4-AN ACT concerning safety.
5-Be it enacted by the People of the State of Illinois,
6-represented in the General Assembly:
7-Section 5. The PFAS Reduction Act is amended by adding
8-Section 40 as follows:
9-(415 ILCS 170/40 new)
10-Sec. 40. PFAS disposal program. The Agency shall establish
11-a take-back program for fire departments that use and store
12-firefighting foam containing PFAS. Fire departments that
13-participated in the most recent survey described in Section 25
14-shall be eligible to participate in the program, but
15-participation in the program shall not be required. The
16-program shall provide funding and resources to ensure the
17-proper disposal or destruction of firefighting foam containing
18-PFAS. The program shall continue for a period of 5 years or
19-until the Office of the State Fire Marshal finds that no
20-firefighting foam containing PFAS is reported in the survey
21-described in Section 25. This program is subject to
22-appropriation.
23-Section 99. Effective date. This Act takes effect upon
24-becoming law.
