1414 1 AN ACT concerning public employee benefits.
1515 2 Be it enacted by the People of the State of Illinois,
1616 3 represented in the General Assembly:
1717 4 Section 5. The Illinois Pension Code is amended by
1818 5 changing Section 5-214.2 as follows:

2020 7 Sec. 5-214.2. Credit for certain law enforcement service.
2121 8 An active policeman who is a member of this Fund on or before
2222 9 the effective date of this Section may establish up to 10 years
2323 10 of additional service credit in 6-month increments for service
2424 11 in a law enforcement capacity under Articles 3, 7, 8, 9, 10,
2525 12 13, 14, and 15 and Division 1 of Article 22, as a law
2626 13 enforcement officer with the Chicago Housing Authority, or as
2727 14 a law enforcement officer with any agency of the United States
2828 15 government, provided that: (1) service credit is not available
2929 16 for that employment under any other provision of this Article;
3030 17 (2) any service credit for that employment received under any
3131 18 other provision of this Code or under the retirement plan of
3232 19 the Chicago Housing Authority or Federal Employee Retirement
3333 20 System has been terminated; and (3) the policeman applies for
3434 21 this credit in writing within one year after the effective
3535 22 date of this Section and pays to the Fund within 5 years after
3636 23 the date of application an amount to be determined by the Fund

8080 2 An active policeman who becomes a member of this Fund
8181 3 after the effective date of this Section may establish up to 10

9292 14 System has been terminated; and (3) the policeman applies for
9393 15 this credit in writing within 2 years after he or she begins
9494 16 employment under this Article and pays to the Fund within 5
9595 17 years after the date of application an amount to be determined
9696 18 by the Fund in accordance with this Section; except that the
9797 19 2-year requirement to file an application does not apply to an
9898 20 active policeman who becomes a member of this Fund on or after
9999 21 December 1, 2019, makes an application for this credit in
100100 22 writing prior to December 31, 2023, and pays to the Fund,
101101 23 within 5 years after the date of application, an amount to be
102102 24 determined by the Fund in accordance with this Section.
103103 25 The Fund must determine the policeman's payment required
104104 26 to establish creditable service under this Section by taking

115115 1 into account the appropriate actuarial assumptions, including
116116 2 without limitation the police officer's service, age, and
117117 3 salary history; the level of funding of the Fund; and any other
118118 4 factors that the Fund determines to be relevant. For this
119119 5 purpose, the policeman's required payment should result in no
120120 6 significant increase to the Fund's unfunded actuarial accrued
121121 7 liability determined as of the most recent actuarial
122122 8 valuation, based on the same assumptions and methods used to
123123 9 develop and report the Fund's actuarial accrued liability and
124124 10 actuarial value of assets under Statement No. 25 of
125125 11 Governmental Accounting Standards Board or any subsequent
126126 12 applicable Statement.

128128 14 Section 90. The State Mandates Act is amended by adding

131131 17 Sec. 8.47. Exempt mandate. Notwithstanding Sections 6 and
132132 18 8 of this Act, no reimbursement by the State is required for
133133 19 the implementation of any mandate created by this amendatory
134134 20 Act of the 103rd General Assembly.
135135 21 Section 99. Effective date. This Act takes effect upon
136136 22 becoming law.
