313 1 AN ACT concerning finance.
414 2 Be it enacted by the People of the State of Illinois,
515 3 represented in the General Assembly:
616 4 Section 5. The Local Food, Farms, and Jobs Act is amended
7-5 by changing Sections 5 and 10 and by adding Section 13 as
8-6 follows:

1020 8 Sec. 5. Definitions. As used in this Act:
1121 9 "Food desert" means an area lacking fresh fruit,
1222 10 vegetables, and other healthful whole foods, due to a lack of
1323 11 grocery stores, farmers' markets, or healthy food providers.
1424 12 "Local farm fresh produce or food products" are products:
1525 13 (1) grown in Illinois; or (2) processed and packaged in
1626 14 Illinois, using at least one ingredient grown in Illinois.
1727 15 "Socially disadvantaged farmers" means farmers located in
1828 16 Illinois who have been subjected to racial or ethnic
1929 17 prejudices or who have been placed at a disadvantage because
2030 18 of their identity as a member of a racial or ethnic group
2131 19 without regard to their individual qualities. "Socially
2232 20 disadvantaged farmers" includes farmers who identify as a
2333 21 "minority person", as defined under Section 2 of the Business
2434 22 Enterprise for Minorities, Women, and Persons with
2535 23 Disabilities Act, and who have been certified as a

3777 4 Sec. 10. Procurement goals for local farm fresh produce or
3878 5 food products.
3979 6 (a) In order to create, strengthen, and expand local farm
4080 7 and food economies throughout Illinois, it shall be the goal
4181 8 of this State that 20% of all food and food products purchased
4282 9 by State agencies and State-owned facilities, including,
4383 10 without limitation, facilities for persons with mental health
4484 11 and developmental disabilities, correctional facilities, and
4585 12 public universities, shall, by 2020, be local farm fresh
4686 13 produce or food products.
4787 14 (b) The State shall support and encourage that 10% of food
4888 15 and food products purchased by entities funded in part or in
4989 16 whole by State dollars, which spend more than $25,000 per year
5090 17 on food or food products for its students, residents, or
5191 18 clients, including, without limitation, public schools, child
5292 19 care facilities, after-school programs, and hospitals, shall,
5393 20 by 2020, be local farm fresh produce or food products.
5494 21 (c) To meet the goals set forth in this Section, when a
5595 22 State contract for purchase of food or food products is to be
5696 23 awarded to the lowest responsible bidder, an otherwise
5797 24 qualified bidder who will fulfill the contract through the use
5898 25 of local farm fresh produce or food products may be given

69109 1 preference over other bidders, provided that the cost included
70110 2 in the bid of local farm fresh produce or food products is not
71111 3 more than 10% greater than the cost included in a bid that is
72112 4 not for local farm fresh produce or food products.
73113 5 (d) All State agencies and State-owned facilities that
74114 6 purchase food and food products for use at State-owned
75115 7 facilities shall develop a system for (i) identifying the
76116 8 percentage of local farm fresh produce or food products
77117 9 purchased for fiscal year 2021 as the baseline; and (ii)
78118 10 tracking and reporting local farm fresh produce or food
79119 11 products purchases on an annual basis.
80120 12 (e) On January 1, 2024 and each January 1 thereafter,
81121 13 those State agencies and State-owned facilities that purchase
82122 14 food or food products shall publish in their respective
83123 15 procurement bulletins, in the form and format prescribed by
84124 16 the chief procurement officer, notice of their purchases of
85125 17 local farm or food products in the immediately preceding
86126 18 fiscal year.

90130 22 (a) To create, strengthen, and expand local farm and food
91131 23 economies throughout Illinois, and to create equity in those
92132 24 economies, it is the aspirational goal of this State for at

106146 3 (b) It is also the aspirational goal of the State for at

108148 5 that are funded in part or in whole by State dollars and that
109149 6 spend more than $25,000 per year on food or food products to be
110150 7 local farm fresh produce or food products produced by socially
111151 8 disadvantaged farmers.
112152 9 (c) To meet the goals set forth in this Section, when a
113153 10 State contract for the purchase of food or food products is to
114154 11 be awarded to the lowest responsive and responsible bidder, an
115155 12 otherwise qualified bidder who is a socially disadvantaged
116156 13 farmer that will fulfill the contract through the use of local
117157 14 farm fresh produce or food products may be given preference
118158 15 over other bidders, provided that the cost included in the bid
119159 16 of local farm fresh produce or food products is not more than
120160 17 10% greater than the cost included in a bid that is not for
121161 18 local farm fresh produce or food products. A State agency
122162 19 purchasing fresh produce may request any information necessary
123163 20 to determine whether a bidder will fulfill the contract
124164 21 through the use of local farm fresh produce or food products.
125165 22 (d) All State agencies that purchase food and food
126166 23 products for use at State-owned facilities shall develop a
127167 24 system for: (i) identifying the percentage of local farm fresh
128168 25 produce or food products produced by socially disadvantaged
