Justin Slaughter SYNOPSIS AS INTRODUCED: 730 ILCS 5/3-3-8 from Ch. 38, par. 1003-3-8 Amends the Unified Code of Corrections. Provides that upon completion of all mandatory conditions of parole or mandatory supervised release, the Department of Corrections shall file a certification with the Prisoner Review Board that the subject has completed the mandatory conditions of parole or mandatory supervised release and that discharge is appropriate. Provides that the order of discharge shall become effective upon entry of the order of the Board in cases in which the Board determined that the parolee or releasee: (1) is likely to remain at liberty without committing another offense; or (2) received a high school diploma, associate's degree, bachelor's degree, career certificate, or vocational technical certification or passed high school equivalency testing during the period of his or her parole or mandatory supervised release. Provides that if the person is on mandatory supervised release and is a low-risk and need subject person as determined by an appropriate evidence-based risk and need assessment, the order of discharge shall become effective upon entry of the order of the Board. Provides that the order of discharge in other cases shall become effective 30 days after the Department of Corrections files the certification unless the Prisoner Review Board denies early discharge. 1111 1 AN ACT concerning criminal law.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Unified Code of Corrections is amended by
1515 5 changing Section 3-3-8 as follows:

1717 7 Sec. 3-3-8. Length of parole and mandatory supervised
1818 8 release; discharge.
1919 9 (a) The length of parole for a person sentenced under the
2020 10 law in effect prior to the effective date of this amendatory
2121 11 Act of 1977 and the length of mandatory supervised release for
2222 12 those sentenced under the law in effect on and after such
2323 13 effective date shall be as set out in Section 5-8-1 unless
2424 14 sooner terminated under paragraph (b) of this Section.
2525 15 (b) The Prisoner Review Board may enter an order releasing
2626 16 and discharging one from parole or mandatory supervised
2727 17 release, and his or her commitment to the Department, when it
2828 18 determines that he or she is likely to remain at liberty
2929 19 without committing another offense.
3030 20 (b-1) Provided that the subject is in compliance with the
3131 21 terms and conditions of his or her parole or mandatory
3232 22 supervised release, the Prisoner Review Board shall reduce the
3333 23 period of a parolee or releasee's parole or mandatory

6868 1 supervised release by 90 days upon the parolee or releasee
6969 2 receiving a high school diploma, associate's degree,
7070 3 bachelor's degree, career certificate, or vocational technical
7171 4 certification or upon passage of high school equivalency
7272 5 testing during the period of his or her parole or mandatory
7373 6 supervised release. A parolee or releasee shall provide
7474 7 documentation from the educational institution or the source
7575 8 of the qualifying educational or vocational credential to
7676 9 their supervising officer for verification. Each reduction in
7777 10 the period of a subject's term of parole or mandatory
7878 11 supervised release shall be available only to subjects who
7979 12 have not previously earned the relevant credential for which
8080 13 they are receiving the reduction. As used in this Section,
8181 14 "career certificate" means a certificate awarded by an
8282 15 institution for satisfactory completion of a prescribed
8383 16 curriculum that is intended to prepare an individual for
8484 17 employment in a specific field.
8585 18 (b-2) The Prisoner Review Board may release a low-risk and
8686 19 need subject person from mandatory supervised release as
8787 20 determined by an appropriate evidence-based risk and need
8888 21 assessment.
8989 22 (b-3) Upon completion of all mandatory conditions of
9090 23 parole or mandatory supervised release, the Department of
9191 24 Corrections shall file a certification with the Prisoner
9292 25 Review Board that the subject has completed the mandatory
9393 26 conditions of parole or mandatory supervised release and that
