1111 1 AN ACT concerning government.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Freedom of Information Act is amended by
1515 5 changing Sections 2, 3, 3.1, 3.2, 3.6, 6, and 7 as follows:

1818 8 Sec. 2. Definitions. As used in this Act:
1919 9 (a) "Public body" means all legislative, executive,
2020 10 administrative, or advisory bodies of the State, state
2121 11 universities and colleges, counties, townships, cities,
2222 12 villages, incorporated towns, school districts and all other
2323 13 municipal corporations, boards, bureaus, committees, or
2424 14 commissions of this State, any subsidiary bodies of any of the
2525 15 foregoing including but not limited to committees and
2626 16 subcommittees thereof, and a School Finance Authority created
2727 17 under Article 1E of the School Code. "Public body" does not
2828 18 include a child death review team or the Illinois Child Death
2929 19 Review Teams Executive Council established under the Child
3030 20 Death Review Team Act, or a regional youth advisory board or
3131 21 the Statewide Youth Advisory Board established under the
3232 22 Department of Children and Family Services Statewide Youth

6868 1 (b) "Person" means any individual, corporation,
6969 2 partnership, firm, organization or association, acting
7070 3 individually or as a group.
7171 4 (c) "Public records" means all records, reports, forms,
7272 5 writings, letters, memoranda, books, papers, maps,
7373 6 photographs, microfilms, cards, tapes, recordings, electronic
7474 7 data processing records, electronic communications, recorded
7575 8 information and all other documentary materials pertaining to
7676 9 the transaction of public business, regardless of physical
7777 10 form or characteristics, having been prepared by or for, or
7878 11 having been or being used by, received by, in the possession
7979 12 of, or under the control of any public body.
8080 13 (c-5) "Private information" means unique identifiers,
8181 14 including a person's social security number, driver's license
8282 15 number, employee identification number, biometric identifiers,
8383 16 personal financial information, passwords or other access
8484 17 codes, medical records, home or personal telephone numbers,
8585 18 and personal email addresses. Private information also
8686 19 includes home address and personal license plates, except as
8787 20 otherwise provided by law or when compiled without possibility
8888 21 of attribution to any person.
8989 22 (c-10) "Commercial purpose" means the use of any part of a
9090 23 public record or records, or information derived from public
9191 24 records, in any form for sale, resale, or solicitation or
9292 25 advertisement for sales or services. For purposes of this

111111 8 (d) "Copying" means the reproduction of any public record
112112 9 by means of any photographic, electronic, mechanical or other
113113 10 process, device or means now known or hereafter developed and
114114 11 available to the public body.
115115 12 (e) "Head of the public body" means the president, mayor,
116116 13 chairman, presiding officer, director, superintendent,
117117 14 manager, supervisor or individual otherwise holding primary
118118 15 executive and administrative authority for the public body, or
119119 16 such person's duly authorized designee.
120120 17 (f) "News media" means a newspaper or other periodical
121121 18 issued at regular intervals whether in print or electronic
122122 19 format, a news service whether in print or electronic format,
123123 20 a radio station, a television station, a television network, a
124124 21 community antenna television service, or a person or
125125 22 corporation engaged in making news reels or other motion
126126 23 picture news for public showing.
127127 24 (g) "Recurrent requester", as used in Section 3.2 of this
128128 25 Act, means a person that, in the 12 months immediately

140140 1 (i) a minimum of 50 requests for records, (ii) a minimum of 15
141141 2 requests for records within a 30-day period, or (iii) a

154154 15 to honor oral requests) that is submitted to a public body via
155155 16 personal delivery, mail, telefax, electronic mail, or other
156156 17 means available to the public body and that identifies the
157157 18 particular public record the requester seeks. One request may
158158 19 identify multiple records to be inspected or copied.
159159 20 (h) "Voluminous request" means a request that: (i)
160160 21 includes more than 5 individual requests for more than 5
161161 22 different categories of records or a combination of individual
162162 23 requests that total requests for more than 5 different
163163 24 categories of records in a period of 20 business days; or (ii)
164164 25 requires the compilation of more than 500 letter or
165165 26 legal-sized pages of public records unless a single requested

262262 16 privacy laws and regulations, including, but not limited to,
263263 17 the Health Insurance Portability and Accountability Act and
264264 18 its regulations, 45 CFR Parts 160 and 164. As used in this
265265 19 subsection, "HIPAA-covered entity" has the meaning given to
266266 20 the term "covered entity" in 45 CFR 160.103.
267267 21 (c-10) "Commercial purpose" means the use of any part of a
268268 22 public record or records, or information derived from public
269269 23 records, in any form for sale, resale, or solicitation, for or
270270 24 advertisement for sales or services, or for solicitation of

390390 1 otherwise provided in Sections 7 and 8.5 of this Act.
391391 2 Notwithstanding any other law, a public body may not grant to
392392 3 any person or entity, whether by contract, license, or
393393 4 otherwise, the exclusive right to access and disseminate any
394394 5 public record as defined in this Act.
395395 6 (b) Subject to the fee provisions of Section 6 of this Act,
396396 7 each public body shall promptly provide, to any person who
397397 8 submits a request, a copy of any public record required to be
398398 9 disclosed by subsection (a) of this Section and shall certify
399399 10 such copy if so requested.
400400 11 (c) Requests for inspection or copies shall be made in
401401 12 writing and directed to the public body. Written requests may
402402 13 be submitted to a public body via personal delivery, mail,
403403 14 telefax, or other means available to the public body. A public
404404 15 body may honor oral requests for inspection or copying. A
405405 16 public body may not require that a request be submitted on a
406406 17 standard form or require the requester to specify the purpose
407407 18 for a request, except to determine whether the records are
408408 19 requested for a commercial purpose or whether to grant a
409409 20 request for a fee waiver. All requests for inspection and
410410 21 copying received by a public body shall immediately be
411411 22 forwarded to its Freedom of Information officer or designee.
412412 23 (d) Each public body shall, promptly, either comply with
413413 24 or deny a request for public records within 5 business days
414414 25 after its receipt of the request, unless the time for response

435435 10 the request as unduly burdensome under subsection (g).
436436 11 (e) The time for response under this Section may be
437437 12 extended by the public body for not more than 7 5 business days
438438 13 from the original due date for any of the following reasons:
439439 14 (i) the requested records are stored in whole or in
440440 15 part at other locations than the office having charge of
441441 16 the requested records;
442442 17 (ii) the request requires the collection of a
443443 18 substantial number of specified records;
444444 19 (iii) the request is couched in categorical terms and
445445 20 requires an extensive search for the records responsive to
446446 21 it;
447447 22 (iv) the requested records have not been located in
448448 23 the course of routine search and additional efforts are
449449 24 being made to locate them;

467467 6 subsection (d) of this Section without unduly burdening or
468468 7 interfering with the operations of the public body;
469469 8 (vii) there is a need for consultation, which shall be
470470 9 conducted with all practicable speed, with another public
471471 10 body or among 2 or more components of a public body having
472472 11 a substantial interest in the determination or in the
473473 12 subject matter of the request.
474474 13 The person making a request and the public body may agree
475475 14 in writing to extend the time for compliance for a period to be
476476 15 determined by the parties. If the requester and the public
477477 16 body agree to extend the period for compliance, a failure by
478478 17 the public body to comply with any previous deadlines shall
479479 18 not be treated as a denial of the request for the records.
480480 19 (f) When additional time is required for any of the above
481481 20 reasons, the public body shall, within 7 5 business days after
482482 21 receipt of the request, notify the person making the request
483483 22 of the reasons for the extension and the date by which the
484484 23 response will be forthcoming. Failure to respond within the
485485 24 time permitted for extension shall be considered a denial of

512512 15 categorical request by stating that compliance would unduly
513513 16 burden its operation and the conditions described above are
514514 17 met, it shall do so in writing, specifying the reasons why it
515515 18 would be unduly burdensome and the extent to which compliance
516516 19 will so burden the operations of the public body. Such a
517517 20 response shall be treated as a denial of the request for
518518 21 information.
519519 22 Repeated requests from the same person for the same
520520 23 records that are unchanged or identical to records previously
521521 24 provided or properly denied under this Act shall be deemed
522522 25 unduly burdensome under this provision.

646646 7 request as a voluminous request; (ii) the reasons why the
647647 8 public body is treating the request as a voluminous request;

650650 11 sent and specify whether the requester would like to amend the

656656 17 request and assess any fees the public body charges pursuant
657657 18 to Section 6 of this Act; (v) that the public body has 5
658658 19 business days after receipt of the requester's response or 5
659659 20 business days from the last day for the requester to amend his
660660 21 or her request, whichever is sooner, to respond to the
661661 22 request; (vi) that the public body may request an additional
662662 23 10 business days to comply with the request; (vii) of the
663663 24 requester's right to review of the public body's determination

687687 13 (c) If a request continues to be a voluminous request
688688 14 following the requester's response under subsection (b) of
689689 15 this Section or the requester fails to respond, the public
690690 16 body shall respond within the earlier of 5 business days after
691691 17 it receives the response from the requester or 5 business days
692692 18 after the final day for the requester to respond to the public
693693 19 body's notification under this subsection. The response shall:
694694 20 (i) provide an estimate of the fees to be charged, which the
695695 21 public body may require the person to pay in full before
696696 22 copying the requested documents; (ii) deny the request
697697 23 pursuant to one or more of the exemptions set out in this Act;
698698 24 (iii) notify the requester that the request is unduly

726726 16 the public body. If a requester does not pay a fee charged
727727 17 pursuant to Section 6 of this Act for a voluminous request, the
728728 18 debt shall be considered a debt due and owing to the public
729729 19 body and may be collected in accordance with applicable law.

751751 6 furnish it in the format in which it is maintained by the
752752 7 public body, or in paper format at the option of the requester.
753753 8 A public body may charge the requester for the actual cost of
754754 9 purchasing the recording medium, whether disc, diskette, tape,
755755 10 or other medium. If a request is not a request for a commercial
756756 11 purpose or a voluminous request, a public body may not charge
757757 12 the requester for the costs of any search for and review of the
758758 13 records or other personnel costs associated with reproducing
759759 14 the records. Except to the extent that the General Assembly
760760 15 expressly provides, statutory fees applicable to copies of
761761 16 public records when furnished in a paper format shall not be

764764 19 (a-5) If a voluminous request is for electronic records
765765 20 and those records are not in a portable document format (PDF),
766766 21 the public body may charge up to $20 for not more than 2

793793 12 public body may charge fees reasonably calculated to reimburse
794794 13 its actual cost for reproducing and certifying public records
795795 14 and for the use, by any person, of the equipment of the public
796796 15 body to copy records. No fees shall be charged for the first 50
797797 16 pages of black and white, letter or legal sized copies
798798 17 requested by a requester. The fee for black and white, letter
799799 18 or legal sized copies shall not exceed 15 cents per page. If a
800800 19 public body provides copies in color or in a size other than
801801 20 letter or legal, the public body may not charge more than its
802802 21 actual cost for reproducing the records. In calculating its
803803 22 actual cost for reproducing records or for the use of the
804804 23 equipment of the public body to reproduce records, a public
805805 24 body shall not include the costs of any search for and review

822822 5 (c) Documents shall be furnished without charge or at a
823823 6 reduced charge, as determined by the public body, if the
824824 7 person requesting the documents states the specific purpose
825825 8 for the request and indicates that a waiver or reduction of the
826826 9 fee is in the public interest. Waiver or reduction of the fee
827827 10 is in the public interest if the principal purpose of the
828828 11 request is to access and disseminate information regarding the
829829 12 health, safety and welfare or the legal rights of the general
830830 13 public and is not for the principal purpose of personal or
831831 14 commercial benefit. For purposes of this subsection,
832832 15 "commercial benefit" shall not apply to requests made by news
833833 16 media when the principal purpose of the request is to access
834834 17 and disseminate information regarding the health, safety, and
835835 18 welfare or the legal rights of the general public. In setting
836836 19 the amount of the waiver or reduction, the public body may take
837837 20 into consideration the amount of materials requested and the
838838 21 cost of copying them.
839839 22 (d) The imposition of a fee not consistent with
840840 23 subsections (6)(a) and (b) of this Act constitutes a denial of
841841 24 access to public records for the purposes of judicial review.
842842 25 (e) The fee for each abstract of a driver's record shall be

865865 12 public body imposes a fee pursuant to this subsection (f), it
866866 13 must provide the requester with an accounting of all fees,
867867 14 costs, and personnel hours in connection with the request for

898898 10 maintained by one or more law enforcement agencies and
899899 11 specifically designed to provide information to one or
900900 12 more law enforcement agencies regarding the physical or
901901 13 mental status of one or more individual subjects.
902902 14 (c) Personal information contained within public
903903 15 records, the disclosure of which would constitute a
904904 16 clearly unwarranted invasion of personal privacy, unless
905905 17 the disclosure is consented to in writing by the
906906 18 individual subjects of the information. "Unwarranted
907907 19 invasion of personal privacy" means the disclosure of
908908 20 information that is highly personal or objectionable to a
909909 21 reasonable person and in which the subject's right to
910910 22 privacy outweighs any legitimate public interest in
911911 23 obtaining the information. The disclosure of information
912912 24 that bears on the public duties of public employees and
913913 25 officials shall not be considered an invasion of personal
914914 26 privacy.
