11	11	1 AN ACT concerning transportation.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 5. The Illinois Vehicle Code is amended by adding
15	15	5 Section 11-1433 as follows:
16	16	6 (625 ILCS 5/11-1433 new)
17	17	7 Sec. 11-1433. Third-party delivery service; zero-emission
18	18	8 deliveries.
19	19	9 (a) As used in this Section, "third-party delivery
20	20	10 service" has the meaning given to that term under the Fair Food
21	21	11 and Retail Delivery Act.
22	22	12 (b) A contractor or person employed to deliver goods from
23	23	13 a store or restaurant through a third-party delivery service
24	24	14 shall use a non-carbon emitting mode of transportation while
25	25	15 making such deliveries.
26	26	16 (c) A contractor or person that violates this Section may
27	27	17 be subject to a fine of $250 or suspension of the contractor's
28	28	18 or person's driver's license.
29	29	19 (d) This Section shall only apply to counties with a
30	30	20 population of 3,000,000 or more.
31	31	21 (e) A home rule municipality may not regulate deliveries
32	32	22 pertaining to third-party delivery services in a manner
33	33	23 inconsistent with this Section. This Section is a limitation
