1111 1 AN ACT concerning criminal law.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Criminal Code of 2012 is amended by
1515 5 changing Section 26-7 as follows:
1616 6 (720 ILCS 5/26-7)
1717 7 Sec. 26-7. Disorderly conduct with a laser or laser
1818 8 pointer.
1919 9 (a) Definitions. For the purposes of this Section:
2020 10 "Aircraft" means any contrivance now known or
2121 11 hereafter invented, used, or designed for navigation of or
2222 12 flight in the air, but excluding parachutes.
2323 13 "Laser" means both of the following:
2424 14 (1) any device that utilizes the natural
2525 15 oscillations of atoms or molecules between energy
2626 16 levels for generating coherent electromagnetic
2727 17 radiation in the ultraviolet, visible, or infrared
2828 18 region of the spectrum and when discharged exceeds one
2929 19 milliwatt continuous wave;
3030 20 (2) any device designed or used to amplify
3131 21 electromagnetic radiation by simulated emission that
3232 22 is visible to the human eye.
3333 23 "Laser pointer" means a hand-held device that emits

7070 3 "Laser sight" means a laser pointer that can be
7171 4 attached to a firearm and can be used to improve the
7272 5 accuracy of the firearm.
7373 6 (b) A person commits disorderly conduct with a laser or
7474 7 laser pointer when he or she intentionally or knowingly:
7575 8 (1) aims an operating laser pointer at a person he or
7676 9 she knows or reasonably should know to be a peace officer;
7777 10 or
7878 11 (2) aims and discharges a laser or other device that
7979 12 creates visible light into the cockpit of an aircraft that
8080 13 is in the process of taking off, landing, or is in flight;
8181 14 or
8282 15 (3) aims a laser or laser pointer at a person or at a
8383 16 person's residence without the consent of that person.
8484 17 (c) Paragraph (2) of subsection (b) does not apply to the
8585 18 following individuals who aim and discharge a laser or other
8686 19 device at an aircraft:
8787 20 (1) an authorized individual in the conduct of
8888 21 research and development or flight test operations
8989 22 conducted by an aircraft manufacturer, the Federal
9090 23 Aviation Administration, or any other person authorized by
9191 24 the Federal Aviation Administration to conduct this
9292 25 research and development or flight test operations; or
9393 26 (2) members or elements of the Department of Defense

107107 4 (d) Sentence. Disorderly conduct with a laser or laser
