13	13	1 AN ACT concerning education.
14	14	2 Be it enacted by the People of the State of Illinois,
15	15	3 represented in the General Assembly:
16	16	4 Section 5. The School Code is amended by changing Section
17	17	5 10-20.9a as follows:
18	18	6 (105 ILCS 5/10-20.9a) (from Ch. 122, par. 10-20.9a)
19	19	7 Sec. 10-20.9a. Final grade; promotion; student account
20	20	8 balance.
21	21	9 (a) Teachers shall administer the approved marking system
22	22	10 or other approved means of evaluating pupil progress. The
23	23	11 teacher shall maintain the responsibility and right to
24	24	12 determine grades and other evaluations of students within the
25	25	13 grading policies of the district based upon his or her
26	26	14 professional judgment of available criteria pertinent to any
27	27	15 given subject area or activity for which he or she is
28	28	16 responsible. District policy shall provide the procedure and
29	29	17 reasons by and for which a grade may be changed; provided that
30	30	18 no grade or evaluation shall be changed without notification
31	31	19 to the teacher concerning the nature and reasons for such
32	32	20 change. If such a change is made, the person making the change
33	33	21 shall assume such responsibility for determining the grade or
34	34	22 evaluation, and shall initial such change.

76	76	1 next higher grade level based upon age or any other social
77	77	2 reasons not related to the academic performance of the
78	78	3 students. On or before September 1, 1998, school boards shall
79	79	4 adopt and enforce a policy on promotion as they deem necessary
80	80	5 to ensure that students meet local goals and objectives and
81	81	6 can perform at the expected grade level prior to promotion.
82	82	7 Decisions to promote or retain students in any classes shall
83	83	8 be based on successful completion of the curriculum,
84	84	9 attendance, performance based on the assessments required
85	85	10 under Section 2-3.64a-5 of this Code, the Iowa Test of Basic
86	86	11 Skills, or other testing or any other criteria established by
87	87	12 the school board. Students determined by the local district to
88	88	13 not qualify for promotion to the next higher grade shall be
89	89	14 provided remedial assistance, which may include, but shall not
90	90	15 be limited to, a summer bridge program of no less than 90
91	91	16 hours, tutorial sessions, increased or concentrated
92	92	17 instructional time, modifications to instructional materials,
93	93	18 and retention in grade.
94	94	19 (c) No public high school of a school district shall
95	95	20 withhold a student's grades, transcripts, or diploma or
96	96	21 otherwise punish or penalize the student because of an unpaid
97	97	22 balance on the student's school account.
98	98	23 At the end of each school year, the school district shall
99	99	24 catalogue and report to the State Board of Education the total
100	100	25 amount that remains unpaid by students due to the prohibition
101	101	26 under this subsection (c).
