1111 1 AN ACT concerning business.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Consumer Fraud and Deceptive Business
1515 5 Practices Act is amended by changing Section 2 as follows:
1616 6 (815 ILCS 505/2) (from Ch. 121 1/2, par. 262)
1717 7 Sec. 2.
1818 8 (a) Unfair methods of competition and unfair or deceptive
1919 9 acts or practices, including but not limited to the use or
2020 10 employment of any deception fraud, false pretense, false
2121 11 promise, misrepresentation or the concealment, suppression or
2222 12 omission of any material fact, with intent that others rely
2323 13 upon the concealment, suppression or omission of such material
2424 14 fact, or the use or employment of any practice described in
2525 15 Section 2 of the "Uniform Deceptive Trade Practices Act",
2626 16 approved August 5, 1965, in the conduct of any trade or
2727 17 commerce are hereby declared unlawful whether any person has
2828 18 in fact been misled, deceived or damaged thereby. In
2929 19 construing this section consideration shall be given to the
3030 20 interpretations of the Federal Trade Commission and the
3131 21 federal courts relating to Section 5 (a) of the Federal Trade
3232 22 Commission Act.
