14	14	1 AN ACT concerning public employee benefits.
15	15	2 Be it enacted by the People of the State of Illinois,
16	16	3 represented in the General Assembly:
17	17	4 Section 5. The Illinois Pension Code is amended by
18	18	5 changing Section 5-214.2 as follows:
19	19	6 (40 ILCS 5/5-214.2)
20	20	7 Sec. 5-214.2. Credit for certain law enforcement service.
21	21	8 An active policeman who is a member of this Fund on or before
22	22	9 the effective date of this Section may establish up to 10 years
23	23	10 of additional service credit in 6-month increments for service
24	24	11 in a law enforcement capacity under Articles 3, 7, 8, 9, 10,
25	25	12 13, 14, and 15 and Division 1 of Article 22, as a law
26	26	13 enforcement officer with the Chicago Housing Authority, or as
27	27	14 a law enforcement officer with any agency of the United States
28	28	15 government, provided that: (1) service credit is not available
29	29	16 for that employment under any other provision of this Article;
30	30	17 (2) any service credit for that employment received under any
31	31	18 other provision of this Code or under the retirement plan of
32	32	19 the Chicago Housing Authority or Federal Employee Retirement
33	33	20 System has been terminated; and (3) the policeman applies for
34	34	21 this credit in writing within one year after the effective
35	35	22 date of this Section and pays to the Fund within 5 years after
36	36	23 the date of application an amount to be determined by the Fund

80	80	2 An active policeman who becomes a member of this Fund
81	81	3 after the effective date of this Section may establish up to 10

92	92	14 System has been terminated; and (3) the policeman applies for
93	93	15 this credit in writing within 2 years after he or she begins
94	94	16 employment under this Article and pays to the Fund within 5
95	95	17 years after the date of application an amount to be determined
96	96	18 by the Fund in accordance with this Section; except that the
97	97	19 2-year requirement to file an application does not apply to an
98	98	20 active policeman who becomes a member of this Fund on or after
99	99	21 December 1, 2019, makes an application for this credit in
100	100	22 writing prior to December 31, 2023, and pays to the Fund,
101	101	23 within 5 years after the date of application, an amount to be
102	102	24 determined by the Fund in accordance with this Section.
103	103	25 The Fund must determine the policeman's payment required
104	104	26 to establish creditable service under this Section by taking

115	115	1 into account the appropriate actuarial assumptions, including
116	116	2 without limitation the police officer's service, age, and
117	117	3 salary history; the level of funding of the Fund; and any other
118	118	4 factors that the Fund determines to be relevant. For this
119	119	5 purpose, the policeman's required payment should result in no
120	120	6 significant increase to the Fund's unfunded actuarial accrued
121	121	7 liability determined as of the most recent actuarial
122	122	8 valuation, based on the same assumptions and methods used to
123	123	9 develop and report the Fund's actuarial accrued liability and
124	124	10 actuarial value of assets under Statement No. 25 of
125	125	11 Governmental Accounting Standards Board or any subsequent
126	126	12 applicable Statement.

128	128	14 Section 90. The State Mandates Act is amended by adding
129	129	15 Section 8.47 as follows:

131	131	17 Sec. 8.47. Exempt mandate. Notwithstanding Sections 6 and
132	132	18 8 of this Act, no reimbursement by the State is required for
133	133	19 the implementation of any mandate created by this amendatory
134	134	20 Act of the 103rd General Assembly.
135	135	21 Section 99. Effective date. This Act takes effect upon
136	136	22 becoming law.
