1111 1 AN ACT concerning transportation.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Illinois Vehicle Code is amended by adding
1515 5 Section 5-110 as follows:

1717 7 Sec. 5-110. Partial driving automation feature notice
1818 8 required.
1919 9 (a) As used in this Section:
2020 10 "Autonomous vehicle" means a motor vehicle that possesses
2121 11 the capability, whether it is enabled or not, for automated
2222 12 functions to control movement of the vehicle along 2 axes of
2323 13 direction simultaneously.
2424 14 "Partial driving automation feature" means a motor vehicle
2525 15 support function that possesses the capability of providing
2626 16 steering, breaking, acceleration, lane centering, or adaptive
2727 17 cruise control support to the driver of the motor vehicle.
2828 18 (b) A dealer or manufacturer shall not sell any new
2929 19 passenger vehicle that is equipped with any partial driving
3030 20 automation feature, or provide any software update or other
3131 21 vehicle upgrade that adds any partial driving automation
3232 22 feature, without, at the time of delivering or upgrading the
3333 23 vehicle, providing the buyer or owner with a distinct notice

6868 1 that provides the name of the feature and clearly describes
6969 2 the functions and limitations of the feature.
7070 3 (c) A manufacturer or dealer shall not name any partial
7171 4 driving automation feature, or describe any partial driving
7272 5 automation feature in marketing materials, using language that
7373 6 implies or would otherwise lead a reasonable person to
7474 7 believe, that the feature allows the vehicle to function as an
7575 8 autonomous vehicle or otherwise has functionality not actually
7676 9 included in the feature.
7777 10 (d) Compliance with this Section shall not alter any
7878 11 existing duty of care or limit the civil liability of a
7979 12 manufacturer or dealer, including, but not limited to, claims
8080 13 of negligence or product defect.
8181 14 (e) Before delivering a passenger vehicle equipped with a
8282 15 partial driving automation feature to a dealer, a manufacturer
8383 16 shall provide information to enable the dealer to comply with
8484 17 subsection (b). This information shall include specific
8585 18 language recommended for the notice required in subsection
8686 19 (b). A dealer may reasonably rely on the information provided
8787 20 by the manufacturer and a dealer shall not be held in violation
8888 21 of subsection (b) if the manufacturer fails to provide this
8989 22 information to the dealer or if the information provided is
9090 23 deemed to be not in compliance with this Section.
9191 24 (f) A manufacturer shall not be held in violation of
9292 25 subsection (b) if the manufacturer provides a dealer with the
9393 26 information required under subsection (e) and the dealer fails
