1313 1 AN ACT concerning education.
1414 2 Be it enacted by the People of the State of Illinois,
1515 3 represented in the General Assembly:
1616 4 Section 5. The Critical Health Problems and Comprehensive
1717 5 Health Education Act is amended by changing Section 3 as
1818 6 follows:

2020 8 Sec. 3. Comprehensive Health Education Program. The
2121 9 program established under this Act shall include, but not be
2222 10 limited to, the following major educational areas as a basis
2323 11 for curricula in all elementary and secondary schools in this
2424 12 State: human ecology and health; human growth and development;
2525 13 the emotional, psychological, physiological, hygienic, and
2626 14 social responsibilities of family life, including sexual
2727 15 abstinence until marriage; the prevention and control of
2828 16 disease, including instruction in grades 6 through 12 on the
2929 17 prevention, transmission, and spread of AIDS; age-appropriate
3030 18 sexual abuse and assault awareness and prevention education in
3131 19 grades pre-kindergarten through 12; public and environmental
3232 20 health; consumer health; safety education and disaster
3333 21 survival; mental health and illness; personal health habits;
3434 22 alcohol and drug use and abuse, including the medical and
3535 23 legal ramifications of alcohol, drug, and tobacco use; abuse

7676 1 during pregnancy; evidence-based and medically accurate
7777 2 information regarding sexual abstinence; tobacco and
7878 3 e-cigarettes and other vapor devices; nutrition; safety around
7979 4 icy bodies of water in grades pre-kindergarten through 8; and
8080 5 dental health. The instruction on mental health and illness
8181 6 must evaluate the multiple dimensions of health by reviewing
8282 7 the relationship between physical and mental health so as to
8383 8 enhance student understanding, attitudes, and behaviors that
8484 9 promote health, well-being, and human dignity and must include
8585 10 how and where to find mental health resources and specialized
8686 11 treatment in the State. The program shall also provide course
8787 12 material and instruction to advise pupils of the Abandoned
8888 13 Newborn Infant Protection Act. The program shall include
8989 14 information about cancer, including, without limitation, types
9090 15 of cancer, signs and symptoms, risk factors, the importance of
9191 16 early prevention and detection, and information on where to go
9292 17 for help. Notwithstanding the above educational areas, the
9393 18 following areas may also be included as a basis for curricula
9494 19 in all elementary and secondary schools in this State: basic
9595 20 first aid (including, but not limited to, cardiopulmonary
9696 21 resuscitation and the Heimlich maneuver), heart disease,
9797 22 diabetes, stroke, the prevention of child abuse, neglect, and
9898 23 suicide, and teen dating violence in grades 7 through 12.
9999 24 Beginning with the 2014-2015 school year, training on how to

112112 1 Red Cross, the American Heart Association, or another
113113 2 nationally recognized certifying organization) and how to use
114114 3 an automated external defibrillator shall be included as a
115115 4 basis for curricula in all secondary schools in this State.
116116 5 The school board of each public elementary and secondary
117117 6 school in the State shall encourage all teachers and other
118118 7 school personnel to acquire, develop, and maintain the
119119 8 knowledge and skills necessary to properly administer
120120 9 life-saving techniques, including, without limitation, the
121121 10 Heimlich maneuver and rescue breathing. The training shall be
122122 11 in accordance with standards of the American Red Cross, the
123123 12 American Heart Association, or another nationally recognized
124124 13 certifying organization. A school board may use the services
125125 14 of non-governmental entities whose personnel have expertise in
126126 15 life-saving techniques to instruct teachers and other school
127127 16 personnel in these techniques. Each school board is encouraged
128128 17 to have in its employ, or on its volunteer staff, at least one
129129 18 person who is certified, by the American Red Cross or by
130130 19 another qualified certifying agency, as qualified to
131131 20 administer first aid and cardiopulmonary resuscitation. In
132132 21 addition, each school board is authorized to allocate
133133 22 appropriate portions of its institute or inservice days to
134134 23 conduct training programs for teachers and other school
135135 24 personnel who have expressed an interest in becoming qualified
136136 25 to administer emergency first aid or cardiopulmonary
137137 26 resuscitation. School boards are urged to encourage their

148148 1 teachers and other school personnel who coach school athletic
149149 2 programs and other extracurricular school activities to
150150 3 acquire, develop, and maintain the knowledge and skills
151151 4 necessary to properly administer first aid and cardiopulmonary
152152 5 resuscitation in accordance with standards and requirements
153153 6 established by the American Red Cross or another qualified
154154 7 certifying agency. Subject to appropriation, the State Board
155155 8 of Education shall establish and administer a matching grant
156156 9 program to pay for half of the cost that a school district
157157 10 incurs in training those teachers and other school personnel
158158 11 who express an interest in becoming qualified to administer
159159 12 cardiopulmonary resuscitation (which training must be in
160160 13 accordance with standards of the American Red Cross, the
161161 14 American Heart Association, or another nationally recognized
162162 15 certifying organization) or in learning how to use an
163163 16 automated external defibrillator. A school district that
164164 17 applies for a grant must demonstrate that it has funds to pay
165165 18 half of the cost of the training for which matching grant money
166166 19 is sought. The State Board of Education shall award the grants
167167 20 on a first-come, first-serve basis.
168168 21 No pupil shall be required to take or participate in any
169169 22 class or course on AIDS or family life instruction or to
170170 23 receive training on how to properly administer cardiopulmonary
171171 24 resuscitation or how to use an automated external
172172 25 defibrillator if his or her parent or guardian submits written

184184 1 course or program or the training shall not be reason for
185185 2 suspension or expulsion of the pupil.
186186 3 Curricula developed under programs established in
187187 4 accordance with this Act in the major educational area of
188188 5 alcohol and drug use and abuse shall include classroom
189189 6 instruction in grades 5 through 12. The instruction, which
190190 7 shall include matters relating to both the physical and legal
191191 8 effects and ramifications of drug and substance abuse, shall
192192 9 be integrated into existing curricula; and the State Board of
193193 10 Education shall develop and make available to all elementary
194194 11 and secondary schools in this State instructional materials
195195 12 and guidelines which will assist the schools in incorporating
196196 13 the instruction into their existing curricula. In addition,
197197 14 school districts may offer, as part of existing curricula
198198 15 during the school day or as part of an after school program,
199199 16 support services and instruction for pupils or pupils whose
200200 17 parent, parents, or guardians are chemically dependent.
