14	14	1 AN ACT concerning State government.
15	15	2 Be it enacted by the People of the State of Illinois,
16	16	3 represented in the General Assembly:
17	17	4 Section 5. The Illinois Constitutional Amendment Act is
18	18	5 amended by changing Sections 2 and 4 as follows:

20	20	7 Sec. 2. (a) The General Assembly in submitting an
21	21	8 amendment to the Constitution to the electors, or the
22	22	9 proponents of an amendment to Article IV of the Constitution
23	23	10 submitted by petition, shall prepare a brief explanation of
24	24	11 such amendment, a brief argument in favor of the same, and the
25	25	12 form in which such amendment will appear on the separate
26	26	13 ballot as provided by Section 16-6 of the Election Code, as
27	27	14 amended. The minority of the General Assembly, or if there is
28	28	15 no minority, anyone designated by the General Assembly shall
29	29	16 prepare a brief argument against such amendment. The
30	30	17 explanation, the arguments for and against each constitutional
31	31	18 amendment, and the form in which the amendment will appear on
32	32	19 the separate ballot shall be approved by a joint resolution of
33	33	20 the General Assembly and filed in the office of the Secretary
34	34	21 of State with the proposed amendment.

78	78	2 designated at the time of the filing of the petition as
79	79	3 provided in Section 10-8 of the Election Code, and the
80	80	4 opponents shall be those members of the General Assembly
81	81	5 opposing such amendment, or if there are none, anyone

84	84	8 proponent's explanation and argument in favor of and the
85	85	9 opponents argument against an amendment to Article IV
86	86	10 initiated by petition must be submitted to the Attorney
87	87	11 General, who may rewrite them for accuracy and fairness. The
88	88	12 explanation, the arguments for and against each constitutional
89	89	13 amendment, and the form in which the amendment will appear on
90	90	14 the separate ballot shall be filed in the office of the
91	91	15 Secretary of State with the proposed amendment.
92	92	16 (c) At least 2 months before the next election of members
93	93	17 of the General Assembly, following the passage of the proposed
94	94	18 amendment, the Secretary of State shall publish the amendment,
95	95	19 in full in 8 point type, or the equivalent thereto, in at least
96	96	20 one secular newspaper of general circulation in every county
97	97	21 in this State in which a newspaper is published and its digital
98	98	22 equivalent. In counties in which 2 or more newspapers are
99	99	23 published, the Secretary of State shall cause such amendment
100	100	24 to be published in 2 newspapers and their digital equivalent.
101	101	25 In counties having a population of 500,000 or more, such

114	114	2 first publication, the publication of such amendment shall be
115	115	3 repeated once each week for 2 consecutive weeks. In selecting
116	116	4 newspapers in which to publish such amendment the Secretary of
117	117	5 State shall have regard solely to the circulation of such
118	118	6 newspapers, selecting secular newspapers in every case having
119	119	7 the largest circulation. The proposed amendment shall have a
120	120	8 notice prefixed thereto in said publications, that at such
121	121	9 election the proposed amendment will be submitted to the
122	122	10 electors for adoption or rejection, and at the end of the
123	123	11 official publication, he shall also publish the form in which
124	124	12 the proposed amendment will appear on the separate ballot. The
125	125	13 Secretary of State shall fix the publication fees to be paid
126	126	14 newspapers for making such publication, but in no case shall
127	127	15 such publication fee exceed the amount charged by such
128	128	16 newspapers to private individuals for a like publication.
129	129	17 (d) In addition to the notice hereby required to be
130	130	18 published, the Secretary of State shall also cause the
131	131	19 existing form of the constitutional provision proposed to be
132	132	20 amended, the proposed amendment, the explanation of the same,
133	133	21 the arguments for and against the same, and the form in which
134	134	22 such amendment will appear on the separate ballot, to be
135	135	23 published in pamphlet form in 8 point type or the equivalent
136	136	24 thereto in English, in additional languages as required by
137	137	25 Section 203 of Title III of the federal Voting Rights Act of
138	138	26 1965, and in braille. The Secretary of State shall publish the

152	152	4 shall publish an audio version of the pamphlet, which shall be

155	155	7 (e) Except as provided in subsection (f), the Secretary of
156	156	8 State shall mail such pamphlet to every mailing address in the
157	157	9 State, addressed to the attention of the Postal Patron. He
158	158	10 shall also maintain a reasonable supply of such pamphlets so
159	159	11 as to make them available to any person requesting one.
160	160	12 (f) For any proposed constitutional amendment appearing on
161	161	13 the ballot for the general election on November 8, 2022, the
162	162	14 Secretary of State, in lieu of the requirement in subsection
163	163	15 (e) of this Act, shall mail a postcard to every mailing address
164	164	16 in the State advising that a proposed constitutional amendment
165	165	17 will be considered at the general election. The postcard shall
166	166	18 include a URL to the Secretary of State's website that
167	167	19 contains the information required in subsection (d).

255	255	2 subdivisions. In the case of nonpartisan elections for
256	256	3 officers of a political subdivision, unless the statute or an
257	257	4 ordinance adopted pursuant to Article VII of the Constitution

337	337	12 such ballot sheet there shall be a provision for the casting of
338	338	13 a write-in vote. Write-in lines equal to the number of
339	339	14 candidates for which a voter may vote shall be printed for an

341	341	16 intent to be write-in candidates or qualify to file
342	342	17 declarations to be write-in candidates under Sections 17-16.1

404	404	7 name, whether by a statutory or common law procedure in
405	405	8 Illinois or any other jurisdiction, within 3 years before the
406	406	9 last day for filing the petition for nomination, nomination
407	407	10 papers, or certificate of nomination for that office,
408	408	11 whichever is applicable, then (i) the candidate's name on the
409	409	12 ballot must be followed by "formerly known as (list all prior
410	410	13 names during the 3-year period) until name changed on (list
411	411	14 date of each such name change)" and (ii) the petition, papers,
412	412	15 or certificate must be accompanied by the candidate's
413	413	16 affidavit stating the candidate's previous names during the
414	414	17 period specified in (i) and the date or dates each of those
415	415	18 names was changed; failure to meet these requirements shall be
416	416	19 grounds for denying certification of the candidate's name for
417	417	20 the ballot or removing the candidate's name from the ballot,
418	418	21 as appropriate, but these requirements do not apply to name
419	419	22 changes resulting from adoption to assume an adoptive parent's
420	420	23 or parents' surname, marriage or civil union to assume a
421	421	24 spouse's surname, or dissolution of marriage or civil union or
422	422	25 declaration of invalidity of marriage or civil union to assume

435	435	2 designation such as a political slogan, title, or degree or
436	436	3 nickname suggesting or implying possession of a title, degree
437	437	4 or professional status, or similar information may be used in
438	438	5 connection with the candidate's surname. For purposes of this
439	439	6 Section, a "political slogan" is defined as any word or words
440	440	7 expressing or connoting a position, opinion, or belief that
441	441	8 the candidate may espouse, including, but not limited to, any
442	442	9 word or words conveying any meaning other than that of the
443	443	10 personal identity of the candidate. A candidate may not use a
444	444	11 political slogan as part of his or her name on the ballot,
445	445	12 notwithstanding that the political slogan may be part of the
446	446	13 candidate's name.
447	447	14 (f) The State Board of Elections, a local election
448	448	15 official, or an election authority shall remove any
449	449	16 candidate's name designation from a ballot that is
450	450	17 inconsistent with subsection (e) of this Section. In addition,
451	451	18 the State Board of Elections, a local election official, or an
452	452	19 election authority shall not certify to any election authority
453	453	20 any candidate name designation that is inconsistent with
454	454	21 subsection (e) of this Section.
455	455	22 (g) If the State Board of Elections, a local election
456	456	23 official, or an election authority removes a candidate's name
457	457	24 designation from a ballot under subsection (f) of this
458	458	25 Section, then the aggrieved candidate may seek appropriate
459	459	26 relief in circuit court.
