311 1 AN ACT concerning finance.
412 2 Be it enacted by the People of the State of Illinois,
513 3 represented in the General Assembly:
614 4 Section 5. The Commission on Equity and Inclusion Act is
715 5 amended by changing Section 40-10 as follows:
816 6 (30 ILCS 574/40-10)
917 7 Sec. 40-10. Powers and duties. In addition to the other
1018 8 powers and duties which may be prescribed in this Act or
1119 9 elsewhere, the Commission shall have the following powers and
1220 10 duties:
1321 11 (1) The Commission shall have a role in all State and
1422 12 university procurement by facilitating and streamlining
1523 13 communications between the Business Enterprise Council for
1624 14 Minorities, Women, and Persons with Disabilities, the
1725 15 purchasing entities, the Chief Procurement Officers, and
1826 16 others.
1927 17 (2) The Commission may create a scoring evaluation for
2028 18 State agency directors, public university presidents and
2129 19 chancellors, and public community college presidents. The
2230 20 scoring shall be based on the following 3 principles: (i)
2331 21 increasing capacity; (ii) growing revenue; and (iii)
2432 22 enhancing credentials. These principles should be the
2533 23 foundation of the agency compliance plan required under

3468 1 Section 6 of the Business Enterprise for Minorities,
3569 2 Women, and Persons with Disabilities Act.
3670 3 (3) The Commission shall exercise the authority and
3771 4 duties provided to it under Section 5-7 of the Illinois
3872 5 Procurement Code.
3973 6 (4) The Commission, working with State agencies, shall
4074 7 provide support for diversity in State hiring.
4175 8 (5) The Commission shall oversee the implementation of
4276 9 diversity training of the State workforce.
4377 10 (6) Each January, and as otherwise frequently as may
4478 11 be deemed necessary and appropriate by the Commission, the
4579 12 Commission shall propose and submit to the Governor and
4680 13 the General Assembly legislative changes to increase
4781 14 inclusion and diversity in State government.
4882 15 (7) The Commission shall have oversight over the
4983 16 following entities:
5084 17 (A) the Illinois African-American Family
5185 18 Commission;
5286 19 (B) the Illinois Latino Family Commission;
5387 20 (C) the Asian American Family Commission;
5488 21 (D) the Illinois Muslim American Advisory Council;
5589 22 (E) the Illinois African-American Fair Contracting
5690 23 Commission created under Executive Order 2018-07; and
5791 24 (F) the Business Enterprise Council for
5892 25 Minorities, Women, and Persons with Disabilities.
5993 26 (7.5) The Commission shall collect and publish on its

82116 13 Facilities Planning Act;
83117 14 (C) Section 8f of the Business Enterprise for
84118 15 Minorities, Women and Persons with Disabilities Act;
85119 16 (D) Section 5-57 of the Economic Development
86120 17 for a Growing Economy Tax Credit Act;
87121 18 (E) Section 5-117 of the Public Utilities Act;
88122 19 (F) Section 12.2 of the Illinois Horse Racing
89123 20 Act of 1975; and
90124 21 (G) Section 10 of the Railroad Supplier
91125 22 Diversity Act.
92126 23 (7.6) The Commission may hold public workshops focused
93127 24 on specific industries and reports to collaboratively
94128 25 connect diverse enterprises with entities that manage

116150 11 (8) The Commission shall adopt any rules necessary for
117151 12 the implementation and administration of the requirements
118152 13 of this Act.
119153 14 (9) The Commission shall exercise the authority and
120154 15 duties provided to it under Section 45-57 of the Illinois
121155 16 Procurement Code.
