Kevin John Olickal SYNOPSIS AS INTRODUCED: 305 ILCS 5/5-47 new Amends the Administration Article of the Illinois Public Aid Code. Provides that subject to appropriation, the Department of Human Services shall replace SNAP benefits that were stolen from a recipient's electronic benefits transfer card by means of card skimming, card cloning, or some other similar fraudulent method during the period October 1, 2022 through September 30, 2026. Provides that the Department may adopt any rules necessary to implement the amendatory Act, including rules on how to accept and substantiate recipient claims for SNAP benefits stolen by means of card skimming, card cloning, or some other similar fraudulent method. Provides that the amendatory Act is repealed on January 1, 2027. Effective immediately. 1111 1 AN ACT concerning public aid.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Illinois Public Aid Code is amended by
1515 5 adding Section 5-47 as follows:
1616 6 (305 ILCS 5/5-47 new)
1717 7 Sec. 5-47. Stolen SNAP benefits replacement.
1818 8 (a) As used in this Section, "electronic benefits transfer
1919 9 card" means the LINK card issued by the Department of Human
2020 10 Services for the purpose of enabling a user of the card to
2121 11 obtain Supplemental Nutrition Assistance Program (SNAP)
2222 12 benefits or cash.
2323 13 (b) Subject to appropriation, the Department of Human
2424 14 Services shall replace SNAP benefits that were stolen from a
2525 15 recipient's electronic benefits transfer card by means of card
2626 16 skimming, card cloning, or some other similar fraudulent
2727 17 method during the period October 1, 2022 through September 30,
2828 18 2026. The Department may adopt any rules necessary to
2929 19 implement this provision, including rules on how to accept and
3030 20 substantiate recipient claims for SNAP benefits stolen by
3131 21 means of card skimming, card cloning, or some other similar
3232 22 fraudulent method. This Section is repealed on January 1,
3333 23 2027.
