                    103RD GENERAL ASSEMBLY State of Illinois 2023 and 2024 HB3343 Introduced , by Rep. Kelly M. Burke SYNOPSIS AS INTRODUCED:  40 ILCS 5/5-214.230 ILCS 805/8.47 new  Amends the Chicago Police Article of the Illinois Pension Code. In a provision authorizing an active policeman to establish credit for certain prior law enforcement service, provides that the requirement that the policeman applies for the credit within 2 years after beginning employment does not apply to an active policeman who becomes a member of the Fund on or after December 1, 2019, makes an application for the credit in writing prior to December 31, 2023, and pays to the Fund, within 5 years after the date of application, a specified amount. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately. 1  AN ACT concerning public employee benefits.
2  Be it enacted by the People of the State of Illinois,
3  represented in the General Assembly:
4  Section 5. The Illinois Pension Code is amended by
5  changing Section 5-214.2 as follows:
6  (40 ILCS 5/5-214.2)
7  Sec. 5-214.2. Credit for certain law enforcement service.
8  An active policeman who is a member of this Fund on or before
9  the effective date of this Section may establish up to 10 years
10  of additional service credit in 6-month increments for service
11  in a law enforcement capacity under Articles 3, 7, 8, 9, 10,
12  13, 14, and 15 and Division 1 of Article 22, as a law
13  enforcement officer with the Chicago Housing Authority, or as
14  a law enforcement officer with any agency of the United States
15  government, provided that: (1) service credit is not available
16  for that employment under any other provision of this Article;
17  (2) any service credit for that employment received under any
18  other provision of this Code or under the retirement plan of
19  the Chicago Housing Authority or Federal Employee Retirement
20  System has been terminated; and (3) the policeman applies for
21  this credit in writing within one year after the effective
22  date of this Section and pays to the Fund within 5 years after
23  the date of application an amount to be determined by the Fund

1  in accordance with this Section.
2  An active policeman who becomes a member of this Fund
3  after the effective date of this Section may establish up to 10
4  years of additional service credit in 6-month increments for
5  service in a law enforcement capacity under Articles 3, 7, 8,
6  9, 10, 13, 14, and 15 and Division 1 of Article 22, as a law
7  enforcement officer with the Chicago Housing Authority, or as
8  a law enforcement officer with any agency of the United States
9  government, provided that: (1) service credit is not available
10  for that employment under any other provision of this Article;
11  (2) any service credit for that employment received under any
12  other provision of this Code or under the retirement plan of
13  the Chicago Housing Authority or Federal Employee Retirement
14  System has been terminated; and (3) the policeman applies for
15  this credit in writing within 2 years after he or she begins
16  employment under this Article and pays to the Fund within 5
17  years after the date of application an amount to be determined
18  by the Fund in accordance with this Section; except that the
19  2-year requirement to file an application does not apply to an
20  active policeman who becomes a member of this Fund on or after
21  December 1, 2019, makes an application for this credit in
22  writing prior to December 31, 2023, and pays to the Fund,
23  within 5 years after the date of application, an amount to be
24  determined by the Fund in accordance with this Section.
25  The Fund must determine the policeman's payment required
26  to establish creditable service under this Section by taking

1  into account the appropriate actuarial assumptions, including
2  without limitation the police officer's service, age, and
3  salary history; the level of funding of the Fund; and any other
4  factors that the Fund determines to be relevant. For this
5  purpose, the policeman's required payment should result in no
6  significant increase to the Fund's unfunded actuarial accrued
7  liability determined as of the most recent actuarial
8  valuation, based on the same assumptions and methods used to
9  develop and report the Fund's actuarial accrued liability and
10  actuarial value of assets under Statement No. 25 of
11  Governmental Accounting Standards Board or any subsequent
12  applicable Statement.

14  Section 90. The State Mandates Act is amended by adding
15  Section 8.47 as follows:

17  Sec. 8.47. Exempt mandate. Notwithstanding Sections 6 and
18  8 of this Act, no reimbursement by the State is required for
19  the implementation of any mandate created by this amendatory
20  Act of the 103rd General Assembly.
21  Section 99. Effective date. This Act takes effect upon
22  becoming law.
