2929 1 AN ACT concerning elections.
3030 2 Be it enacted by the People of the State of Illinois,
3131 3 represented in the General Assembly:
3232 4 Section 5. The Election Code is amended by changing
3333 5 Sections 1A-16, 1A-45, 3-6, 4-2, 4-23, 5-2, 5-29.01, 6-27,
3434 6 6-62, 6-67.01, 7-10, 7-45, 8-8, 10-4, 17-9, 17-10, 18A-5,
3535 7 20-3, and 28-3 as follows:
3636 8 (10 ILCS 5/1A-16)
3737 9 Sec. 1A-16. Voter registration information; Internet
3838 10 posting; processing of voter registration forms; content of
3939 11 such forms. Notwithstanding any law to the contrary, the
4040 12 following provisions shall apply to voter registration under
4141 13 this Code.
4242 14 (a) Voter registration information; Internet posting of
4343 15 voter registration form. Within 90 days after August 21, 2003
4444 16 (the effective date of Public Act 93-574), the State Board of
4545 17 Elections shall post on its World Wide Web site the following
4646 18 information:
4747 19 (1) A comprehensive list of the names, addresses,
4848 20 phone numbers, and websites, if applicable, of all county
4949 21 clerks and boards of election commissioners in Illinois.

122122 1 (3) A downloadable, printable voter registration form,
123123 2 in at least English and in Spanish versions, that a person
124124 3 may complete and mail or submit to the State Board of
125125 4 Elections or the appropriate county clerk or board of
126126 5 election commissioners.
127127 6 Any forms described under paragraph (3) must state the
128128 7 following:
129129 8 If you do not have a driver's license or social
130130 9 security number, and this form is submitted by mail, and
131131 10 you have never registered to vote in the jurisdiction you
132132 11 are now registering in, then you must send, with this
133133 12 application, either (i) a copy of a current and valid
134134 13 photo identification, or (ii) a copy of a current utility
135135 14 bill, bank statement, government check, paycheck, or other
136136 15 government document that shows the name and address of the
137137 16 voter. If you do not provide the information required
138138 17 above, then you will be required to provide election
139139 18 officials with either (i) or (ii) described above the
140140 19 first time you vote at a voting place.
141141 20 (b) Acceptance of registration forms by the State Board of
142142 21 Elections and county clerks and board of election
143143 22 commissioners. The State Board of Elections, county clerks,
144144 23 and board of election commissioners shall accept all completed
145145 24 voter registration forms described in subsection (a)(3) of
146146 25 this Section and Section 1A-17 and voter registration forms

158158 1 Victims of Domestic Violence, Sexual Assault, Human
159159 2 Trafficking, or Stalking Act that are:
160160 3 (1) postmarked on or before the day that voter
161161 4 registration is closed under this Code;
162162 5 (2) not postmarked, but arrives no later than 5 days
163163 6 after the close of registration;
164164 7 (3) submitted in person by a person using the form on
165165 8 or before the day that voter registration is closed under
166166 9 this Code; or
167167 10 (4) submitted in person by a person who submits one or
168168 11 more forms on behalf of one or more persons who used the
169169 12 form on or before the day that voter registration is
170170 13 closed under this Code.
171171 14 Upon the receipt of a registration form, the State Board
172172 15 of Elections shall mark the date on which the form was received
173173 16 and send the form via first class mail to the appropriate
174174 17 county clerk or board of election commissioners, as the case
175175 18 may be, within 2 business days based upon the home address of
176176 19 the person submitting the registration form. The county clerk
177177 20 and board of election commissioners shall accept and process
178178 21 any form received from the State Board of Elections.
179179 22 (c) Processing of registration forms by county clerks and
180180 23 boards of election commissioners. The county clerk or board of
181181 24 election commissioners shall promulgate procedures for
182182 25 processing the voter registration form.

267267 2 the best of my knowledge under penalty of perjury. If I
268268 3 have provided false information, then I may be fined,
269269 4 imprisoned, or, if I am not a U.S. citizen, deported
270270 5 from or refused entry into the United States.".
271271 6 (15) A space for the person to fill in his or her
272272 7 e-mail address if he or she chooses to provide that

274274 9 (d-5) Compliance with federal law; rulemaking authority.
275275 10 The voter registration form described in this Section shall be
276276 11 consistent with the form prescribed by the Federal Election
277277 12 Commission under the National Voter Registration Act of 1993,
278278 13 P.L. 103-31, as amended from time to time, and the Help America
279279 14 Vote Act of 2002, P.L. 107-252, in all relevant respects. The
280280 15 State Board of Elections shall periodically update the form
281281 16 based on changes to federal or State law. The State Board of
282282 17 Elections shall promulgate any rules necessary for the
283283 18 implementation of this Section; provided that the rules
284284 19 comport with the letter and spirit of the National Voter
285285 20 Registration Act of 1993 and Help America Vote Act of 2002 and
286286 21 maximize the opportunity for a person to register to vote.
287287 22 (d-10) No later than 90 days after the 2022 general
288288 23 election, the State Board of Elections shall permit applicants
289289 24 to choose between "male", "female", or "non-binary" when
290290 25 designating the applicant's sex on the voter registration

302302 1 (e) Forms available in paper form. The State Board of
303303 2 Elections shall make the voter registration form available in
304304 3 regular paper stock and form in sufficient quantities for the
305305 4 general public. The State Board of Elections may provide the
306306 5 voter registration form to the Secretary of State, county
307307 6 clerks, boards of election commissioners, designated agencies
308308 7 of the State of Illinois, and any other person or entity
309309 8 designated to have these forms by this Code in regular paper
310310 9 stock and form or some other format deemed suitable by the
311311 10 Board. Each county clerk or board of election commissioners
312312 11 has the authority to design and print its own voter
313313 12 registration form so long as the form complies with the
314314 13 requirements of this Section. The State Board of Elections,
315315 14 county clerks, boards of election commissioners, or other
316316 15 designated agencies of the State of Illinois required to have
317317 16 these forms under this Code shall provide a member of the
318318 17 public with any reasonable number of forms that he or she may
