1111 1 AN ACT concerning education.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The School Code is amended by changing Section
1515 5 10-17a as follows:
1616 6 (105 ILCS 5/10-17a) (from Ch. 122, par. 10-17a)
1717 7 Sec. 10-17a. State, school district, and school report
1818 8 cards.
1919 9 (1) By October 31, 2013 and October 31 of each subsequent
2020 10 school year, the State Board of Education, through the State
2121 11 Superintendent of Education, shall prepare a State report
2222 12 card, school district report cards, and school report cards,
2323 13 and shall by the most economical means provide to each school
2424 14 district in this State, including special charter districts
2525 15 and districts subject to the provisions of Article 34, the
2626 16 report cards for the school district and each of its schools.
2727 17 Because of the impacts of the COVID-19 public health emergency
2828 18 during school year 2020-2021, the State Board of Education
2929 19 shall have until December 31, 2021 to prepare and provide the
3030 20 report cards that would otherwise be due by October 31, 2021.
3131 21 During a school year in which the Governor has declared a
3232 22 disaster due to a public health emergency pursuant to Section
3333 23 7 of the Illinois Emergency Management Agency Act, the report

7070 3 (2) In addition to any information required by federal
7171 4 law, the State Superintendent shall determine the indicators
7272 5 and presentation of the school report card, which must
7373 6 include, at a minimum, the most current data collected and
7474 7 maintained by the State Board of Education related to the
7575 8 following:
7676 9 (A) school characteristics and student demographics,
7777 10 including average class size, average teaching experience,
7878 11 student racial/ethnic breakdown, and the percentage of
7979 12 students classified as low-income; the percentage of
8080 13 students classified as English learners, the number of
8181 14 students who graduate from a bilingual or English learner
8282 15 program, and the number of students who graduate from,
8383 16 transfer from, or otherwise leave bilingual programs; the
8484 17 percentage of students who have individualized education
8585 18 plans or 504 plans that provide for special education
8686 19 services; the number and percentage of all students who
8787 20 have been assessed for placement in a gifted education or
8888 21 advanced academic program and, of those students: (i) the
8989 22 racial and ethnic breakdown, (ii) the percentage who are
9090 23 classified as low-income, and (iii) the number and
9191 24 percentage of students who received direct instruction
9292 25 from a teacher who holds a gifted education endorsement

119119 16 elective classes are offered, health and wellness
120120 17 initiatives (including the average number of days of
121121 18 Physical Education per week per student), approved
122122 19 programs of study, awards received, community
123123 20 partnerships, and special programs such as programming for
124124 21 the gifted and talented, students with disabilities, and
125125 22 work-study students;
126126 23 (C) student outcomes, including, where applicable, the
127127 24 percentage of students deemed proficient on assessments of
128128 25 State standards, the percentage of students in the eighth
129129 26 grade who pass Algebra, the percentage of students who

155155 16 to learn, a measure of growth, and the percentage of
156156 17 students who enter high school on track for college and
157157 18 career readiness;
158158 19 (E) the school environment, including, where
159159 20 applicable, high school dropout rate by grade level, the
160160 21 percentage of students with less than 10 absences in a
161161 22 school year, the percentage of teachers with less than 10
162162 23 absences in a school year for reasons other than
163163 24 professional development, leaves taken pursuant to the
164164 25 federal Family Medical Leave Act of 1993, long-term
165165 26 disability, or parental leaves, the 3-year average of the

178178 3 school in the last 6 years, the number of teachers who hold
179179 4 a gifted education endorsement, the process and criteria
180180 5 used by the district to determine whether a student is
181181 6 eligible for participation in a gifted education program
182182 7 or advanced academic program and the manner in which
183183 8 parents and guardians are made aware of the process and
184184 9 criteria, the number of teachers who are National Board
185185 10 Certified Teachers, disaggregated by race and ethnicity, 2
186186 11 or more indicators from any school climate survey selected
187187 12 or approved by the State and administered pursuant to
188188 13 Section 2-3.153 of this Code, with the same or similar
189189 14 indicators included on school report cards for all surveys
190190 15 selected or approved by the State pursuant to Section
191191 16 2-3.153 of this Code, the combined percentage of teachers
192192 17 rated as proficient or excellent in their most recent
193193 18 evaluation, and, beginning with the 2022-2023 school year,
194194 19 data on the number of incidents of violence that occurred
195195 20 on school grounds or during school-related activities and
196196 21 that resulted in an out-of-school suspension, expulsion,
197197 22 or removal to an alternative setting, as reported pursuant
198198 23 to Section 2-3.162;
199199 24 (F) a school district's and its individual schools'
200200 25 balanced accountability measure, in accordance with
201201 26 Section 2-3.25a of this Code;

213213 2 State contributed to the Teachers' Retirement System of
214214 3 the State of Illinois in the prior fiscal year for the
215215 4 school's employees, which shall be reported to the State
216216 5 Board of Education by the Teachers' Retirement System of
217217 6 the State of Illinois;
218218 7 (H) for a school district organized under Article 34
219219 8 of this Code only, State contributions to the Public
220220 9 School Teachers' Pension and Retirement Fund of Chicago
221221 10 and State contributions for health care for employees of
222222 11 that school district;
223223 12 (I) a school district's Final Percent of Adequacy, as
224224 13 defined in paragraph (4) of subsection (f) of Section
225225 14 18-8.15 of this Code;
226226 15 (J) a school district's Local Capacity Target, as
227227 16 defined in paragraph (2) of subsection (c) of Section
228228 17 18-8.15 of this Code, displayed as a percentage amount;
229229 18 (K) a school district's Real Receipts, as defined in
230230 19 paragraph (1) of subsection (d) of Section 18-8.15 of this
231231 20 Code, divided by a school district's Adequacy Target, as
232232 21 defined in paragraph (1) of subsection (b) of Section
233233 22 18-8.15 of this Code, displayed as a percentage amount;
234234 23 (L) a school district's administrative costs;
235235 24 (M) whether or not the school has participated in the
236236 25 Illinois Youth Survey. In this paragraph (M), "Illinois
237237 26 Youth Survey" means a self-report survey, administered in

254254 7 (P) class characteristics and student demographics of
255255 8 a given class, including racial/ethnic breakdown compared
256256 9 to that of the school, students classified as low income
257257 10 compared to that of the school, students classified as
258258 11 English learners compared to that of the school, students
259259 12 who have individualized education plans or 504 plans that
260260 13 provide for special education services compared to that of
261261 14 the school, the total number of years the teacher of the
262262 15 given class has been teaching, the number of years the
263263 16 teachers of the given class has been teaching that
264264 17 specific class, boys compared to that of the school, girls
265265 18 compared to that of the school, and the number of students
266266 19 in the class; and
267267 20 student outcomes, including, where applicable, the
268268 21 percentage of students who earn a C or higher in the class,
269269 22 the percentage of students who take the advanced placement
270270 23 test in an advanced placement class broken down by race,
271271 24 the passing rate of the advanced placement test broken
272272 25 down by race.

284284 1 allows for comparing the current outcome, progress, and
285285 2 environment data to the State average, to the school data from
286286 3 the past 5 years, and to the outcomes, progress, and
287287 4 environment of similar schools based on the type of school and
288288 5 enrollment of low-income students, special education students,
289289 6 and English learners.
290290 7 Any indicators collected shall be aggregated at the class
291291 8 level, department level, and school level, and the indicators
292292 9 shall be collected from each course.
293293 10 As used in this Section, "Class" means as each individual
294294 11 instructional course taken at a given school.
295295 12 As used in this subsection (2):
296296 13 "Administrative costs" means costs associated with
297297 14 executive, administrative, or managerial functions within the
298298 15 school district that involve planning, organizing, managing,
299299 16 or directing the school district.
300300 17 "Advanced academic program" means a course of study to
301301 18 which students are assigned based on advanced cognitive
302302 19 ability or advanced academic achievement compared to local age
303303 20 peers and in which the curriculum is substantially
304304 21 differentiated from the general curriculum to provide
305305 22 appropriate challenge and pace.
306306 23 "Computer science" means the study of computers and
307307 24 algorithms, including their principles, their hardware and
308308 25 software designs, their implementation, and their impact on
309309 26 society. "Computer science" does not include the study of

320320 1 everyday uses of computers and computer applications, such as
321321 2 keyboarding or accessing the Internet.
322322 3 "Gifted education" means educational services, including
323323 4 differentiated curricula and instructional methods, designed
324324 5 to meet the needs of gifted children as defined in Article 14A
325325 6 of this Code.
326326 7 For the purposes of paragraph (A) of this subsection (2),
327327 8 "average daily attendance" means the average of the actual
328328 9 number of attendance days during the previous school year for
329329 10 any enrolled student who is subject to compulsory attendance
330330 11 by Section 26-1 of this Code at each school and charter school.
331331 12 (3) At the discretion of the State Superintendent, the
332332 13 school district report card shall include a subset of the
333333 14 information identified in paragraphs (A) through (E) of
334334 15 subsection (2) of this Section, as well as information
335335 16 relating to the operating expense per pupil and other finances
336336 17 of the school district, and the State report card shall
337337 18 include a subset of the information identified in paragraphs
338338 19 (A) through (E) and paragraph (N) of subsection (2) of this
339339 20 Section. The school district report card shall include the
340340 21 average daily attendance, as that term is defined in
341341 22 subsection (2) of this Section, of students who have
342342 23 individualized education programs and students who have 504
343343 24 plans that provide for special education services within the
344344 25 school district.
345345 26 (4) Notwithstanding anything to the contrary in this

356356 1 Section, in consultation with key education stakeholders, the
357357 2 State Superintendent shall at any time have the discretion to
358358 3 amend or update any and all metrics on the school, district, or
359359 4 State report card.
360360 5 (5) Annually, no more than 30 calendar days after receipt
361361 6 of the school district and school report cards from the State
362362 7 Superintendent of Education, each school district, including
363363 8 special charter districts and districts subject to the
364364 9 provisions of Article 34, shall present such report cards at a
365365 10 regular school board meeting subject to applicable notice
366366 11 requirements, post the report cards on the school district's
367367 12 Internet web site, if the district maintains an Internet web
368368 13 site, make the report cards available to a newspaper of
369369 14 general circulation serving the district, and, upon request,
370370 15 send the report cards home to a parent (unless the district
371371 16 does not maintain an Internet web site, in which case the
372372 17 report card shall be sent home to parents without request). If
373373 18 the district posts the report card on its Internet web site,
374374 19 the district shall send a written notice home to parents
375375 20 stating (i) that the report card is available on the web site,
376376 21 (ii) the address of the web site, (iii) that a printed copy of
377377 22 the report card will be sent to parents upon request, and (iv)
378378 23 the telephone number that parents may call to request a
379379 24 printed copy of the report card.
380380 25 (6) Nothing contained in Public Act 98-648 repeals,
381381 26 supersedes, invalidates, or nullifies final decisions in
