30	30	2 Be it enacted by the People of the State of Illinois,
31	31	3 represented in the General Assembly:
32	32	4 Section 5. The Election Code is amended by changing
33	33	5 Sections 1A-16, 1A-45, 3-6, 4-2, 4-23, 5-2, 5-29.01, 6-27,
34	34	6 6-62, 6-67.01, 7-10, 7-45, 8-8, 10-4, 17-9, 17-10, 18A-5,
35	35	7 20-3, and 28-3 as follows:
36	36	8 (10 ILCS 5/1A-16)
37	37	9 Sec. 1A-16. Voter registration information; Internet
38	38	10 posting; processing of voter registration forms; content of
39	39	11 such forms. Notwithstanding any law to the contrary, the
40	40	12 following provisions shall apply to voter registration under
41	41	13 this Code.
42	42	14 (a) Voter registration information; Internet posting of
43	43	15 voter registration form. Within 90 days after August 21, 2003
44	44	16 (the effective date of Public Act 93-574), the State Board of
45	45	17 Elections shall post on its World Wide Web site the following
46	46	18 information:
47	47	19 (1) A comprehensive list of the names, addresses,
48	48	20 phone numbers, and websites, if applicable, of all county
49	49	21 clerks and boards of election commissioners in Illinois.
50	50	22 (2) A schedule of upcoming elections and the deadline

122	122	1 (3) A downloadable, printable voter registration form,
123	123	2 in at least English and in Spanish versions, that a person
124	124	3 may complete and mail or submit to the State Board of
125	125	4 Elections or the appropriate county clerk or board of
126	126	5 election commissioners.
127	127	6 Any forms described under paragraph (3) must state the
128	128	7 following:
129	129	8 If you do not have a driver's license or social
130	130	9 security number, and this form is submitted by mail, and
131	131	10 you have never registered to vote in the jurisdiction you
132	132	11 are now registering in, then you must send, with this
133	133	12 application, either (i) a copy of a current and valid
134	134	13 photo identification, or (ii) a copy of a current utility
135	135	14 bill, bank statement, government check, paycheck, or other
136	136	15 government document that shows the name and address of the
137	137	16 voter. If you do not provide the information required
138	138	17 above, then you will be required to provide election
139	139	18 officials with either (i) or (ii) described above the
140	140	19 first time you vote at a voting place.
141	141	20 (b) Acceptance of registration forms by the State Board of
142	142	21 Elections and county clerks and board of election
143	143	22 commissioners. The State Board of Elections, county clerks,
144	144	23 and board of election commissioners shall accept all completed
145	145	24 voter registration forms described in subsection (a)(3) of
146	146	25 this Section and Section 1A-17 and voter registration forms
147	147	26 created under Section 30 of the Address Confidentiality for

158	158	1 Victims of Domestic Violence, Sexual Assault, Human
159	159	2 Trafficking, or Stalking Act that are:
160	160	3 (1) postmarked on or before the day that voter
161	161	4 registration is closed under this Code;
162	162	5 (2) not postmarked, but arrives no later than 5 days
163	163	6 after the close of registration;
164	164	7 (3) submitted in person by a person using the form on
165	165	8 or before the day that voter registration is closed under
166	166	9 this Code; or
167	167	10 (4) submitted in person by a person who submits one or
168	168	11 more forms on behalf of one or more persons who used the
169	169	12 form on or before the day that voter registration is
170	170	13 closed under this Code.
171	171	14 Upon the receipt of a registration form, the State Board
172	172	15 of Elections shall mark the date on which the form was received
173	173	16 and send the form via first class mail to the appropriate
174	174	17 county clerk or board of election commissioners, as the case
175	175	18 may be, within 2 business days based upon the home address of
176	176	19 the person submitting the registration form. The county clerk
177	177	20 and board of election commissioners shall accept and process
178	178	21 any form received from the State Board of Elections.
179	179	22 (c) Processing of registration forms by county clerks and
180	180	23 boards of election commissioners. The county clerk or board of
181	181	24 election commissioners shall promulgate procedures for
182	182	25 processing the voter registration form.
183	183	26 (d) Contents of the voter registration form. The State

267	267	2 the best of my knowledge under penalty of perjury. If I
268	268	3 have provided false information, then I may be fined,
269	269	4 imprisoned, or, if I am not a U.S. citizen, deported
270	270	5 from or refused entry into the United States.".
271	271	6 (15) A space for the person to fill in his or her
272	272	7 e-mail address if he or she chooses to provide that
273	273	8 information.
274	274	9 (d-5) Compliance with federal law; rulemaking authority.
275	275	10 The voter registration form described in this Section shall be
276	276	11 consistent with the form prescribed by the Federal Election
277	277	12 Commission under the National Voter Registration Act of 1993,
278	278	13 P.L. 103-31, as amended from time to time, and the Help America
279	279	14 Vote Act of 2002, P.L. 107-252, in all relevant respects. The
280	280	15 State Board of Elections shall periodically update the form
281	281	16 based on changes to federal or State law. The State Board of
282	282	17 Elections shall promulgate any rules necessary for the
283	283	18 implementation of this Section; provided that the rules
284	284	19 comport with the letter and spirit of the National Voter
285	285	20 Registration Act of 1993 and Help America Vote Act of 2002 and
286	286	21 maximize the opportunity for a person to register to vote.
287	287	22 (d-10) No later than 90 days after the 2022 general
288	288	23 election, the State Board of Elections shall permit applicants
289	289	24 to choose between "male", "female", or "non-binary" when
290	290	25 designating the applicant's sex on the voter registration

2273	2273	15 "provisional ballot envelope". The election judge shall

2307	2307	13 provisional ballot, he or she shall place the marked

2309	2309	15 and seal the envelope, and return the envelope to an
2310	2310	16 election judge, who shall then deposit the sealed
2311	2311	17 provisional ballot envelope into a securable container
2312	2312	18 separately identified and utilized for containing sealed
2313	2313	19 provisional ballot envelopes. Ballots that are provisional
2314	2314	20 because they are cast after 7:00 p.m. by court order shall
2315	2315	21 be kept separate from other provisional ballots. Upon the
2316	2316	22 closing of the polls, the securable container shall be
2317	2317	23 sealed with filament tape provided for that purpose, which
2318	2318	24 shall be wrapped around the box lengthwise and crosswise,
