11	11	1 AN ACT concerning public aid.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 5. The Illinois Public Aid Code is amended by
15	15	5 changing Section 5-5.05 as follows:
16	16	6 (305 ILCS 5/5-5.05)
17	17	7 Sec. 5-5.05. Hospitals; psychiatric services.
18	18	8 (a) On and after July 1, 2008, the inpatient, per diem rate
19	19	9 to be paid to a hospital for inpatient psychiatric services
20	20	10 shall be $363.77.
21	21	11 (b) For purposes of this Section, "hospital" means the
22	22	12 following:
23	23	13 (1) Advocate Christ Hospital, Oak Lawn, Illinois.
24	24	14 (2) Barnes-Jewish Hospital, St. Louis, Missouri.
25	25	15 (3) BroMenn Healthcare, Bloomington, Illinois.

117	117	14 For purposes of this Section, "inpatient psychiatric
118	118	15 services" means those services provided to patients who are in
119	119	16 need of short-term acute inpatient hospitalization for active
120	120	17 treatment of an emotional or mental disorder.
121	121	18 (b-5) Notwithstanding any other provision of this Section,
122	122	19 and subject to appropriation, the inpatient, per diem rate to
123	123	20 be paid to all safety-net hospitals for inpatient psychiatric
124	124	21 services on and after January 1, 2021 shall be at least $630.
125	125	22 (b-10) Notwithstanding any other provision of this
126	126	23 Section, effective with dates of service on and after January
127	127	24 1, 2022, any general acute care hospital with more than 9,500
128	128	25 inpatient psychiatric Medicaid days in any calendar year shall
129	129	26 be paid the inpatient per diem rate of no less than $630.

140	140	1 (b-15) Notwithstanding any other provision of this
141	141	2 Section, any freestanding psychiatric hospital located in
142	142	3 Peoria County, for which construction commenced on or after
143	143	4 January 1, 2023, shall be paid the inpatient per diem rate of
144	144	5 no less than $630 for dates of service on and after January 1,
145	145	6 2025.
146	146	7 (c) No rules shall be promulgated to implement this
147	147	8 Section. For purposes of this Section, "rules" is given the
148	148	9 meaning contained in Section 1-70 of the Illinois
149	149	10 Administrative Procedure Act.
150	150	11 (d) This Section shall not be in effect during any period
151	151	12 of time that the State has in place a fully operational
152	152	13 hospital assessment plan that has been approved by the Centers
153	153	14 for Medicare and Medicaid Services of the U.S. Department of
154	154	15 Health and Human Services.
155	155	16 (e) On and after July 1, 2012, the Department shall reduce
156	156	17 any rate of reimbursement for services or other payments or
157	157	18 alter any methodologies authorized by this Code to reduce any
158	158	19 rate of reimbursement for services or other payments in
159	159	20 accordance with Section 5-5e.
