1111 1 AN ACT concerning finance.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Department of Agriculture Law of the Civil
1515 5 Administrative Code of Illinois is amended by adding Section
1616 6 205-455 as follows:
1717 7 (20 ILCS 205/205-455 new)
1818 8 Sec. 205-455. Grants to special access food providers.
1919 9 (a) Beginning on July 1, 2023, subject to appropriation,
2020 10 the Department shall award grants to special access food
2121 11 providers in the State. The amount of the grant may not exceed
2222 12 the sum or 15% of the special access food provider's basis in
2323 13 the grocery store, plus 10% of the renovation expenditures
2424 14 incurred by the special access food provider.
2525 15 (b) As used in this Section:
2626 16 "Food desert" means any census tract that meets the
2727 17 following criteria:
2828 18 (1) if the census tract is located in a metropolitan
2929 19 area, then not less than 500 people or 33% of the
3030 20 population of the census tract, whichever is less, reside
3131 21 more than one mile from a grocery store; or
3232 22 (2) if the census tract is located in a
3333 23 nonmetropolitan area, then not less than 500 people or 33%

6868 1 of the population of the census tract, whichever is less,
6969 2 reside more than 10 miles from a grocery store.
7070 3 "Grocery store" means a retail store for which forecasted
7171 4 sales of groceries account for not less than 35% of its total
7272 5 annual sales.
7373 6 "Person" means any individual, partnership, corporation,
7474 7 association, or other organization.
7575 8 "Special access food provider" means a person that is
7676 9 seeking to construct, renovate, or rehabilitate a property
7777 10 that (i) will be used as a grocery store upon completion of the
7878 11 construction, renovation, or rehabilitation and (ii) is
7979 12 located in a food desert in the State on the date on which
8080 13 construction, renovation, or rehabilitation begins.
