1111 1 AN ACT concerning transportation.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Illinois Vehicle Code is amended by
1515 5 changing Section 11-601 as follows:
1616 6 (625 ILCS 5/11-601) (from Ch. 95 1/2, par. 11-601)
1717 7 Sec. 11-601. General speed restrictions.
1818 8 (a) No vehicle may be driven upon any highway of this State
1919 9 at a speed which is greater than is reasonable and proper with
2020 10 regard to traffic conditions and the use of the highway, or
2121 11 endangers the safety of any person or property. The fact that
2222 12 the speed of a vehicle does not exceed the applicable maximum
2323 13 speed limit does not relieve the driver from the duty to
2424 14 decrease speed when approaching and crossing an intersection,
2525 15 approaching and going around a curve, when approaching a hill
2626 16 crest, when traveling upon any narrow or winding roadway, or
2727 17 when special hazard exists with respect to pedestrians or
2828 18 other traffic or by reason of weather or highway conditions.
2929 19 Speed must be decreased as may be necessary to avoid colliding
3030 20 with any person or vehicle on or entering the highway in
3131 21 compliance with legal requirements and the duty of all persons
3232 22 to use due care.
3333 23 (a-5) For purposes of this Section, "urban district" does

7171 4 (b) No person may drive a vehicle upon any highway of this
7272 5 State at a speed which is greater than the applicable
7373 6 statutory maximum speed limit established by paragraphs (c),
7474 7 (d), (e), (f) or (g) of this Section, by Section 11-605 or by a
7575 8 regulation or ordinance made under this Chapter.
7676 9 (c) Unless some other speed restriction is established
7777 10 under this Chapter, until October 1, 2023, the maximum speed
7878 11 limit in an urban district for all vehicles is:
7979 12 1. 30 miles per hour; and
8080 13 2. 15 miles per hour in an alley.
8181 14 (c-5) Unless some other speed restriction is established
8282 15 under this Chapter, on and after October 1, 2023, the maximum
8383 16 speed limit in an urban district for all vehicles is:
8484 17 1. 20 miles per hour; and
8585 18 2. 10 miles per hour in an alley.
8686 19 By September 1, 2023, the Secretary of State must
8787 20 communicate this change to every licensed driver in the State
8888 21 via direct postal mail and a broad statewide communications
8989 22 campaign.
9090 23 A county, municipality, or township with speed enforcement
9191 24 authority may issue only warnings for violations during the
9292 25 first 60 days after the enactment of this amendatory Act of the
9393 26 103rd General Assembly.

104104 1 (d) Unless some other speed restriction is established
105105 2 under this Chapter, the maximum speed limit outside an urban
106106 3 district for any vehicle is (1) 65 miles per hour for all or
107107 4 part of highways that are designated by the Department, have
108108 5 at least 4 lanes of traffic, and have a separation between the
109109 6 roadways moving in opposite directions and (2) 55 miles per
110110 7 hour for all other highways, roads, and streets.
111111 8 (d-1) Unless some other speed restriction is established
112112 9 under this Chapter, the maximum speed limit outside an urban
113113 10 district for any vehicle is (1) 70 miles per hour on any
114114 11 interstate highway as defined by Section 1-133.1 of this Code
115115 12 which includes all highways under the jurisdiction of the
116116 13 Illinois State Toll Highway Authority; (2) 65 miles per hour
117117 14 for all or part of highways that are designated by the
118118 15 Department, have at least 4 lanes of traffic, and have a
119119 16 separation between the roadways moving in opposite directions;
120120 17 and (3) 55 miles per hour for all other highways, roads, and
121121 18 streets. The counties of Cook, DuPage, Kane, Lake, Madison,
122122 19 McHenry, St. Clair, and Will may adopt ordinances setting a
123123 20 maximum speed limit on highways, roads, and streets that is
124124 21 lower than the limits established by this Section.
125125 22 (e) In the counties of Cook, DuPage, Kane, Lake, McHenry,
126126 23 and Will, unless some lesser speed restriction is established
127127 24 under this Chapter, the maximum speed limit outside an urban
128128 25 district for a second division vehicle designed or used for
129129 26 the carrying of a gross weight of 8,001 pounds or more

140140 1 (including the weight of the vehicle and maximum load) is 60
141141 2 miles per hour on any interstate highway as defined by Section
142142 3 1-133.1 of this Code and 55 miles per hour on all other

145145 6 (f) Unless some other speed restriction is established
146146 7 under this Chapter, the maximum speed limit outside an urban
147147 8 district for a bus is:
148148 9 1. 65 miles per hour upon any highway which has at
149149 10 least 4 lanes of traffic and of which the roadways for
150150 11 traffic moving in opposite directions are separated by a
151151 12 strip of ground which is not surfaced or suitable for
152152 13 vehicular traffic, except that the maximum speed limit for
153153 14 a bus on all highways, roads, or streets not under the
154154 15 jurisdiction of the Department or the Illinois State Toll
155155 16 Highway Authority is 55 miles per hour;
156156 17 1.5. 70 miles per hour upon any interstate highway as
157157 18 defined by Section 1-133.1 of this Code outside the
158158 19 counties of Cook, DuPage, Kane, Lake, McHenry, and Will;
159159 20 and
160160 21 2. 55 miles per hour on any other highway.
