1212 1 AN ACT concerning local government.
1313 2 Be it enacted by the People of the State of Illinois,
1414 3 represented in the General Assembly:
1515 4 Section 5. The Counties Code is amended by adding Section
1616 5 5-1126.5 as follows:
1717 6 (55 ILCS 5/5-1126.5 new)
1818 7 Sec. 5-1126.5. Cannabis consumption. The county board may
1919 8 license or regulate businesses operating as a public
2020 9 accommodation that permit the consumption of cannabis on the
2121 10 business premises and that are not regulated under the
2222 11 Cannabis Regulation and Tax Act. The consumption of cannabis
2323 12 under this Section is exempt from the provisions of
2424 13 subparagraph (F) of paragraph (3) of subsection (a) of Section
2525 14 10-35 of the Cannabis Regulation and Tax Act. For purposes of
2626 15 this Section, "public accommodation" means a refreshment,
2727 16 entertainment, or recreation facility of any kind, whether
2828 17 licensed or not, whose goods, services, facilities,
2929 18 privileges, or advantages are extended, offered, sold, or
3030 19 otherwise made available to the public.
3131 20 Section 10. The Illinois Municipal Code is amended by

7070 2 Sec. 11-42-10.3. Cannabis consumption. The corporate
7171 3 authorities of each municipality may license or regulate
7272 4 businesses operating as a public accommodation that permit the
7373 5 consumption of cannabis on the business premises and that are
7474 6 not regulated under the Cannabis Regulation and Tax Act. The
7575 7 consumption of cannabis under this Section is exempt from the
7676 8 provisions of subparagraph (F) of paragraph (3) of subsection
7777 9 (a) of Section 10-35 of the Cannabis Regulation and Tax Act.
7878 10 For purposes of this Section, "public accommodation" means a
7979 11 refreshment, entertainment, or recreation facility of any
8080 12 kind, whether licensed or not, whose goods, services,
8181 13 facilities, privileges, or advantages are extended, offered,
8282 14 sold, or otherwise made available to the public.
8383 15 Section 99. Effective date. This Act takes effect upon
8484 16 becoming law.
