4-AN ACT concerning business.
5-Be it enacted by the People of the State of Illinois,
6-represented in the General Assembly:
7-Section 5. The Cemetery Oversight Act is amended by
8-changing Section 20-10 as follows:
9-(225 ILCS 411/20-10)
10-(Section scheduled to be repealed on January 1, 2027)
11-Sec. 20-10. Contract.
12-(a) At the time cemetery arrangements are made and prior
13-to rendering the cemetery services, a cemetery authority shall
14-create a completed written contract to be provided to the
15-consumer, signed by both parties by their actual written
16-signatures on either paper or electronic form, that shall
17-contain: (i) the date on which the arrangements were made;
18-(ii) the price of the service selected and the services and
19-merchandise included for that price; (iii) the supplemental
20-items of service and merchandise requested and the price of
21-each item; (iv) the terms or method of payment agreed upon; and
22-(v) a statement as to any monetary advances made on behalf of
23-the family. The cemetery authority shall maintain a copy of
24-such written contract in its permanent records.
25-(b) Any retail installment contract for the purchase of
26-interment, entombment, or inurnment rights shall contain a

34-capital letters, that rights to a deeded interest do not vest
35-until final payment and that upon an uncured default,
36-including when a contract is rolled into a new open-balance
37-retail installment contract, with additional interment,
38-entombment, or inurnment rights or additional cemetery
39-merchandise or services, there will be no deeded interest.
