3	13		1 AN ACT concerning finance.
4	14		2 Be it enacted by the People of the State of Illinois,
5	15		3 represented in the General Assembly:
6	16		4 Section 5. The Local Food, Farms, and Jobs Act is amended
7		-	5 by changing Sections 5 and 10 and by adding ~~Section 13 as~~
8		-	6 follows:

10	20		8 Sec. 5. Definitions. As used in this Act:
11	21		9 "Food desert" means an area lacking fresh fruit,
12	22		10 vegetables, and other healthful whole foods, due to a lack of
13	23		11 grocery stores, farmers' markets, or healthy food providers.
14	24		12 "Local farm fresh produce or food products" are products:
15	25		13 (1) grown in Illinois; or (2) processed and packaged in
16	26		14 Illinois, using at least one ingredient grown in Illinois.
17	27		15 "Socially disadvantaged farmers" means farmers located in
18	28		16 Illinois who have been subjected to racial or ethnic
19	29		17 prejudices or who have been placed at a disadvantage because
20	30		18 of their identity as a member of a racial or ethnic group
21	31		19 without regard to their individual qualities. "Socially
22	32		20 disadvantaged farmers" includes farmers who identify as a
23	33		21 "minority person", as defined under Section 2 of the Business
24	34		22 Enterprise for Minorities, Women, and Persons with
25	35		23 Disabilities Act, and who have been certified as a

37	77		4 Sec. 10. Procurement goals for local farm fresh produce or
38	78		5 food products.
39	79		6 (a) In order to create, strengthen, and expand local farm
40	80		7 and food economies throughout Illinois, it shall be the goal
41	81		8 of this State that 20% of all food and food products purchased
42	82		9 by State agencies and State-owned facilities, including,
43	83		10 without limitation, facilities for persons with mental health
44	84		11 and developmental disabilities, correctional facilities, and
45	85		12 public universities, shall, by 2020, be local farm fresh
46	86		13 produce or food products.
47	87		14 (b) The State shall support and encourage that 10% of food
48	88		15 and food products purchased by entities funded in part or in
49	89		16 whole by State dollars, which spend more than $25,000 per year
50	90		17 on food or food products for its students, residents, or
51	91		18 clients, including, without limitation, public schools, child
52	92		19 care facilities, after-school programs, and hospitals, shall,
53	93		20 by 2020, be local farm fresh produce or food products.
54	94		21 (c) To meet the goals set forth in this Section, when a
55	95		22 State contract for purchase of food or food products is to be
56	96		23 awarded to the lowest responsible bidder, an otherwise
57	97		24 qualified bidder who will fulfill the contract through the use
58	98		25 of local farm fresh produce or food products may be given

69	109		1 preference over other bidders, provided that the cost included
70	110		2 in the bid of local farm fresh produce or food products is not
71	111		3 more than 10% greater than the cost included in a bid that is
72	112		4 not for local farm fresh produce or food products.
73	113		5 (d) All State agencies and State-owned facilities that
74	114		6 purchase food and food products for use at State-owned
75	115		7 facilities shall develop a system for (i) identifying the
76	116		8 percentage of local farm fresh produce or food products
77	117		9 purchased for fiscal year 2021 as the baseline; and (ii)
78	118		10 tracking and reporting local farm fresh produce or food
79	119		11 products purchases on an annual basis.
80	120		12 (e) On January 1, 2024 and each January 1 thereafter,
81	121		13 those State agencies and State-owned facilities that purchase
82	122		14 food or food products shall publish in their respective
83	123		15 procurement bulletins, in the form and format prescribed by
84	124		16 the chief procurement officer, notice of their purchases of
85	125		17 local farm or food products in the immediately preceding
86	126		18 fiscal year.

90	130		22 (a) To create, strengthen, and expand local farm and food
91	131		23 economies throughout Illinois, and to create equity in those
92	132		24 economies, it is the aspirational goal of this State for at
93	133		25 least 10% of all of the food and food products purchased by

106	146		3 (b) It is also the aspirational goal of the State for at
107	147		4 least 10% of the food and food products purchased by entities
108	148		5 that are funded in part or in whole by State dollars and that
109	149		6 spend more than $25,000 per year on food or food products to be
110	150		7 local farm fresh produce or food products produced by socially
111	151		8 disadvantaged farmers.
112	152		9 (c) To meet the goals set forth in this Section, when a
113	153		10 State contract for the purchase of food or food products is to
114	154		11 be awarded to the lowest responsive and responsible bidder, an
115	155		12 otherwise qualified bidder who is a socially disadvantaged
116	156		13 farmer that will fulfill the contract through the use of local
117	157		14 farm fresh produce or food products may be given preference
118	158		15 over other bidders, provided that the cost included in the bid
119	159		16 of local farm fresh produce or food products is not more than
120	160		17 10% greater than the cost included in a bid that is not for
121	161		18 local farm fresh produce or food products. A State agency
122	162		19 purchasing fresh produce may request any information necessary
123	163		20 to determine whether a bidder will fulfill the contract
124	164		21 through the use of local farm fresh produce or food products.
125	165		22 (d) All State agencies that purchase food and food
126	166		23 products for use at State-owned facilities shall develop a
127	167		24 system for: (i) identifying the percentage of local farm fresh
128	168		25 produce or food products produced by socially disadvantaged
