11	11	1 AN ACT concerning education.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 5. The School Code is amended by changing Section
15	15	5 21B-20 as follows:

18	18	8 Sec. 21B-20. Types of licenses. The State Board of
19	19	9 Education shall implement a system of educator licensure,
20	20	10 whereby individuals employed in school districts who are
21	21	11 required to be licensed must have one of the following
22	22	12 licenses: (i) a professional educator license; (ii) an
23	23	13 educator license with stipulations; (iii) a substitute
24	24	14 teaching license; or (iv) until June 30, 2028, a short-term
25	25	15 substitute teaching license. References in law regarding
26	26	16 individuals certified or certificated or required to be
27	27	17 certified or certificated under Article 21 of this Code shall
28	28	18 also include individuals licensed or required to be licensed
29	29	19 under this Article. The first year of all licenses ends on June
30	30	20 30 following one full year of the license being issued.
31	31	21 The State Board of Education, in consultation with the
32	32	22 State Educator Preparation and Licensure Board, may adopt such
33	33	23 rules as may be necessary to govern the requirements for

69	69	2 (1) Professional Educator License. Persons who (i)
70	70	3 have successfully completed an approved educator
71	71	4 preparation program and are recommended for licensure by
72	72	5 the Illinois institution offering the educator preparation
73	73	6 program, (ii) have successfully completed the required
74	74	7 testing under Section 21B-30 of this Code, (iii) have
75	75	8 successfully completed coursework on the psychology of,
76	76	9 the identification of, and the methods of instruction for
77	77	10 the exceptional child, including, without limitation,
78	78	11 children with learning disabilities, (iv) have
79	79	12 successfully completed coursework in methods of reading
80	80	13 and reading in the content area, and (v) have met all other
81	81	14 criteria established by rule of the State Board of
82	82	15 Education shall be issued a Professional Educator License.
83	83	16 All Professional Educator Licenses are valid until June 30
84	84	17 immediately following 5 years of the license being issued.
85	85	18 The Professional Educator License shall be endorsed with
86	86	19 specific areas and grade levels in which the individual is
87	87	20 eligible to practice. For an early childhood education
88	88	21 endorsement, an individual may satisfy the student
89	89	22 teaching requirement of his or her early childhood teacher
90	90	23 preparation program through placement in a setting with
91	91	24 children from birth through grade 2, and the individual
92	92	25 may be paid and receive credit while student teaching. The
93	93	26 student teaching experience must meet the requirements of

104	104	1 and be approved by the individual's early childhood
105	105	2 teacher preparation program.
106	106	3 Individuals can receive subsequent endorsements on the
107	107	4 Professional Educator License. Subsequent endorsements
108	108	5 shall require a minimum of 24 semester hours of coursework
109	109	6 in the endorsement area and passage of the applicable
110	110	7 content area test, unless otherwise specified by rule.
111	111	8 (2) Educator License with Stipulations. An Educator
112	112	9 License with Stipulations shall be issued an endorsement
113	113	10 that limits the license holder to one particular position
114	114	11 or does not require completion of an approved educator
115	115	12 program or both.
116	116	13 An individual with an Educator License with
117	117	14 Stipulations must not be employed by a school district or
118	118	15 any other entity to replace any presently employed teacher
119	119	16 who otherwise would not be replaced for any reason.
120	120	17 An Educator License with Stipulations may be issued
121	121	18 with the following endorsements:
122	122	19 (A) (Blank).
123	123	20 (B) Alternative provisional educator. An
124	124	21 alternative provisional educator endorsement on an
125	125	22 Educator License with Stipulations may be issued to an
126	126	23 applicant who, at the time of applying for the
127	127	24 endorsement, has done all of the following:
128	128	25 (i) Graduated from a regionally accredited

141	141	2 (ii) Successfully completed the first phase of
142	142	3 the Alternative Educator Licensure Program for
143	143	4 Teachers, as described in Section 21B-50 of this
144	144	5 Code.
145	145	6 (iii) Passed a content area test, as required
146	146	7 under Section 21B-30 of this Code.
147	147	8 The alternative provisional educator endorsement is
148	148	9 valid for 2 years of teaching and may be renewed for a
149	149	10 third year by an individual meeting the requirements set
150	150	11 forth in Section 21B-50 of this Code.
151	151	12 (C) Alternative provisional superintendent. An
152	152	13 alternative provisional superintendent endorsement on
153	153	14 an Educator License with Stipulations entitles the
154	154	15 holder to serve only as a superintendent or assistant
155	155	16 superintendent in a school district's central office.
156	156	17 This endorsement may only be issued to an applicant
157	157	18 who, at the time of applying for the endorsement, has
158	158	19 done all of the following:
159	159	20 (i) Graduated from a regionally accredited
160	160	21 college or university with a minimum of a master's
161	161	22 degree in a management field other than education.
162	162	23 (ii) Been employed for a period of at least 5
163	163	24 years in a management level position in a field
164	164	25 other than education.
165	165	26 (iii) Successfully completed the first phase

181	181	6 The endorsement is valid for 2 fiscal years in
182	182	7 order to complete one full year of serving as a
183	183	8 superintendent or assistant superintendent.
184	184	9 (D) (Blank).
185	185	10 (E) Career and technical educator. A career and
186	186	11 technical educator endorsement on an Educator License
187	187	12 with Stipulations may be issued to an applicant who
188	188	13 has a minimum of 60 semester hours of coursework from a
189	189	14 regionally accredited institution of higher education
190	190	15 or an accredited trade and technical institution and
191	191	16 has a minimum of 2,000 hours of experience outside of
192	192	17 education in each area to be taught.
193	193	18 The career and technical educator endorsement on
194	194	19 an Educator License with Stipulations is valid until
195	195	20 June 30 immediately following 5 years of the
196	196	21 endorsement being issued and may be renewed.
197	197	22 An individual who holds a valid career and
198	198	23 technical educator endorsement on an Educator License
199	199	24 with Stipulations but does not hold a bachelor's
200	200	25 degree may substitute teach in career and technical
201	201	26 education classrooms.

213	213	2 (G) Transitional bilingual educator. A
214	214	3 transitional bilingual educator endorsement on an
215	215	4 Educator License with Stipulations may be issued for
216	216	5 the purpose of providing instruction in accordance
217	217	6 with Article 14C of this Code to an applicant who
218	218	7 provides satisfactory evidence that he or she meets
219	219	8 all of the following requirements:
220	220	9 (i) Possesses adequate speaking, reading, and
221	221	10 writing ability in the language other than English
222	222	11 in which transitional bilingual education is
223	223	12 offered.
224	224	13 (ii) Has the ability to successfully
225	225	14 communicate in English.
226	226	15 (iii) Either possessed, within 5 years
227	227	16 previous to his or her applying for a transitional
228	228	17 bilingual educator endorsement, a valid and
229	229	18 comparable teaching certificate or comparable
230	230	19 authorization issued by a foreign country or holds
231	231	20 a degree from an institution of higher learning in
232	232	21 a foreign country that the State Educator
233	233	22 Preparation and Licensure Board determines to be
234	234	23 the equivalent of a bachelor's degree from a
235	235	24 regionally accredited institution of higher
236	236	25 learning in the United States.
237	237	26 A transitional bilingual educator endorsement

249	249	2 is valid until June 30 immediately following 5 years
250	250	3 of the endorsement being issued, and shall not be
251	251	4 renewed.
252	252	5 Persons holding a transitional bilingual educator
253	253	6 endorsement shall not be employed to replace any
254	254	7 presently employed teacher who otherwise would not be
255	255	8 replaced for any reason.
256	256	9 (H) Language endorsement. In an effort to
257	257	10 alleviate the shortage of teachers speaking a language
258	258	11 other than English in the public schools, an
259	259	12 individual who holds an Educator License with
260	260	13 Stipulations may also apply for a language
261	261	14 endorsement, provided that the applicant provides
262	262	15 satisfactory evidence that he or she meets all of the
263	263	16 following requirements:
264	264	17 (i) Holds a transitional bilingual
265	265	18 endorsement.
266	266	19 (ii) Has demonstrated proficiency in the
267	267	20 language for which the endorsement is to be issued
268	268	21 by passing the applicable language content test
269	269	22 required by the State Board of Education.
270	270	23 (iii) Holds a bachelor's degree or higher from
271	271	24 a regionally accredited institution of higher
272	272	25 education or, for individuals educated in a
273	273	26 country other than the United States, holds a

287	287	4 the equivalent of a bachelor's degree from a

290	290	7 (iv) (Blank).
291	291	8 A language endorsement on an Educator License with
292	292	9 Stipulations is valid for prekindergarten through
293	293	10 grade 12 for the same validity period as the
294	294	11 individual's transitional bilingual educator
295	295	12 endorsement on the Educator License with Stipulations
296	296	13 and shall not be renewed.
297	297	14 (I) Visiting international educator. A visiting
298	298	15 international educator endorsement on an Educator
299	299	16 License with Stipulations may be issued to an
300	300	17 individual who is being recruited by a particular
301	301	18 school district that conducts formal recruitment
302	302	19 programs outside of the United States to secure the
303	303	20 services of qualified teachers and who meets all of
304	304	21 the following requirements:
305	305	22 (i) Holds the equivalent of a minimum of a
306	306	23 bachelor's degree issued in the United States.
307	307	24 (ii) Has been prepared as a teacher at the
308	308	25 grade level for which he or she will be employed.
309	309	26 (iii) Has adequate content knowledge in the

325	325	6 shall be permitted to teach in bilingual education
326	326	7 programs in the language that was the medium of
327	327	8 instruction in his or her teacher preparation program,
328	328	9 provided that he or she passes the English Language
329	329	10 Proficiency Examination or another test of writing
330	330	11 skills in English identified by the State Board of
331	331	12 Education, in consultation with the State Educator
332	332	13 Preparation and Licensure Board.
333	333	14 A visiting international educator endorsement on
334	334	15 an Educator License with Stipulations is valid for 5
335	335	16 years and shall not be renewed.
336	336	17 (J) Paraprofessional educator. A paraprofessional
337	337	18 educator endorsement on an Educator License with
338	338	19 Stipulations may be issued to an applicant who holds a
339	339	20 high school diploma or its recognized equivalent and
340	340	21 (i) holds an associate's degree or a minimum of 60
341	341	22 semester hours of credit from a regionally accredited
342	342	23 institution of higher education; (ii) has passed a
343	343	24 paraprofessional competency test under subsection
344	344	25 (c-5) of Section 21B-30; or (iii) is at least 18 years
345	345	26 of age and will be using the Educator License with

356	356	1 Stipulations exclusively for grades prekindergarten
357	357	2 through grade 8, until the individual reaches the age
358	358	3 of 19 years and otherwise meets the criteria for a
359	359	4 paraprofessional educator endorsement pursuant to this
360	360	5 subparagraph (J). The paraprofessional educator
361	361	6 endorsement is valid until June 30 immediately
362	362	7 following 5 years of the endorsement being issued and
363	363	8 may be renewed through application and payment of the
364	364	9 appropriate fee, as required under Section 21B-40 of
365	365	10 this Code. An individual who holds only a
366	366	11 paraprofessional educator endorsement is not subject
367	367	12 to additional requirements in order to renew the
368	368	13 endorsement.
369	369	14 (K) Chief school business official. A chief school
370	370	15 business official endorsement on an Educator License
371	371	16 with Stipulations may be issued to an applicant who
372	372	17 qualifies by having a master's degree or higher, 2
373	373	18 years of full-time administrative experience in school
374	374	19 business management or 2 years of university-approved
375	375	20 practical experience, and a minimum of 24 semester
376	376	21 hours of graduate credit in a program approved by the
377	377	22 State Board of Education for the preparation of school
378	378	23 business administrators and by passage of the
379	379	24 applicable State tests, including an applicable
380	380	25 content area test.
381	381	26 The chief school business official endorsement may

394	394	3 master's degree in business administration, finance,
395	395	4 accounting, or public administration and who completes
396	396	5 an additional 6 semester hours of internship in school

398	398	7 institution of higher education and passes the
399	399	8 applicable State tests, including an applicable
400	400	9 content area test. This endorsement shall be required
401	401	10 for any individual employed as a chief school business

403	403	12 The chief school business official endorsement on
404	404	13 an Educator License with Stipulations is valid until
405	405	14 June 30 immediately following 5 years of the
406	406	15 endorsement being issued and may be renewed if the
407	407	16 license holder completes renewal requirements as
408	408	17 required for individuals who hold a Professional
409	409	18 Educator License endorsed for chief school business
410	410	19 official under Section 21B-45 of this Code and such
411	411	20 rules as may be adopted by the State Board of
412	412	21 Education.
413	413	22 The State Board of Education shall adopt any rules
414	414	23 necessary to implement Public Act 100-288.
415	415	24 (L) Provisional in-state educator. A provisional
416	416	25 in-state educator endorsement on an Educator License
417	417	26 with Stipulations may be issued to a candidate who has

429	429	2 program at an Illinois institution of higher education
430	430	3 and who has not successfully completed an
431	431	4 evidence-based assessment of teacher effectiveness but
432	432	5 who meets all of the following requirements:
433	433	6 (i) Holds at least a bachelor's degree.
434	434	7 (ii) Has completed an approved educator
435	435	8 preparation program at an Illinois institution.
436	436	9 (iii) Has passed an applicable content area
437	437	10 test, as required by Section 21B-30 of this Code.
438	438	11 (iv) Has attempted an evidence-based
439	439	12 assessment of teacher effectiveness and received a
440	440	13 minimum score on that assessment, as established
441	441	14 by the State Board of Education in consultation
442	442	15 with the State Educator Preparation and Licensure
443	443	16 Board.
444	444	17 A provisional in-state educator endorsement on an
445	445	18 Educator License with Stipulations is valid for one
446	446	19 full fiscal year after the date of issuance and may not
447	447	20 be renewed.
448	448	21 (M) (Blank).
449	449	22 (N) Specialized services. A specialized services
450	450	23 endorsement on an Educator License with Stipulations
451	451	24 may be issued as defined and specified by rule.
452	452	25 (3) Substitute Teaching License. A Substitute Teaching
453	453	26 License may be issued to qualified applicants for

464	464	1 substitute teaching in all grades of the public schools,
465	465	2 prekindergarten through grade 12. Substitute Teaching
466	466	3 Licenses are not eligible for endorsements. Applicants for
467	467	4 a Substitute Teaching License must hold a bachelor's
468	468	5 degree or higher from a regionally accredited institution
469	469	6 of higher education or must be enrolled in an approved
470	470	7 educator preparation program in this State and have earned
471	471	8 at least 90 credit hours.
472	472	9 Substitute Teaching Licenses are valid for 5 years.
473	473	10 Substitute Teaching Licenses are valid for substitute
474	474	11 teaching in every county of this State. If an individual
475	475	12 has had his or her Professional Educator License or
476	476	13 Educator License with Stipulations suspended or revoked,
477	477	14 then that individual is not eligible to obtain a
478	478	15 Substitute Teaching License.
479	479	16 A substitute teacher may only teach in the place of a
480	480	17 licensed teacher who is under contract with the employing
481	481	18 board. If, however, there is no licensed teacher under
482	482	19 contract because of an emergency situation, then a
483	483	20 district may employ a substitute teacher for no longer
484	484	21 than 30 calendar days per each vacant position in the
485	485	22 district if the district notifies the appropriate regional
486	486	23 office of education within 5 business days after the
487	487	24 employment of the substitute teacher in the emergency
488	488	25 situation. An emergency situation is one in which an
489	489	26 unforeseen vacancy has occurred and (i) a teacher is

500	500	1 unable to fulfill his or her contractual duties or (ii)
501	501	2 teacher capacity needs of the district exceed previous
502	502	3 indications, and the district is actively engaged in
503	503	4 advertising to hire a fully licensed teacher for the
504	504	5 vacant position.
505	505	6 There is no limit on the number of days that a
506	506	7 substitute teacher may teach in a single school district,
507	507	8 provided that no substitute teacher may teach for longer
508	508	9 than 120 days beginning with the 2021-2022 school year
509	509	10 through the 2022-2023 school year, otherwise 90 school

614	614	8 preparation program and are recommended for licensure by
615	615	9 the Illinois institution offering the educator preparation
616	616	10 program, (ii) have successfully completed the required
617	617	11 testing under Section 21B-30 of this Code, (iii) have
618	618	12 successfully completed coursework on the psychology of,
619	619	13 the identification of, and the methods of instruction for
620	620	14 the exceptional child, including, without limitation,
621	621	15 children with learning disabilities, (iv) have
622	622	16 successfully completed coursework in methods of reading

649	649	7 Individuals can receive subsequent endorsements on the
650	650	8 Professional Educator License. Subsequent endorsements
651	651	9 shall require a minimum of 24 semester hours of coursework
652	652	10 in the endorsement area and passage of the applicable
653	653	11 content area test, unless otherwise specified by rule.
654	654	12 (2) Educator License with Stipulations. An Educator
655	655	13 License with Stipulations shall be issued an endorsement
656	656	14 that limits the license holder to one particular position
657	657	15 or does not require completion of an approved educator
658	658	16 program or both.
659	659	17 An individual with an Educator License with
660	660	18 Stipulations must not be employed by a school district or
661	661	19 any other entity to replace any presently employed teacher
662	662	20 who otherwise would not be replaced for any reason.
663	663	21 An Educator License with Stipulations may be issued
664	664	22 with the following endorsements:

800	800	14 alleviate the shortage of teachers speaking a language
801	801	15 other than English in the public schools, an

803	803	17 Stipulations may also apply for a language
804	804	18 endorsement, provided that the applicant provides
805	805	19 satisfactory evidence that he or she meets all of the
806	806	20 following requirements:
807	807	21 (i) Holds a transitional bilingual
808	808	22 endorsement.
809	809	23 (ii) Has demonstrated proficiency in the
810	810	24 language for which the endorsement is to be issued

1054	1054	16 granted in writing by the regional office of education. An
1055	1055	17 emergency situation is one in which an unforeseen vacancy
1056	1056	18 has occurred and (i) a teacher is unexpectedly unable to
1057	1057	19 fulfill his or her contractual duties or (ii) teacher
1058	1058	20 capacity needs of the district exceed previous indications
1059	1059	21 or vacancies are unfilled due to a lack of qualified
1060	1060	22 candidates, and the district is actively engaged in
1061	1061	23 advertising to hire a fully licensed teacher for the
1062	1062	24 vacant position.

1088	1088	14 holds a valid Professional Educator License or Educator
1089	1089	15 License with Stipulations to seek or hold a Substitute
1090	1090	16 Teaching License to teach as a substitute teacher.
1091	1091	17 (4) Short-Term Substitute Teaching License. Beginning
1092	1092	18 on July 1, 2018 and until June 30, 2028, applicants may
1093	1093	19 apply to the State Board of Education for issuance of a
1094	1094	20 Short-Term Substitute Teaching License. A Short-Term
1095	1095	21 Substitute Teaching License may be issued to a qualified
1096	1096	22 applicant for substitute teaching in all grades of the
1097	1097	23 public schools, prekindergarten through grade 12.
1098	1098	24 Short-Term Substitute Teaching Licenses are not eligible
1099	1099	25 for endorsements. Applicants for a Short-Term Substitute
1100	1100	26 Teaching License must hold an associate's degree or have

1115	1115	5 Short-Term Substitute Teaching Licenses are valid for
1116	1116	6 substitute teaching in every county of this State. If an
1117	1117	7 individual has had his or her Professional Educator
1118	1118	8 License or Educator License with Stipulations suspended or
1119	1119	9 revoked, then that individual is not eligible to obtain a
1120	1120	10 Short-Term Substitute Teaching License.
1121	1121	11 The provisions of Sections 10-21.9 and 34-18.5 of this
1122	1122	12 Code apply to short-term substitute teachers.
1123	1123	13 An individual holding a Short-Term Substitute Teaching
1124	1124	14 License may teach no more than 15 consecutive days per
1125	1125	15 licensed teacher who is under contract. For teacher
1126	1126	16 absences lasting 6 or more days per licensed teacher who
1127	1127	17 is under contract, a school district may not hire an
1128	1128	18 individual holding a Short-Term Substitute Teaching
1129	1129	19 License, unless the Governor has declared a disaster due
1130	1130	20 to a public health emergency pursuant to Section 7 of the
1131	1131	21 Illinois Emergency Management Agency Act. An individual
1132	1132	22 holding a Short-Term Substitute Teaching License must
1133	1133	23 complete the training program under Section 10-20.67 or
1134	1134	24 34-18.60 of this Code to be eligible to teach at a public
1135	1135	25 school. Short-Term Substitute Teaching Licenses Short-term
