11	11	1 AN ACT concerning transportation.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 5. The Illinois Vehicle Code is amended by adding
15	15	5 Section 5-110 as follows:
16	16	6 (625 ILCS 5/5-110 new)
17	17	7 Sec. 5-110. Partial driving automation feature notice
18	18	8 required.
19	19	9 (a) As used in this Section:
20	20	10 "Autonomous vehicle" means a motor vehicle that possesses
21	21	11 the capability, whether it is enabled or not, for automated
22	22	12 functions to control movement of the vehicle along 2 axes of
23	23	13 direction simultaneously.
24	24	14 "Partial driving automation feature" means a motor vehicle
25	25	15 support function that possesses the capability of providing
26	26	16 steering, breaking, acceleration, lane centering, or adaptive
27	27	17 cruise control support to the driver of the motor vehicle.
28	28	18 (b) A dealer or manufacturer shall not sell any new
29	29	19 passenger vehicle that is equipped with any partial driving
30	30	20 automation feature, or provide any software update or other
31	31	21 vehicle upgrade that adds any partial driving automation
32	32	22 feature, without, at the time of delivering or upgrading the
33	33	23 vehicle, providing the buyer or owner with a distinct notice

68	68	1 that provides the name of the feature and clearly describes
69	69	2 the functions and limitations of the feature.
70	70	3 (c) A manufacturer or dealer shall not name any partial
71	71	4 driving automation feature, or describe any partial driving
72	72	5 automation feature in marketing materials, using language that
73	73	6 implies or would otherwise lead a reasonable person to
74	74	7 believe, that the feature allows the vehicle to function as an
75	75	8 autonomous vehicle or otherwise has functionality not actually
76	76	9 included in the feature.
77	77	10 (d) Compliance with this Section shall not alter any
78	78	11 existing duty of care or limit the civil liability of a
79	79	12 manufacturer or dealer, including, but not limited to, claims
80	80	13 of negligence or product defect.
81	81	14 (e) Before delivering a passenger vehicle equipped with a
82	82	15 partial driving automation feature to a dealer, a manufacturer
83	83	16 shall provide information to enable the dealer to comply with
84	84	17 subsection (b). This information shall include specific
85	85	18 language recommended for the notice required in subsection
86	86	19 (b). A dealer may reasonably rely on the information provided
87	87	20 by the manufacturer and a dealer shall not be held in violation
88	88	21 of subsection (b) if the manufacturer fails to provide this
89	89	22 information to the dealer or if the information provided is
90	90	23 deemed to be not in compliance with this Section.
91	91	24 (f) A manufacturer shall not be held in violation of
92	92	25 subsection (b) if the manufacturer provides a dealer with the
93	93	26 information required under subsection (e) and the dealer fails
