11 103RD GENERAL ASSEMBLY State of Illinois 2023 and 2024 HB5221 Introduced , by Rep. Yolonda Morris SYNOPSIS AS INTRODUCED: 20 ILCS 1305/10-80 new Amends the Department of Human Services Act. Provides that subject to appropriation, the Department of Human Services shall establish and administer a program that provides parents or guardians of children enrolled in a qualifying day care facility reimbursements of paid child care expenses for up to 5 sick days each calendar year. Provides that the reimbursement rate for sick days shall be determined by the Department by rule. Requires claims for reimbursement to be made to the Department by the qualifying day care facility on behalf of a parent or guardian who submits a receipt and any other required documentation that demonstrates the parent or guardian has satisfied all payment obligations for the claimed sick day. Provides that upon the Department's determination that reimbursement is proper, a reimbursement shall be made to the qualifying day care facility which shall then credit the parent or guardian the reimbursement amount. Provides that parents and guardians and any other relatives who receive child care assistance under the Department's Child Care Assistance Program are not eligible for sick day reimbursements under the amendatory Act. 1111 1 AN ACT concerning State government.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Department of Human Services Act is amended
1515 5 by adding Section 10-80 as follows:

1717 7 Sec. 10-80. Day care reimbursement for sick days.
1818 8 (a) As used in this Section, "qualifying day care
1919 9 facility" means a day care center, day care home, or group day
2020 10 care home licensed under the Child Care Act of 1969.
2121 11 (b) Subject to appropriation, the Department of Human
2222 12 Services shall establish and administer a program that
2323 13 provides parents or guardians of children enrolled in a
2424 14 qualifying day care facility reimbursements of paid child care
2525 15 expenses for up to 5 sick days each calendar year. The
2626 16 reimbursement rate for sick days shall be determined by the
2727 17 Department by rule. Claims for reimbursement shall be made to
2828 18 the Department by the qualifying day care facility on behalf
2929 19 of a parent or guardian who submits a receipt and any other
3030 20 required documentation that demonstrates the parent or
3131 21 guardian has satisfied all payment obligations for the claimed
3232 22 sick day. Upon the Department's determination that
