1111 1 AN ACT concerning local government.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 1. Short title. This Act may be cited as the Local
1515 5 Official Vacancy Posting Act.
1616 6 Section 5. Posting of elected official vacancies. A unit
1717 7 of local government shall post every elected official vacancy
1818 8 on its website, if the website is maintained by the unit of
1919 9 local government's full-time staff. The posting shall remain
2020 10 on the website until the vacancy is filled.
2121 11 Section 10. Posting on county website. In addition to the
2222 12 postings required under Section 5, a unit of local government
2323 13 shall submit every elected official vacancy to the county
2424 14 clerk in the county in which the unit is located and the county
2525 15 clerk shall post the information on the county website. The
2626 16 posting shall remain on the website until the unit of local
2727 17 government informs the county clerk that the vacancy has been
2828 18 filled.
2929 19 Section 15. Filling of elected official vacancies after
3030 20 posting. If the unit of local government has a website
3131 21 maintained by the unit of local government's full-time staff,

7373 8 Section 90. Home rule. A home rule unit may not regulate
7474 9 the posting of elected official vacancies in a manner
7575 10 inconsistent with this Act. This Act is a limitation under
7676 11 subsection (i) of Section 6 of Article VII of the Illinois
7777 12 Constitution on the concurrent exercise by home rule units of
7878 13 powers and functions exercised by the State.
