Frances Ann Hurley SYNOPSIS AS INTRODUCED: 410 ILCS 705/55-100 new410 ILCS 705/55-105 new Amends the Cannabis Regulation and Tax Act. Provides that the mayor or president of the board of trustees of each city, village, or incorporated town and the president or chairman of the county board shall be the local cannabis control commissioner for his or her respective city, village, incorporated town, or county. Provides that the mayor, president of the board of trustees, or president or chairman of the county board may appoint a person or persons to assist him or her in the exercise of the powers and the performance of the duties of the local cannabis control commissioner. Provides for the powers, functions, and duties of a local cannabis control commissioner, including the power to recommend to the relevant Department that a license issued to a person within his or her jurisdiction be suspended or revoked for cause and to enter or to authorize any law enforcement officer to enter at any time upon any premises licensed under the Act to determine whether any of the provisions of the Act or any rules or regulations have been or are being violated, to examine the premises of a licensee, and to receive complaints from any citizen within the local cannabis control commissioner's jurisdiction. 1212 1 AN ACT concerning health.
1313 2 Be it enacted by the People of the State of Illinois,
1414 3 represented in the General Assembly:
1515 4 Section 5. The Cannabis Regulation and Tax Act is amended
1616 5 by adding Sections 55-100 and 55-105 as follows:
1717 6 (410 ILCS 705/55-100 new)
1818 7 Sec. 55-100. Local cannabis control commissioner. The
1919 8 mayor or president of the board of trustees of each city,
2020 9 village, or incorporated town, or his or her designee, and the
2121 10 president or chairman of the county board, or his or her
2222 11 designee, shall be the local cannabis control commissioner for
2323 12 his or her respective city, village, incorporated town, or
2424 13 county and shall be charged with the administration in his or
2525 14 her respective jurisdiction of the appropriate provisions of
2626 15 this Act and of ordinances and resolutions relating to
2727 16 cannabis as may be enacted. The authority of the president or
2828 17 chairman of the county board, or his or her designee, shall
2929 18 extend only to that area in any county that lies outside the
3030 19 corporate limit of any city, village, and incorporated town in
3131 20 the county and those areas that are owned by the county and are
3232 21 within the corporate limits of a city, village, and
3333 22 incorporated town with a population of less than 1,000,000.

7171 1 president or chairman of the county board, or his or her

7676 6 Sec. 55-105. Powers, functions, and duties of a local
7777 7 cannabis control commissioner. Each local cannabis control
7878 8 commissioner shall have the following powers, functions, and
7979 9 duties with respect to licenses issued under this Act:
8080 10 (1) to recommend to the relevant Department that a
8181 11 license issued to a person within his or her jurisdiction
8282 12 be suspended or revoked for cause;
8383 13 (2) to enter or to authorize any law enforcement
8484 14 officer to enter at any time upon any premises licensed
8585 15 under this Act to determine whether any of the provisions
8686 16 of this Act or any rules or regulations adopted by him or
8787 17 her or by the applicable Department have been or are being
8888 18 violated, and at such time to examine the premises of the
8989 19 licensee; and
9090 20 (3) to receive a complaint from any citizen within his
9191 21 or her jurisdiction that any provision of this Act or any
9292 22 rule adopted under this Act has been or is being violated
9393 23 and to act upon the complaint in a manner provided by law.
