Provides that a land owner, including private owners, the State, or a unit of local government, must rope off and erect warning signs near portions of a pond, river, or lake that is reasonably accessible by persons other than the owner of the property if (1) the pond, river, or lake is within 500 feet of a residence other than the property owner's residence and (2) a majority of the water by the shore is iced over. Requires a sign to be erected every 50 feet that includes a warning drawing of an individual falling through ice and text stating, "Warning: Thin Ice". Provides that a county, municipality, or township, including home rule units, may not adopt ordinances regulating the roping off and signage required in a manner less restrictive than provided in the Act. Provides that a county, municipality, or township ordinance regulating the roping off and signage requirements may include, but is not limited to, regulations expanding the requirements to other, temporary bodies of water, such as drainage basins, and regulating fishing and ice skating on bodies of water where roping off and signage is required. Provides that roping off and signage is not required and may not be regulated for the portions of a pond, river, or lake that are used by livestock as a water source. 11	11	1 AN ACT concerning local government.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 1. Short title. This Act may be cited as the Thin
15	15	5 Ice Warning Act.
16	16	6 Section 5. Roping off and signs required.
17	17	7 (a) A land owner, including private owners, the State, or
18	18	8 a unit of local government, must rope off and erect warning
19	19	9 signs near portions of a pond, river, or lake that is
20	20	10 reasonably accessible by persons other than the owner of the
21	21	11 property if (1) the pond, river, or lake is within 500 feet of
22	22	12 a residence other than the property owner's residence and (2)
23	23	13 a majority of the water by the shore is iced over. Ropes must
24	24	14 be hung at approximately 3 feet tall.
25	25	15 (b) On each roped off area under subsection (a), a sign
26	26	16 must be erected every 50 feet. The sign must contain a warning
27	27	17 drawing of an individual falling through ice and text stating,
28	28	18 "Warning: Thin Ice".

67	67	1 restrictive than provided in Section 5. This Act is a
68	68	2 limitation under subsection (i) of Section 6 of Article VII of
69	69	3 the Illinois Constitution on the concurrent exercise by home
70	70	4 rule units of powers and functions exercised by the State. A
71	71	5 county, municipality, or township ordinance regulating the
72	72	6 roping off and signage requirements in Section 5 may include,
73	73	7 but is not limited to, regulations expanding the requirements
74	74	8 to other, temporary bodies of water, such as drainage basins,
75	75	9 and regulating fishing and ice skating on bodies of water
76	76	10 where roping off and signage is required under Section 5.
77	77	11 (b) A county or township may not regulate within a
78	78	12 municipality that that has adopted an ordinance under
79	79	13 subsection (a). A county may not regulate within a township
80	80	14 that has adopted an ordinance under subsection (a).
81	81	15 Section 15. Water sources. Roping off and signage is not
82	82	16 required under Section 5 and may not be regulated under
83	83	17 Section 10 for any portions of a pond, river, or lake that are
84	84	18 used by livestock as a water source.
