.
85	85	18 (2) Identifying Department functions and
86	86	19 operations that need to be housed under the Division
87	87	20 on Downstate Economic Development.
88	88	21 (3) Recommending any necessary improvements to the
89	89	22 manner by which the Department administers existing
90	90	23 Department programs, offerings, and forms of
91	91	24 assistance to downstate communities.
92	92	25 (4) Facilitating and streamlining the functions of
93	93	26 the Department in order to improve the Department's

105	105	2 (5) Gathering information concerning any State or
106	106	3 Federal program that is designed to revitalize or
107	107	4 assist downstate communities in the State and
108	108	5 providing this information to public and private
109	109	6 entities upon request.
110	110	7 (6) Promoting and assisting the development,
111	111	8 redevelopment, and revitalization of downstate
112	112	9 communities.
113	113	10 (7) Promoting the maintenance of jobs and seeking
114	114	11 the creation of new job opportunities in downstate
115	115	12 communities.
116	116	13 (8) Recommending to the General Assembly and the
117	117	14 Governor economic policies that may improve the
118	118	15 economic climate in downstate communities.
119	119	16 (9) Making rules necessary to carry out its
120	120	17 responsibilities under this Law.
121	121	18 (10) Encouraging new industrial enterprises to
122	122	19 locate in downstate communities through (i)
123	123	20 educational promotions that point out the
124	124	21 opportunities of downstate communities as commercial
125	125	22 and industrial fields of opportunity, (ii)
126	126	23 solicitation of industrial enterprises, and (iii) to
127	127	24 take any actions deemed necessary and proper in order
128	128	25 to meet the duties of the Division. The Division,
129	129	26 however, shall have no power to require reports from

141	141	2 (11) Accepting grants, loans, or appropriations
142	142	3 from the federal government or the State, or any
143	143	4 agency or instrumentality thereof, to be used for the
144	144	5 operating expenses of the Division or for any purposes
145	145	6 of the Division.
146	146	7 (d) If the Department identifies that an existing Office,
147	147	8 Division, or Program (under the Department's jurisdiction)
148	148	9 performs, plans, or coordinates a function or duty of the
149	149	10 Division created under this Section that is hereby
150	150	11 established, the Department may take any necessary actions to
151	151	12 prevent, to the best of its ability, the duplication of
152	152	13 existing Department operations. The Department shall take the
153	153	14 necessary actions prior to establishing the Division to use
154	154	15 existing Department funds and resources to implement this
155	155	16 Section.
156	156	17 (e) The Assistant Director shall oversee the
157	157	18 implementation and administration of all functions and duties
158	158	19 performed by the Division under this Section.
159	159	20 (f) The Department shall adopt any rules necessary to
160	160	21 implement the provisions of this Section.
161	161	22 Section 99. Effective date. This Act takes effect upon
162	162	23 becoming law.
