1313 1 AN ACT concerning education.
1414 2 Be it enacted by the People of the State of Illinois,
1515 3 represented in the General Assembly:
1616 4 Section 5. The School Code is amended by changing Section
1717 5 10-20.9a as follows:
1818 6 (105 ILCS 5/10-20.9a) (from Ch. 122, par. 10-20.9a)
1919 7 Sec. 10-20.9a. Final grade; promotion; student account
2020 8 balance.
2121 9 (a) Teachers shall administer the approved marking system
2222 10 or other approved means of evaluating pupil progress. The
2323 11 teacher shall maintain the responsibility and right to
2424 12 determine grades and other evaluations of students within the
2525 13 grading policies of the district based upon his or her
2626 14 professional judgment of available criteria pertinent to any
2727 15 given subject area or activity for which he or she is
2828 16 responsible. District policy shall provide the procedure and
2929 17 reasons by and for which a grade may be changed; provided that
3030 18 no grade or evaluation shall be changed without notification
3131 19 to the teacher concerning the nature and reasons for such
3232 20 change. If such a change is made, the person making the change
3333 21 shall assume such responsibility for determining the grade or
3434 22 evaluation, and shall initial such change.

7676 1 next higher grade level based upon age or any other social
7777 2 reasons not related to the academic performance of the
7878 3 students. On or before September 1, 1998, school boards shall
7979 4 adopt and enforce a policy on promotion as they deem necessary
8080 5 to ensure that students meet local goals and objectives and
8181 6 can perform at the expected grade level prior to promotion.
8282 7 Decisions to promote or retain students in any classes shall
8383 8 be based on successful completion of the curriculum,
8484 9 attendance, performance based on the assessments required
8585 10 under Section 2-3.64a-5 of this Code, the Iowa Test of Basic
8686 11 Skills, or other testing or any other criteria established by
8787 12 the school board. Students determined by the local district to
8888 13 not qualify for promotion to the next higher grade shall be
8989 14 provided remedial assistance, which may include, but shall not
9090 15 be limited to, a summer bridge program of no less than 90
9191 16 hours, tutorial sessions, increased or concentrated
9292 17 instructional time, modifications to instructional materials,
9393 18 and retention in grade.
9494 19 (c) No public high school of a school district shall
9595 20 withhold a student's grades, transcripts, or diploma or
9696 21 otherwise punish or penalize the student because of an unpaid
9797 22 balance on the student's school account.
9898 23 At the end of each school year, the school district shall
9999 24 catalogue and report to the State Board of Education the total
100100 25 amount that remains unpaid by students due to the prohibition
101101 26 under this subsection (c).
