11 103RD GENERAL ASSEMBLY State of Illinois 2023 and 2024 HB5099 Introduced , by Rep. Abdelnasser Rashid SYNOPSIS AS INTRODUCED: 30 ILCS 500/50-41 new Amends the Illinois Procurement Code. Requires a vendor who contracts for government services, grants, or leases or purchases of software or hardware to disclose if artificial intelligence technology is, has been, or will be used in the course of fulfilling the contract or in the goods, technology, or services being purchased. Provides that the disclosure must be provided to the chief procurement officer, the Department of Innovation and Technology, and the General Assembly. Provides that, if the role of artificial intelligence changes during the course of the contract, or if the vendor plans to use artificial intelligence when it had not originally planned on doing so, the vendor must provide a new or updated disclosure. Allows a State agency, at its discretion, to require that a vendor provide detailed information on the technology's capacity, data sets, and limitations on the use of artificial intelligence technology. Provides that the chief procurement officer may disqualify a vendor who fails to provide the required disclosure or provides false or misleading information from contracting with the State for a period of up to 2 years. 1111 1 AN ACT concerning transportation.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Illinois Procurement Code is amended by
1515 5 adding Section 50-41 as follows:

1717 7 Sec. 50-41. Disclosure of the use of artificial
1818 8 intelligence technology. A vendor who contracts for government
1919 9 services, grants, or leases or purchases of software or
2020 10 hardware must disclose if artificial intelligence technology
2121 11 is, has been, or will be used in the course of fulfilling the
2222 12 contract or in the goods, technology, or services being
2323 13 purchased. The disclosure must be provided to the chief
2424 14 procurement officer, the Department of Innovation and
2525 15 Technology, and the General Assembly. If the role of
2626 16 artificial intelligence changes during the course of the
2727 17 contract, or if the vendor plans to use artificial
2828 18 intelligence when it had not originally planned on doing so,
2929 19 the vendor must provide a new or updated disclosure. A State
3030 20 agency may, at its discretion, require that a vendor provide
