1313 1 AN ACT concerning transportation.
1414 2 Be it enacted by the People of the State of Illinois,
1515 3 represented in the General Assembly:
1616 4 Section 5. The Illinois Vehicle Code is amended by
1717 5 changing Sections 3-412 and 11-1426.1 and by adding Section
1818 6 3-806.11 as follows:

2323 11 (a) The Secretary of State upon registering a vehicle
2424 12 subject to annual registration for the first time shall issue
2525 13 or shall cause to be issued to the owner one registration plate
2626 14 or digital registration plate for a motorcycle, trailer,
2727 15 semitrailer, moped, autocycle, or truck-tractor, 2
2828 16 registration plates, or a digital registration plate and metal
2929 17 plate as set forth in Section 3-401.5, for other motor
3030 18 vehicles and, where applicable, current registration stickers
3131 19 or digital registration stickers for motor vehicles of the
3232 20 first division. The provisions of this Section may be made
3333 21 applicable to such vehicles of the second division, as the
3434 22 Secretary of State may, from time to time, in his discretion

8383 10 (b) Every registration plate or digital registration plate
8484 11 shall have displayed upon it the registration number assigned
8585 12 to the vehicle for which it is issued, the name of this State,
8686 13 which may be abbreviated, the year number for which it was
8787 14 issued, which may be abbreviated, the phrase "Land of Lincoln"
8888 15 (except as otherwise provided in this Code), and such other
8989 16 letters or numbers as the Secretary may prescribe. However,
9090 17 for apportionment plates issued to vehicles registered under
9191 18 Section 3-402.1 and fleet plates issued to vehicles registered
9292 19 under Section 3-405.3, the phrase "Land of Lincoln" may be
9393 20 omitted to allow for the word "apportioned", the word "fleet",
9494 21 or other similar language to be displayed. Registration plates
9595 22 or digital registration plates issued to a vehicle registered
9696 23 as a fleet vehicle may display a designation determined by the
9797 24 Secretary.
9898 25 The Secretary may in his discretion prescribe that letters
9999 26 be used as prefixes only on registration plates or digital

110110 1 registration plates issued to vehicles of the first division
111111 2 which are registered under this Code and only as suffixes on
112112 3 registration plates or digital registration plates issued to
113113 4 other vehicles. Every registration sticker or digital
114114 5 registration sticker issued as evidence of current
115115 6 registration shall designate the year number for which it is
116116 7 issued and such other letters or numbers as the Secretary may
117117 8 prescribe and shall be of a contrasting color with the
118118 9 registration plates or digital registration plates and
119119 10 registration stickers or digital registration stickers of the
120120 11 previous year.
121121 12 (c) Each registration plate or digital registration plate
122122 13 and the required letters and numerals thereon, except the year
123123 14 number for which issued, shall be of sufficient size to be
124124 15 plainly readable from a distance of 100 feet during daylight,
125125 16 and shall be coated with reflectorizing material. The
126126 17 dimensions of the plate issued to vehicles of the first
127127 18 division shall be 6 by 12 inches.
128128 19 (d) The Secretary of State shall issue for every passenger
129129 20 motor vehicle rented without a driver the same type of
130130 21 registration plates or digital registration plates as the type
131131 22 of plates issued for a private passenger vehicle.
132132 23 (e) The Secretary of State shall issue for every passenger
133133 24 car used as a taxicab or livery, distinctive registration
134134 25 plates or digital registration plates.

154154 9 (i) The Secretary of State shall issue for every public

156156 11 registration plates identifying the vehicle as an ambulance.
157157 12 The Secretary shall forward to the Department of Healthcare
158158 13 and Family Services registration information for the purpose
159159 14 of verification of claims filed with the Department by
160160 15 ambulance owners for payment for services to public assistance
161161 16 recipients.
162162 17 (j) The Secretary of State shall issue for every public
163163 18 and private medical carrier or rescue vehicle livery
164164 19 registration plates or digital registration plates displaying
165165 20 numbers within ranges of numbers reserved respectively for
166166 21 medical carriers and rescue vehicles. The Secretary shall
167167 22 forward to the Department of Healthcare and Family Services
168168 23 registration information for the purpose of verification of
169169 24 claims filed with the Department by owners of medical carriers
170170 25 or rescue vehicles for payment for services to public
171171 26 assistance recipients.

182182 1 (k) The Secretary of State shall issue distinctive license
183183 2 plates or digital registration plates or distinctive license
184184 3 plate stickers or digital registration stickers for every
185185 4 vehicle exempted from subsections (a) and (a-5) of Section
186186 5 12-503 by subsection (g) of that Section, and by subsection
187187 6 (g-5) of that Section before its deletion by this amendatory
188188 7 Act of the 95th General Assembly. The Secretary shall issue
189189 8 these plates or stickers immediately upon receiving the
190190 9 physician's certification required under subsection (g) of
191191 10 Section 12-503. New plates or stickers shall also be issued
192192 11 when the certification is renewed as provided in that
193193 12 subsection.
194194 13 (l) The Secretary of State shall issue distinctive
195195 14 registration plates or digital registration plates for
196196 15 low-speed vehicles.
197197 16 (m) The Secretary of State shall issue distinctive
198198 17 registration plates or digital registration plates for
199199 18 autocycles. The dimensions of the plate issued to autocycles
200200 19 shall be 4 by 7 inches.
201201 20 (n) The Secretary of State shall issue distinctive
202202 21 registration plates or digital registration plates for
203203 22 non-highway vehicles. The Secretary shall issue these plates
204204 23 only to non-highway vehicles that meet the requirements set
205205 24 forth in subsections (e) and (g) of Section 11-1426.1. The
206206 25 Secretary shall collect and deposit the registration fee as
207207 26 required under Section 3-806.10

233233 16 Sec. 11-1426.1. Operation of non-highway vehicles on
234234 17 streets, roads, and highways.
235235 18 (a) As used in this Section, "non-highway vehicle" means a
236236 19 motor vehicle not specifically designed to be used on a public
237237 20 highway, including:
238238 21 (1) an all-terrain vehicle, as defined by Section
239239 22 1-101.8 of this Code;
240240 23 (2) a golf cart, as defined by Section 1-123.9;
241241 24 (3) an off-highway motorcycle, as defined by Section

253253 2 (4) a recreational off-highway vehicle, as defined by
254254 3 Section 1-168.8.
255255 4 (b) Except as otherwise provided in this Section, it is
256256 5 unlawful for any person to drive or operate a non-highway
257257 6 vehicle upon any street, highway, or roadway in this State. If
258258 7 the operation of a non-highway vehicle is authorized under
259259 8 subsection (d), the non-highway vehicle may be operated only
260260 9 on streets where the posted speed limit is 35 miles per hour or
261261 10 less. This subsection (b) does not prohibit a non-highway
262262 11 vehicle from crossing a road or street at an intersection
263263 12 where the road or street has a posted speed limit of more than
264264 13 35 miles per hour.
265265 14 (b-5) A person may not operate a non-highway vehicle upon
266266 15 any street, highway, or roadway in this State unless he or she
267267 16 has a valid driver's license issued in his or her name by the
268268 17 Secretary of State or by a foreign jurisdiction.
269269 18 (c) No person operating a non-highway vehicle shall make a
270270 19 direct crossing upon or across any tollroad, interstate
271271 20 highway, or controlled access highway in this State. No person
272272 21 operating a non-highway vehicle shall make a direct crossing
273273 22 upon or across any other highway under the jurisdiction of the
274274 23 State except at an intersection of the highway with another
275275 24 public street, road, or highway.

288288 1 local government may authorize, by ordinance or resolution,
289289 2 the operation of non-highway vehicles on roadways under its
290290 3 jurisdiction if the unit of local government determines that
291291 4 the public safety will not be jeopardized. The Department may
292292 5 authorize the operation of non-highway vehicles on the
293293 6 roadways under its jurisdiction if the Department determines
294294 7 that the public safety will not be jeopardized. The unit of
295295 8 local government or the Department may restrict the types of
296296 9 non-highway vehicles that are authorized to be used on its
297297 10 streets.
298298 11 Before permitting the operation of non-highway vehicles on
299299 12 its roadways, a municipality, township, county, other unit of
300300 13 local government, or the Department must consider the volume,
301301 14 speed, and character of traffic on the roadway and determine
302302 15 whether non-highway vehicles may safely travel on or cross the
303303 16 roadway. Upon determining that non-highway vehicles may safely
304304 17 operate on a roadway and the adoption of an ordinance or
305305 18 resolution by a municipality, township, county, or other unit
306306 19 of local government, or authorization by the Department,
307307 20 appropriate signs shall be posted.
308308 21 If a roadway is under the jurisdiction of more than one
309309 22 unit of government, non-highway vehicles may not be operated
310310 23 on the roadway unless each unit of government agrees and takes
311311 24 action as provided in this subsection.
312312 25 (e) No non-highway vehicle may be operated on a roadway

324324 1 apparatus, tires, a rearview mirror, red reflectorized warning
325325 2 devices in the front and rear, a slow moving emblem (as
326326 3 required of other vehicles in Section 12-709 of this Code) on
327327 4 the rear of the non-highway vehicle, a headlight that emits a
328328 5 white light visible from a distance of 500 feet to the front, a
329329 6 tail lamp that emits a red light visible from at least 100 feet
330330 7 from the rear, brake lights, and turn signals. When operated
331331 8 on a roadway, a non-highway vehicle shall have its headlight
332332 9 and tail lamps lighted as required by Section 12-201 of this
333333 10 Code.
334334 11 (f) A person who drives or is in actual physical control of
335335 12 a non-highway vehicle on a roadway while under the influence
336336 13 is subject to Sections 11-500 through 11-502 of this Code.
337337 14 (g) Any person who operates a non-highway vehicle on a
338338 15 street, highway, or roadway shall be subject to the mandatory
339339 16 insurance requirements under Article VI of Chapter 7 of this
340340 17 Code.
341341 18 (h) It shall not be unlawful for any person to drive or
342342 19 operate a non-highway vehicle, as defined in paragraphs (1)
343343 20 and (4) of subsection (a) of this Section, on a county roadway
344344 21 or township roadway for the purpose of conducting farming
345345 22 operations to and from the home, farm, farm buildings, and any
346346 23 adjacent or nearby farm land.
347347 24 Non-highway vehicles, as used in this subsection (h),
348348 25 shall not be subject to subsections (e) and (g) of this

360360 1 Section, is not covered under a motor vehicle insurance policy
361361 2 pursuant to subsection (g) of this Section, the vehicle must
362362 3 be covered under a farm, home, or non-highway vehicle
363363 4 insurance policy issued with coverage amounts no less than the
364364 5 minimum amounts set for bodily injury or death and for
365365 6 destruction of property under Section 7-203 of this Code.
366366 7 Non-highway vehicles operated on a county or township roadway
367367 8 at any time between one-half hour before sunset and one-half
368368 9 hour after sunrise must be equipped with head lamps and tail
369369 10 lamps, and the head lamps and tail lamps must be lighted.
370370 11 Non-highway vehicles, as used in this subsection (h),
371371 12 shall not make a direct crossing upon or across any tollroad,
372372 13 interstate highway, or controlled access highway in this
373373 14 State.
374374 15 Non-highway vehicles, as used in this subsection (h),
375375 16 shall be allowed to cross a State highway, municipal street,
376376 17 county highway, or road district highway if the operator of
377377 18 the non-highway vehicle makes a direct crossing provided:
378378 19 (1) the crossing is made at an angle of approximately
379379 20 90 degrees to the direction of the street, road or highway
380380 21 and at a place where no obstruction prevents a quick and
381381 22 safe crossing;
382382 23 (2) the non-highway vehicle is brought to a complete
383383 24 stop before attempting a crossing;
384384 25 (3) the operator of the non-highway vehicle yields the
385385 26 right of way to all pedestrian and vehicular traffic which

397397 2 (4) that when crossing a divided highway, the crossing
398398 3 is made only at an intersection of the highway with
399399 4 another public street, road, or highway.
400400 5 (i) No action taken by a unit of local government under
401401 6 this Section designates the operation of a non-highway vehicle
402402 7 as an intended or permitted use of property with respect to
403403 8 Section 3-102 of the Local Governmental and Governmental
404404 9 Employees Tort Immunity Act.
405405 10 (j) Notwithstanding any other provision of this Section, a
406406 11 non-highway vehicle with a registration plate issued under
407407 12 subsection (n) of Section 3-412 may be operated on any street,
408408 13 highway, or roadway where the posted speed limit is 35 miles
409409 14 per hour or less or any county highway where the posted speed
410410 15 limit is 55 miles per hour or less.
411411 16 Non-highway vehicles, as used in this subsection (j),
412412 17 shall not make a direct crossing upon or across any tollroad,
413413 18 interstate highway, or controlled access highway in this
414414 19 State.
415415 20 Non-highway vehicles, as used in this subsection (j), may
416416 21 cross a State highway, municipal street, county highway, or
417417 22 road district highway if:
418418 23 (1) the crossing is made at an angle of approximately
419419 24 90 degrees to the direction of the street, road, or
420420 25 highway and at a place where no obstruction prevents a
421421 26 quick and safe crossing;

432432 1 (2) the non-highway vehicle is brought to a complete

434434 3 (3) the operator of the non-highway vehicle yields the
435435 4 right of way to all pedestrian and vehicular traffic which
436436 5 constitutes a hazard; and
437437 6 (4) when crossing a divided highway, the crossing is
438438 7 made only at an intersection of the highway with another
439439 8 public street, road, or highway.
