1313 1 AN ACT concerning education.
1414 2 Be it enacted by the People of the State of Illinois,
1515 3 represented in the General Assembly:
1616 4 Section 5. The School Code is amended by changing Sections
1717 5 21B-20, 21B-30, and 21B-40 as follows:
1818 6 (105 ILCS 5/21B-20)
1919 7 Sec. 21B-20. Types of licenses. The State Board of
2020 8 Education shall implement a system of educator licensure,
2121 9 whereby individuals employed in school districts who are
2222 10 required to be licensed must have one of the following
2323 11 licenses: (i) a professional educator license; (ii) an
2424 12 educator license with stipulations; (iii) a substitute
2525 13 teaching license; or (iv) until June 30, 2028, a short-term
2626 14 substitute teaching license; or (v) a Montessori educator
2727 15 license. References in law regarding individuals certified or
2828 16 certificated or required to be certified or certificated under
2929 17 Article 21 of this Code shall also include individuals
3030 18 licensed or required to be licensed under this Article. The
3131 19 first year of all licenses ends on June 30 following one full
3232 20 year of the license being issued.
3333 21 The State Board of Education, in consultation with the
3434 22 State Educator Preparation and Licensure Board, may adopt such
3535 23 rules as may be necessary to govern the requirements for

7474 1 licenses and endorsements under this Section.
7575 2 (1) Professional Educator License. Persons who (i)
7676 3 have successfully completed an approved educator
7777 4 preparation program and are recommended for licensure by
7878 5 the Illinois institution offering the educator preparation
7979 6 program, (ii) have successfully completed the required
8080 7 testing under Section 21B-30 of this Code, (iii) have
8181 8 successfully completed coursework on the psychology of,
8282 9 the identification of, and the methods of instruction for
8383 10 the exceptional child, including, without limitation,
8484 11 children with learning disabilities, (iv) have
8585 12 successfully completed coursework in methods of reading
8686 13 and reading in the content area, and (v) have met all other
8787 14 criteria established by rule of the State Board of
8888 15 Education shall be issued a Professional Educator License.
8989 16 All Professional Educator Licenses are valid until June 30
9090 17 immediately following 5 years of the license being issued.
9191 18 The Professional Educator License shall be endorsed with
9292 19 specific areas and grade levels in which the individual is
9393 20 eligible to practice. For an early childhood education
9494 21 endorsement, an individual may satisfy the student
9595 22 teaching requirement of his or her early childhood teacher
9696 23 preparation program through placement in a setting with
9797 24 children from birth through grade 2, and the individual
9898 25 may be paid and receive credit while student teaching. The
9999 26 student teaching experience must meet the requirements of

110110 1 and be approved by the individual's early childhood
111111 2 teacher preparation program.
112112 3 Individuals can receive subsequent endorsements on the
113113 4 Professional Educator License. Subsequent endorsements
114114 5 shall require a minimum of 24 semester hours of coursework
115115 6 in the endorsement area and passage of the applicable
116116 7 content area test, unless otherwise specified by rule.
117117 8 (2) Educator License with Stipulations. An Educator
118118 9 License with Stipulations shall be issued an endorsement
119119 10 that limits the license holder to one particular position
120120 11 or does not require completion of an approved educator
121121 12 program or both.
122122 13 An individual with an Educator License with
123123 14 Stipulations must not be employed by a school district or
124124 15 any other entity to replace any presently employed teacher
125125 16 who otherwise would not be replaced for any reason.
126126 17 An Educator License with Stipulations may be issued
127127 18 with the following endorsements:
128128 19 (A) (Blank).
129129 20 (B) Alternative provisional educator. An
130130 21 alternative provisional educator endorsement on an
131131 22 Educator License with Stipulations may be issued to an
132132 23 applicant who, at the time of applying for the
133133 24 endorsement, has done all of the following:
134134 25 (i) Graduated from a regionally accredited

148148 3 the Alternative Educator Licensure Program for
149149 4 Teachers, as described in Section 21B-50 of this

151151 6 (iii) Passed a content area test, as required
152152 7 under Section 21B-30 of this Code.
153153 8 The alternative provisional educator endorsement is
154154 9 valid for 2 years of teaching and may be renewed for a
155155 10 third year by an individual meeting the requirements set
156156 11 forth in Section 21B-50 of this Code.
157157 12 (C) Alternative provisional superintendent. An
158158 13 alternative provisional superintendent endorsement on
159159 14 an Educator License with Stipulations entitles the
160160 15 holder to serve only as a superintendent or assistant
161161 16 superintendent in a school district's central office.
162162 17 This endorsement may only be issued to an applicant
163163 18 who, at the time of applying for the endorsement, has
164164 19 done all of the following:
165165 20 (i) Graduated from a regionally accredited
166166 21 college or university with a minimum of a master's
167167 22 degree in a management field other than education.
168168 23 (ii) Been employed for a period of at least 5
169169 24 years in a management level position in a field
170170 25 other than education.

191191 10 (E) Career and technical educator. A career and
192192 11 technical educator endorsement on an Educator License
193193 12 with Stipulations may be issued to an applicant who
194194 13 has a minimum of 60 semester hours of coursework from a
195195 14 regionally accredited institution of higher education
196196 15 or an accredited trade and technical institution and
197197 16 has a minimum of 2,000 hours of experience outside of
198198 17 education in each area to be taught.
199199 18 The career and technical educator endorsement on
200200 19 an Educator License with Stipulations is valid until
201201 20 June 30 immediately following 5 years of the
202202 21 endorsement being issued and may be renewed.
203203 22 An individual who holds a valid career and
204204 23 technical educator endorsement on an Educator License
205205 24 with Stipulations but does not hold a bachelor's
206206 25 degree may substitute teach in career and technical

219219 2 (G) Transitional bilingual educator. A
220220 3 transitional bilingual educator endorsement on an
221221 4 Educator License with Stipulations may be issued for
222222 5 the purpose of providing instruction in accordance
223223 6 with Article 14C of this Code to an applicant who
224224 7 provides satisfactory evidence that he or she meets
225225 8 all of the following requirements:
226226 9 (i) Possesses adequate speaking, reading, and
227227 10 writing ability in the language other than English
228228 11 in which transitional bilingual education is
229229 12 offered.
230230 13 (ii) Has the ability to successfully
231231 14 communicate in English.
232232 15 (iii) Either possessed, within 5 years
233233 16 previous to his or her applying for a transitional
234234 17 bilingual educator endorsement, a valid and
235235 18 comparable teaching certificate or comparable
236236 19 authorization issued by a foreign country or holds
237237 20 a degree from an institution of higher learning in
238238 21 a foreign country that the State Educator
239239 22 Preparation and Licensure Board determines to be
240240 23 the equivalent of a bachelor's degree from a
241241 24 regionally accredited institution of higher
242242 25 learning in the United States.
243243 26 A transitional bilingual educator endorsement

258258 5 Persons holding a transitional bilingual educator
259259 6 endorsement shall not be employed to replace any
260260 7 presently employed teacher who otherwise would not be
261261 8 replaced for any reason.
262262 9 (H) Language endorsement. In an effort to
263263 10 alleviate the shortage of teachers speaking a language
264264 11 other than English in the public schools, an
265265 12 individual who holds an Educator License with
266266 13 Stipulations may also apply for a language
267267 14 endorsement, provided that the applicant provides
268268 15 satisfactory evidence that he or she meets all of the
269269 16 following requirements:
270270 17 (i) Holds a transitional bilingual
271271 18 endorsement.
272272 19 (ii) Has demonstrated proficiency in the
273273 20 language for which the endorsement is to be issued
274274 21 by passing the applicable language content test
275275 22 required by the State Board of Education.
276276 23 (iii) Holds a bachelor's degree or higher from
277277 24 a regionally accredited institution of higher
278278 25 education or, for individuals educated in a
279279 26 country other than the United States, holds a

297297 8 A language endorsement on an Educator License with
298298 9 Stipulations is valid for prekindergarten through
299299 10 grade 12 for the same validity period as the
300300 11 individual's transitional bilingual educator
301301 12 endorsement on the Educator License with Stipulations
302302 13 and shall not be renewed.
303303 14 (I) Visiting international educator. A visiting
304304 15 international educator endorsement on an Educator
305305 16 License with Stipulations may be issued to an
306306 17 individual who is being recruited by a particular
307307 18 school district that conducts formal recruitment
308308 19 programs outside of the United States to secure the
309309 20 services of qualified teachers and who meets all of
310310 21 the following requirements:
311311 22 (i) Holds the equivalent of a minimum of a
312312 23 bachelor's degree issued in the United States.
313313 24 (ii) Has been prepared as a teacher at the
314314 25 grade level for which he or she will be employed.
315315 26 (iii) Has adequate content knowledge in the

344344 19 Stipulations may be issued to an applicant who holds a
345345 20 high school diploma or its recognized equivalent and
346346 21 (i) holds an associate's degree or a minimum of 60
347347 22 semester hours of credit from a regionally accredited
348348 23 institution of higher education; (ii) has passed a
349349 24 paraprofessional competency test under subsection
350350 25 (c-5) of Section 21B-30; or (iii) is at least 18 years

362362 1 Stipulations exclusively for grades prekindergarten
363363 2 through grade 8, until the individual reaches the age
364364 3 of 19 years and otherwise meets the criteria for a
365365 4 paraprofessional educator endorsement pursuant to this
366366 5 subparagraph (J). The paraprofessional educator
367367 6 endorsement is valid until June 30 immediately
368368 7 following 5 years of the endorsement being issued and
369369 8 may be renewed through application and payment of the
370370 9 appropriate fee, as required under Section 21B-40 of
371371 10 this Code. An individual who holds only a
372372 11 paraprofessional educator endorsement is not subject
373373 12 to additional requirements in order to renew the
374374 13 endorsement.
375375 14 (K) Chief school business official. A chief school
376376 15 business official endorsement on an Educator License
377377 16 with Stipulations may be issued to an applicant who
378378 17 qualifies by having a master's degree or higher, 2
379379 18 years of full-time administrative experience in school
380380 19 business management or 2 years of university-approved
381381 20 practical experience, and a minimum of 24 semester
382382 21 hours of graduate credit in a program approved by the
383383 22 State Board of Education for the preparation of school
384384 23 business administrators and by passage of the
385385 24 applicable State tests, including an applicable
386386 25 content area test.
387387 26 The chief school business official endorsement may

412412 15 endorsement being issued and may be renewed if the
413413 16 license holder completes renewal requirements as
414414 17 required for individuals who hold a Professional
415415 18 Educator License endorsed for chief school business
416416 19 official under Section 21B-45 of this Code and such
417417 20 rules as may be adopted by the State Board of
418418 21 Education.
419419 22 The State Board of Education shall adopt any rules
420420 23 necessary to implement Public Act 100-288.
421421 24 (L) Provisional in-state educator. A provisional
422422 25 in-state educator endorsement on an Educator License
423423 26 with Stipulations may be issued to a candidate who has

439439 6 (i) Holds at least a bachelor's degree.
440440 7 (ii) Has completed an approved educator
441441 8 preparation program at an Illinois institution.
442442 9 (iii) Has passed an applicable content area
443443 10 test, as required by Section 21B-30 of this Code.
444444 11 (iv) Has attempted an evidence-based
445445 12 assessment of teacher effectiveness and received a
446446 13 minimum score on that assessment, as established
447447 14 by the State Board of Education in consultation
448448 15 with the State Educator Preparation and Licensure
449449 16 Board.
450450 17 A provisional in-state educator endorsement on an
451451 18 Educator License with Stipulations is valid for one
452452 19 full fiscal year after the date of issuance and may not
453453 20 be renewed.
454454 21 (M) (Blank).
455455 22 (N) Specialized services. A specialized services
456456 23 endorsement on an Educator License with Stipulations
457457 24 may be issued as defined and specified by rule.
458458 25 (O) Provisional career and technical educator. A

471471 2 to an applicant who has a minimum of 8,000 hours of
472472 3 work experience in the skill for which the applicant
473473 4 is seeking the endorsement. Each employing school
474474 5 board and regional office of education shall provide
475475 6 verification, in writing, to the State Superintendent
476476 7 of Education at the time the application is submitted
477477 8 that no qualified teacher holding a Professional
478478 9 Educator License or an Educator License with
479479 10 Stipulations with a career and technical educator
480480 11 endorsement is available to teach and that actual
481481 12 circumstances require such issuance.
482482 13 A provisional career and technical educator
483483 14 endorsement on an Educator License with Stipulations
484484 15 is valid until June 30 immediately following 5 years
485485 16 of the endorsement being issued and may be renewed.
486486 17 An individual who holds a provisional career and
487487 18 technical educator endorsement on an Educator License
488488 19 with Stipulations may teach as a substitute teacher in
489489 20 career and technical education classrooms.

738738 18 performance assessment. Except as otherwise provided in this
739739 19 Article, beginning on September 1, 2015 until August 4, 2023

902902 2 compensation. The Task Force shall first meet at the call of
903903 3 the State Superintendent of Education, and each subsequent
904904 4 meeting shall be called by the chairperson of the Task Force,

906906 6 Education. The State Board of Education shall provide
907907 7 administrative and other support to the Task Force.
908908 8 On or before August 1, 2024, the Task Force shall report on
909909 9 its work, including recommendations on a teacher performance

911911 11 Education and the General Assembly. The Task Force is

913913 13 (g) The content area knowledge test and the teacher
914914 14 performance assessment shall be the tests that from time to
915915 15 time are designated by the State Board of Education, in
916916 16 consultation with the State Educator Preparation and Licensure
917917 17 Board, and may be tests prepared by an educational testing
918918 18 organization or tests designed by the State Board of
919919 19 Education, in consultation with the State Educator Preparation
920920 20 and Licensure Board. The test of content area knowledge shall
921921 21 assess content knowledge in a specific subject field. The
922922 22 tests must be designed to be racially neutral to ensure that no
923923 23 person taking the tests is discriminated against on the basis
924924 24 of race, color, national origin, or other factors unrelated to
925925 25 the person's ability to perform as a licensed employee. The

953953 17 (i) The rules developed to implement and enforce the
954954 18 testing requirements under this Section shall include, without
955955 19 limitation, provisions governing test selection, test
956956 20 validation, and determination of a passing score,
957957 21 administration of the tests, frequency of administration,
958958 22 applicant fees, frequency of applicants taking the tests, the
959959 23 years for which a score is valid, and appropriate special
960960 24 accommodations. The State Board of Education shall develop
961961 25 such rules as may be needed to ensure uniformity from year to
962962 26 year in the level of difficulty for each form of an assessment.

10461046 3 additional fee may be charged for that validity period

10491049 6 license (i) immediately after initial issuance of the
10501050 7 license and (ii) at the beginning of each renewal cycle if
10511051 8 the individual has satisfied the renewal requirements

10531053 10 Beginning on July 1, 2017, at the beginning of each
10541054 11 renewal cycle, individuals who hold a Substitute Teaching
10551055 12 License may apply for a reimbursement of the registration
10561056 13 fee within 18 months of renewal and shall be issued that
10571057 14 reimbursement by the State Board of Education from funds
10581058 15 appropriated for that purpose if the licensee provides
10591059 16 evidence to the State Board of Education that the licensee
10601060 17 has taught pursuant to the Substitute Teaching License at
10611061 18 least 10 full school days within one year of renewal.
10621062 19 (5) The license renewal fee for an Educator License
10631063 20 with Stipulations with a paraprofessional educator
10641064 21 endorsement is $25.
10651065 22 (b) All application fees paid pursuant to subdivisions (1)
10661066 23 through (3) of subsection (a) of this Section shall be
10671067 24 deposited into the Teacher Certificate Fee Revolving Fund and
10681068 25 shall be used, subject to appropriation, by the State Board of

10811081 2 applications and for the renewal of licenses. Funds available
10821082 3 from the Teacher Certificate Fee Revolving Fund may also be
10831083 4 used by the State Board of Education to support the
10841084 5 recruitment and retention of educators, to support educator
10851085 6 preparation programs as they seek national accreditation, and
10861086 7 to provide professional development aligned with the
10871087 8 requirements set forth in Section 21B-45 of this Code. A
10881088 9 majority of the funds in the Teacher Certificate Fee Revolving
10891089 10 Fund must be dedicated to the timely and efficient processing
10901090 11 of applications and for the renewal of licenses. The Teacher
10911091 12 Certificate Fee Revolving Fund is not subject to
10921092 13 administrative charge transfers, authorized under Section 8h
10931093 14 of the State Finance Act, from the Teacher Certificate Fee
10941094 15 Revolving Fund into any other fund of this State, and moneys in
10951095 16 the Teacher Certificate Fee Revolving Fund shall not revert
10961096 17 back to the General Revenue Fund at any time.
10971097 18 The regional superintendent of schools shall deposit the
10981098 19 registration fees paid pursuant to subdivision (4) of
10991099 20 subsection (a) of this Section into the institute fund
11001100 21 established pursuant to Section 3-11 of this Code.
11011101 22 (c) The State Board of Education and each regional office
11021102 23 of education are authorized to charge a service or convenience
11031103 24 fee for the use of credit cards for the payment of license
11041104 25 fees. This service or convenience fee shall not exceed the
11051105 26 amount required by the credit card processing company or
