12	12	1 AN ACT concerning criminal law.
13	13	2 Be it enacted by the People of the State of Illinois,
14	14	3 represented in the General Assembly:
15	15	4 Section 1. Findings. The General Assembly finds that:
16	16	5 (1) Fentanyl and its analogs present a serious risk to
17	17	6 public safety.
18	18	7 (2) The analog carfentanil, also known as carfentanyl,
19	19	8 is approximately 100 times more potent than fentanyl, and
20	20	9 2 milligrams of carfentanil is lethal.
21	21	10 Section 5. The Illinois Controlled Substances Act is
22	22	11 amended by changing Section 401 and by adding Section 401.3 as
23	23	12 follows:

70	70	1 Criminal Code of 2012, a counterfeit substance, or a
71	71	2 controlled substance analog. A violation of this Act with
72	72	3 respect to each of the controlled substances listed herein
73	73	4 constitutes a single and separate violation of this Act. For
74	74	5 purposes of this Section, "controlled substance analog" or
75	75	6 "analog" means a substance, other than a controlled substance,
76	76	7 which is not approved by the United States Food and Drug
77	77	8 Administration or, if approved, is not dispensed or possessed
78	78	9 in accordance with State or federal law, and that has a
79	79	10 chemical structure substantially similar to that of a
80	80	11 controlled substance in Schedule I or II, or that was
81	81	12 specifically designed to produce an effect substantially
82	82	13 similar to that of a controlled substance in Schedule I or II.
83	83	14 Examples of chemical classes in which controlled substance
84	84	15 analogs are found include, but are not limited to, the
85	85	16 following: phenethylamines, N-substituted piperidines,
86	86	17 morphinans, ecgonines, quinazolinones, substituted indoles,
87	87	18 and arylcycloalkylamines. For purposes of this Act, a
88	88	19 controlled substance analog shall be treated in the same
89	89	20 manner as the controlled substance to which it is
90	90	21 substantially similar; however, if a controlled substance
91	91	22 analog is at least 5 times as potent as the controlled
92	92	23 substance of which it is an analog, then the weight of the
93	93	24 controlled substance analog for purposes of this Act shall be
94	94	25 deemed to be the weight of the controlled substance analog
95	95	26 multiplied by the increase in potency.

106	106	1 (a) Any person who violates this Section with respect to
107	107	2 the following amounts of controlled or counterfeit substances
108	108	3 or controlled substance analogs, notwithstanding any of the
109	109	4 provisions of subsections (c), (d), (e), (f), (g) or (h) to the
110	110	5 contrary, is guilty of a Class X felony and shall be sentenced
111	111	6 to a term of imprisonment as provided in this subsection (a)
112	112	7 and fined as provided in subsection (b):
113	113	8 (1)(A) not less than 6 years and not more than 30 years
114	114	9 with respect to 15 grams or more but less than 100 grams of
115	115	10 a substance containing heroin, or an analog thereof;
116	116	11 (B) not less than 9 years and not more than 40 years

360	360	3 (b) Any person sentenced with respect to violations of
361	361	4 paragraph (1), (2), (3), (7), or (7.5) of subsection (a)
362	362	5 involving 100 grams or more of the controlled substance named
363	363	6 therein, may in addition to the penalties provided therein, be
364	364	7 fined an amount not more than $500,000 or the full street value
365	365	8 of the controlled or counterfeit substance or controlled
366	366	9 substance analog, whichever is greater. The term "street
367	367	10 value" shall have the meaning ascribed in Section 110-5 of the
368	368	11 Code of Criminal Procedure of 1963. Any person sentenced with
369	369	12 respect to any other provision of subsection (a), may in
370	370	13 addition to the penalties provided therein, be fined an amount
371	371	14 not to exceed $500,000.
372	372	15 (b-1) Excluding violations of this Act when the controlled
373	373	16 substance is fentanyl, any person sentenced to a term of
374	374	17 imprisonment with respect to violations of Section 401, 401.1,

412	412	19 of fentanyl, carfentanil, or any analog thereof, would
413	413	20 render the approved product an adulterated product under
414	414	21 the standards of the Federal Food, Drug, and Cosmetic Act,
415	415	22 or any State of Illinois Act or administrative rule.
416	416	23 (c) Any person who violates this Section with regard to
417	417	24 the following amounts of controlled or counterfeit substances
418	418	25 or controlled substance analogs, notwithstanding any of the
419	419	26 provisions of subsections (a), (b), (d), (e), (f), (g) or (h)

550	550	13 included under subsection (d) of this Section, is guilty of a
551	551	14 Class 3 felony. The fine for violation of this subsection (e)
552	552	15 shall not be more than $150,000.
553	553	16 (f) Any person who violates this Section with regard to
554	554	17 any other amount of a controlled or counterfeit substance
555	555	18 classified in Schedule III is guilty of a Class 3 felony. The
556	556	19 fine for violation of this subsection (f) shall not be more
557	557	20 than $125,000.
558	558	21 (g) Any person who violates this Section with regard to
559	559	22 any other amount of a controlled or counterfeit substance
560	560	23 classified in Schedule IV is guilty of a Class 3 felony. The
561	561	24 fine for violation of this subsection (g) shall not be more
562	562	25 than $100,000.

588	588	15 (a) Except for purposes as authorized by this Act, any
589	589	16 person who knowingly brings or causes to be brought into this
590	590	17 State for the purpose of manufacture or delivery or with the
591	591	18 intent to manufacture or deliver fentanyl, carfentanil, or any
592	592	19 fentanyl analog in this or any other state or country is guilty
593	593	20 of fentanyl trafficking.
594	594	21 (b) A person convicted of fentanyl trafficking shall be
595	595	22 sentenced to a term of imprisonment of not less than twice the
596	596	23 minimum term and fined an amount as authorized by Section 401
597	597	24 of this Act, based upon the amount of fentanyl brought or
598	598	25 caused to be brought into this State, and not more than twice

610	610	2 authorized by Section 401 of this Act, based upon the amount of
611	611	3 fentanyl brought or caused to be brought into this State.
612	612	4 (c) A person convicted of fentanyl trafficking for a
613	613	5 substance or any part thereof that contains carfentanil shall
614	614	6 be sentenced to a term of imprisonment of not less than twice
615	615	7 the minimum term and fined an amount as authorized by Section
616	616	8 401 of this Act, based upon the amount of carfentanil brought
617	617	9 or caused to be brought into this State, and not more than
618	618	10 twice the maximum term of imprisonment and fined twice the
619	619	11 amount as authorized by Section 401 of this Act, based upon the
620	620	12 amount of carfentanil brought or caused to be brought into
621	621	13 this State.
622	622	14 (d) It is a Class 2 felony for which a fine not to exceed
623	623	15 $100,000 may be imposed for any person to knowingly use a
624	624	16 cellular radio telecommunication device in the furtherance of
625	625	17 fentanyl trafficking. This penalty shall be in addition to any
626	626	18 other penalties imposed by law. In this subsection (d),
627	627	19 "cellular radio telecommunication device" has the meaning
628	628	20 provided in Section 12-813.1 of the Illinois Vehicle Code.
629	629	21 (e) In addition to any other penalties under this Section,
630	630	22 the court shall impose a sentence of not less than 6 years and
631	631	23 not more than 30 years for any amount of carfentanil in excess
632	632	24 of 150 milligrams that is stored or transmitted as a powder,
633	633	25 blotter paper, tablet, patch, or spray if the product fails to
