19 | 19 | | 9 (a) Beginning on July 1, 2023, subject to appropriation, |

20 | 20 | | 10 the Department shall award grants to special access food |
---|
21 | 21 | | 11 providers in the State. The amount of the grant may not exceed |
---|
22 | 22 | | 12 the sum or 15% of the special access food provider's basis in |
---|
23 | 23 | | 13 the grocery store, plus 10% of the renovation expenditures |
---|
24 | 24 | | 14 incurred by the special access food provider. |
---|
25 | 25 | | 15 (b) As used in this Section: |
---|
26 | 26 | | 16 "Food desert" means any census tract that meets the |
---|
27 | 27 | | 17 following criteria: |
---|
28 | 28 | | 18 (1) if the census tract is located in a metropolitan |
---|
29 | 29 | | 19 area, then not less than 500 people or 33% of the |
---|
30 | 30 | | 20 population of the census tract, whichever is less, reside |
---|
31 | 31 | | 21 more than one mile from a grocery store; or |
---|
32 | 32 | | 22 (2) if the census tract is located in a |
---|
33 | 33 | | 23 nonmetropolitan area, then not less than 500 people or 33% |

79 | 79 | | 12 located in a food desert in the State on the date on which |
---|
80 | 80 | | 13 construction, renovation, or rehabilitation begins. |
