1111 1 AN ACT concerning public aid.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Illinois Public Aid Code is amended by
1515 5 changing Section 5-5.05 as follows:

1717 7 Sec. 5-5.05. Hospitals; psychiatric services.
1818 8 (a) On and after July 1, 2008, the inpatient, per diem rate
1919 9 to be paid to a hospital for inpatient psychiatric services
2020 10 shall be $363.77.
2121 11 (b) For purposes of this Section, "hospital" means the

117117 14 For purposes of this Section, "inpatient psychiatric
118118 15 services" means those services provided to patients who are in
119119 16 need of short-term acute inpatient hospitalization for active
120120 17 treatment of an emotional or mental disorder.
121121 18 (b-5) Notwithstanding any other provision of this Section,
122122 19 and subject to appropriation, the inpatient, per diem rate to
123123 20 be paid to all safety-net hospitals for inpatient psychiatric
124124 21 services on and after January 1, 2021 shall be at least $630.
125125 22 (b-10) Notwithstanding any other provision of this
126126 23 Section, effective with dates of service on and after January
127127 24 1, 2022, any general acute care hospital with more than 9,500
128128 25 inpatient psychiatric Medicaid days in any calendar year shall
129129 26 be paid the inpatient per diem rate of no less than $630.

140140 1 (b-15) Notwithstanding any other provision of this
141141 2 Section, any freestanding psychiatric hospital located in
142142 3 Peoria County, for which construction commenced on or after
143143 4 January 1, 2023, shall be paid the inpatient per diem rate of
144144 5 no less than $630 for dates of service on and after January 1,
145145 6 2025.
146146 7 (c) No rules shall be promulgated to implement this
147147 8 Section. For purposes of this Section, "rules" is given the
148148 9 meaning contained in Section 1-70 of the Illinois
149149 10 Administrative Procedure Act.
150150 11 (d) This Section shall not be in effect during any period
151151 12 of time that the State has in place a fully operational
152152 13 hospital assessment plan that has been approved by the Centers
153153 14 for Medicare and Medicaid Services of the U.S. Department of
154154 15 Health and Human Services.
155155 16 (e) On and after July 1, 2012, the Department shall reduce
156156 17 any rate of reimbursement for services or other payments or
157157 18 alter any methodologies authorized by this Code to reduce any
158158 19 rate of reimbursement for services or other payments in
159159 20 accordance with Section 5-5e.
