1	1	103RD GENERAL ASSEMBLY State of Illinois 2023 and 2024 HB3885 Introduced , by Rep. Maura Hirschauer SYNOPSIS AS INTRODUCED: 430 ILCS 69/35-45 new Amends the Reimagine Public Safety Act. Provides that subject to appropriation, the Office of Firearm Violence Prevention shall create an assault weapon and large capacity ammunition feeding device buyback program. Provides that subject to appropriation, the Office of Firearm Violence Prevention shall purchase operable assault weapons and large capacity ammunition feeding devices from the owners of those weapons and devices who wish to sell them to the State. Provides that permanently inoperable assault weapons or large capacity ammunition feeding devices are ineligible for the buyback program. Provides that the buyback program shall permit the owners of firearms that are not assault weapons to participate in the buyback program. Provides that firearms and large capacity ammunition feeding devices purchased at the buyback program shall be delivered to the Illinois State Police who may: (1) destroy the firearms and devices; (2) use them for training or other Illinois State Police purposes; or (3) transfer them to municipal and county law enforcement agencies for their use. Provides that the Department of Human Services shall adopt rules to implement the program. 11	11	1 AN ACT concerning safety.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 5. The Reimagine Public Safety Act is amended by
15	15	5 adding Section 35-45 as follows:
16	16	6 (430 ILCS 69/35-45 new)
17	17	7 Sec. 35-45. Assault weapons and large capacity ammunition
18	18	8 feeding devices buyback program.
19	19	9 (a) In this Section, "assault weapon" and "large capacity
20	20	10 ammunition feeding device" have the meanings ascribed to them
21	21	11 in Section 24-1.9 or 24-1.10 of the Criminal Code of 2012,
22	22	12 respectively and includes any additional identified assault
23	23	13 weapons designated as such by the Illinois State Police.
24	24	14 (b) Subject to appropriation, the Office of Firearm
25	25	15 Violence Prevention shall create an assault weapon and large
26	26	16 capacity ammunition feeding device buyback program.
27	27	17 (c) Subject to appropriation, the Office of Firearm
28	28	18 Violence Prevention shall purchase operable assault weapons
29	29	19 and large capacity ammunition feeding devices from the owners
30	30	20 of those weapons and devices who wish to sell them to the
31	31	21 State. Permanently inoperable assault weapons or large
32	32	22 capacity ammunition feeding devices are ineligible for the

68	68	1 (d) The buyback program shall permit the owners of
69	69	2 firearms that are not assault weapons to participate in the
70	70	3 buyback program.
71	71	4 (e) Firearms and large capacity ammunition feeding devices
72	72	5 purchased at the buyback program shall be delivered to the
73	73	6 Illinois State Police who may:
74	74	7 (1) destroy the firearms and devices;
75	75	8 (2) use them for training or other Illinois State
76	76	9 Police purposes; or
77	77	10 (3) transfer them to municipal and county law
78	78	11 enforcement agencies for their use.
79	79	12 (e) The Department of Human Services shall adopt rules to
80	80	13 implement this program.
