11 103RD GENERAL ASSEMBLY State of Illinois 2023 and 2024 HB3437 Introduced , by Rep. William E Hauter SYNOPSIS AS INTRODUCED: New Act Creates the Task Force on Prescribing Psychologist Licensing and Oversight Act. Provides that the Task Force is created within the Department of Financial and Professional Regulation. Provides for membership, appointment, vacancy, and meeting support of the Task Force. Provides that the subject matter of the Task Force shall include, but not be limited to, the following inquiries: (1) will allowing prescribing psychologists to expand the prescribing psychologists' scope to include children and seniors help increase access to treatment for underserved areas and populations, including rural patients and patients on Medicaid; and (2) do prescribing psychologists receive sufficient regulatory oversight, medical supervision, and disciplinary enforcement to fully protect patient safety. Provides that the Task Force shall prepare an annual report that summarizes its work and makes recommendations resulting from its deliberations. Provides that the Task Force shall submit the report of its findings and recommendations to the Governor and the General Assembly. 1111 1 AN ACT concerning regulation.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 1. Short title. This Act may be cited as the Task
1515 5 Force on Prescribing Psychologist Licensing and Oversight Act.
1616 6 Section 5. Purpose. The Task Force on Prescribing
1717 7 Psychologist Licensing and Oversight is created within the
1818 8 Department of Financial and Professional Regulation. The Task
1919 9 Force shall aim to answer the following questions:
2020 10 (1) How much can prescribing psychologists increase
2121 11 overall access to care in this State?
2222 12 (2) Do prescribing psychologists receive the
2323 13 appropriate training and oversight to protect patient
2424 14 safety?
2525 15 Section 10. Membership; appointment; vacancy; meeting
2626 16 support.
2727 17 (a) The Task Force shall have the following members:
2828 18 (1) the Secretary of Financial and Professional
2929 19 Regulation, or the Secretary's designee;
3030 20 (2) the Director of the Division of Professional

7474 8 (7) the Minority Leader of the Senate, or the Leader's

7676 10 (8) a representative of a statewide membership
7777 11 organization for psychiatrists in this State that serves
7878 12 to provide education, professional collaboration, and
7979 13 advocacy for its members, appointed by the Secretary;
8080 14 (9) a psychiatrist licensed and practicing in this
8181 15 State who has received specific training to specialize in
8282 16 treating child and adolescents patients, appointed by the
8383 17 Secretary of Financial and Professional Regulation;
8484 18 (10) a psychiatrist licensed and practicing in this
8585 19 State who has received specific training to specialize in
8686 20 treating geriatric patients, appointed by the Secretary of
8787 21 Financial and Professional Regulation;
8888 22 (11) a representative of a statewide membership
8989 23 organization for this State prescribing psychologists that
9090 24 serves to provide education, professional collaboration,
9191 25 and advocacy for its members, appointed by the Secretary
9292 26 of Financial and Professional Regulation;

103103 1 (12) a psychologist licensed and practicing in this
104104 2 State who has received specific training to specialize in
105105 3 treating child and adolescents patients, appointed by the
106106 4 Secretary of Financial and Professional Regulation; and
107107 5 (13) a psychologist licensed and practicing in this
108108 6 State who has received specific training to specialize in
109109 7 treating geriatric patients, appointed by the Secretary of
110110 8 Financial and Professional Regulation.
111111 9 (b) If a vacancy occurs in the Task Force, the vacancy
112112 10 shall be filled in the same manner as the original appointment
113113 11 for the remainder of the unexpired term.
114114 12 (c) The Task Force shall meet once every 2 months,
115115 13 indefinitely, until the Task Force votes to dissolve itself.
116116 14 Nothing in this Section prohibits the Task Force from meeting
117117 15 more often if it deems it necessary to do so.
118118 16 (d) The Department shall provide administrative support to
119119 17 the Task Force.
120120 18 (e) The Task Force shall only meet once a majority of
121121 19 members are appointed.
122122 20 (f) The Secretary of Financial and Professional
123123 21 Regulation, or the Secretary's designee, shall be the chair of
124124 22 the Task Force.
125125 23 Section 15. Subject matter of the Task Force. The subject
126126 24 matter of the Task Force shall include, but not be limited to,

152152 15 (c) The Task Force shall submit the first report no later
