13	13	1 AN ACT concerning civil law.
14	14	2 Be it enacted by the People of the State of Illinois,
15	15	3 represented in the General Assembly:
16	16	4 Section 5. The Homeowners' Energy Policy Statement Act is
17	17	5 amended by changing Sections 10, 15, and 45 as follows:

19	19	7 Sec. 10. Definitions. In this Act:
20	20	8 "Solar energy" means radiant energy received from the sun
21	21	9 at wave lengths suitable for heat transfer, photosynthetic
22	22	10 use, or photovoltaic use.
23	23	11 "Solar collector" means:
24	24	12 (1) an assembly, structure, or design, including
25	25	13 passive elements, used for gathering, concentrating, or
26	26	14 absorbing direct and indirect solar energy, specially
27	27	15 designed for holding a substantial amount of useful
28	28	16 thermal energy and to transfer that energy to a gas,
29	29	17 solid, or liquid or to use that energy directly; or
30	30	18 (2) a mechanism that absorbs solar energy and converts
31	31	19 it into electricity; or
32	32	20 (3) a mechanism or process used for gathering solar
33	33	21 energy through wind or thermal gradients; or
34	34	22 (4) a component used to transfer thermal energy to a
35	35	23 gas, solid, or liquid, or to convert it into electricity.

74	74	1 "Solar storage mechanism" means equipment or elements
75	75	2 (such as piping and transfer mechanisms, containers, heat
76	76	3 exchangers, batteries, or controls thereof, and gases, solids,
77	77	4 liquids, or combinations thereof) that are utilized for
78	78	5 storing solar energy, gathered by a solar collector, for
79	79	6 subsequent use.
80	80	7 "Solar energy system" means:
81	81	8 (1) a complete assembly, structure, or design of solar
82	82	9 collector, or a solar storage mechanism, which uses solar
83	83	10 energy for generating electricity or for heating or
84	84	11 cooling gases, solids, liquids, or other materials; and
85	85	12 (2) the design, materials, or elements of a system and
86	86	13 its maintenance, operation, and labor components, and the
87	87	14 necessary components, if any, of supplemental conventional
88	88	15 energy systems designed or constructed to interface with a
89	89	16 solar energy system.
90	90	17 "Video doorbell" means an Internet-enabled doorbell,
91	91	18 equipped with a camera or microphone, or both, that:
92	92	19 (1) sends a notification to the smartphone, computer,
93	93	20 or similar Internet-enabled mobile device of a user when a
94	94	21 guest arrives at the entrance of the door;
95	95	22 (2) is activated when the guest presses the button of
96	96	23 the doorbell, is activated when the doorbell senses a
97	97	24 guest with its built-in monitor sensors, or is activated
98	98	25 remotely by the user of the doorbell through the user's
99	99	26 smartphone, computer, or similar Internet-enabled mobile

117	117	8 Sec. 15. Associations; prohibitions. Notwithstanding any
118	118	9 provision of this Act or other provision of law, the adoption
119	119	10 of a bylaw or exercise of any power by the governing entity of
120	120	11 a homeowners' association, common interest community
121	121	12 association, or condominium unit owners' association which
122	122	13 prohibits or has the effect of prohibiting the installation of
123	123	14 a solar energy system, including, but not limited to, a solar
124	124	15 energy system installed for the primary purpose of providing
125	125	16 solar energy to a video doorbell, is expressly prohibited.

129	129	20 (a) This Act shall not apply to any building that:
130	130	21 (1) is greater than 60 feet in height; or
131	131	22 (2) has a shared roof and is subject to a homeowners'
