11 103RD GENERAL ASSEMBLY State of Illinois 2023 and 2024 HB4199 Introduced , by Rep. Mary E. Flowers SYNOPSIS AS INTRODUCED: 305 ILCS 5/12-4.13e new Amends the Administration Article of the Illinois Public Aid Code. Provides that notwithstanding any other law or rule to the contrary and subject to federal approval, when calculating a household unit's monthly earned income for purposes of determining eligibility for Supplemental Nutrition Assistance Program (SNAP) benefits, the Department of Human Services shall only consider the household unit's monthly after-tax income, as defined. Requires the Department to also disregard any change in a household unit's monthly earned income due to any minimum wage increase implemented on or after January 1, 2023 in accordance with any State law or county or municipal ordinance. Requires the Department to apply for any federal approvals required to implement the provisions of the amendatory Act. Permits the Department to adopt any rules necessary to implement the provisions of the amendatory Act. 1111 1 AN ACT concerning public aid.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Illinois Public Aid Code is amended by
1515 5 adding Section 12-4.13e as follows:
1616 6 (305 ILCS 5/12-4.13e new)
1717 7 Sec. 12-4.13e. After-tax income eligibility standard;
1818 8 SNAP. Notwithstanding any other law or rule to the contrary
1919 9 and subject to federal approval, when calculating a household
2020 10 unit's monthly earned income for purposes of determining
2121 11 eligibility for Supplemental Nutrition Assistance Program
2222 12 (SNAP) benefits, the Department of Human Services shall only
2323 13 consider the household unit's monthly after-tax income. As
2424 14 used in this Section, "after-tax income" means the net amount
2525 15 of earned income available after all applicable deductions
2626 16 against the income, including deductions for federal and State
2727 17 income taxes attributable to the income, are taken. In
2828 18 addition, the Department shall disregard any change in a
2929 19 household unit's monthly earned income due to any minimum wage
3030 20 increase implemented on or after January 1, 2023 in accordance
3131 21 with any State law or county or municipal ordinance. The
3232 22 Department shall apply for any federal approvals required to
3333 23 implement the provisions of this Section. The Department may
