1313 1 AN ACT concerning education.
1414 2 Be it enacted by the People of the State of Illinois,
1515 3 represented in the General Assembly:
1616 4 Section 5. The Critical Health Problems and Comprehensive
1717 5 Health Education Act is amended by changing Section 3 as
1818 6 follows:

2020 8 Sec. 3. Comprehensive Health Education Program. The
2121 9 program established under this Act shall include, but not be
2222 10 limited to, the following major educational areas as a basis
2323 11 for curricula in all elementary and secondary schools in this
2424 12 State: human ecology and health; human growth and development;
2525 13 the emotional, psychological, physiological, hygienic, and
2626 14 social responsibilities of family life, including sexual
2727 15 abstinence until marriage; the prevention and control of
2828 16 disease, including instruction in grades 6 through 12 on the
2929 17 prevention, transmission, and spread of AIDS; age-appropriate
3030 18 sexual abuse and assault awareness and prevention education in
3131 19 grades pre-kindergarten through 12; public and environmental
3232 20 health; consumer health; safety education and disaster
3333 21 survival; mental health and illness; personal health habits;
3434 22 alcohol and drug use and abuse, including the medical and
3535 23 legal ramifications of alcohol, drug, and tobacco use; abuse

7676 1 during pregnancy; evidence-based and medically accurate
7777 2 information regarding sexual abstinence; tobacco and
7878 3 e-cigarettes and other vapor devices; nutrition; gambling and
7979 4 gambling addiction; and dental health. The instruction on
8080 5 mental health and illness must evaluate the multiple
8181 6 dimensions of health by reviewing the relationship between
8282 7 physical and mental health so as to enhance student
8383 8 understanding, attitudes, and behaviors that promote health,
8484 9 well-being, and human dignity and must include how and where
8585 10 to find mental health resources and specialized treatment in
8686 11 the State. The program shall also provide course material and
8787 12 instruction to advise pupils of the Abandoned Newborn Infant
8888 13 Protection Act. The program shall include information about
8989 14 cancer, including, without limitation, types of cancer, signs
9090 15 and symptoms, risk factors, the importance of early prevention
9191 16 and detection, and information on where to go for help.
9292 17 Notwithstanding the above educational areas, the following
9393 18 areas may also be included as a basis for curricula in all
9494 19 elementary and secondary schools in this State: basic first
9595 20 aid (including, but not limited to, cardiopulmonary
9696 21 resuscitation and the Heimlich maneuver), heart disease,
9797 22 diabetes, stroke, the prevention of child abuse, neglect, and
9898 23 suicide, and teen dating violence in grades 7 through 12.
9999 24 Beginning with the 2014-2015 school year, training on how to

112112 1 Red Cross, the American Heart Association, or another
113113 2 nationally recognized certifying organization) and how to use
114114 3 an automated external defibrillator shall be included as a
115115 4 basis for curricula in all secondary schools in this State.
116116 5 Beginning with the 2024-2025 school year in grades 9
117117 6 through 12, the program shall include instruction, study, and
118118 7 discussion on the dangers of allergies. Information for the
119119 8 instruction, study, and discussion shall come from information
120120 9 provided by the Department of Public Health and the federal
121121 10 Centers for Disease Control and Prevention. This instruction,
122122 11 study, and discussion shall include, at a minimum:
123123 12 (1) recognizing the signs and symptoms of an allergic
124124 13 reaction, including anaphylaxis;
125125 14 (2) the steps to take to prevent exposure to
126126 15 allergens; and
127127 16 (3) safe emergency epinephrine administration.
128128 17 The school board of each public elementary and secondary
129129 18 school in the State shall encourage all teachers and other
130130 19 school personnel to acquire, develop, and maintain the
131131 20 knowledge and skills necessary to properly administer
132132 21 life-saving techniques, including, without limitation, the
133133 22 Heimlich maneuver and rescue breathing. The training shall be
134134 23 in accordance with standards of the American Red Cross, the
135135 24 American Heart Association, or another nationally recognized
136136 25 certifying organization. A school board may use the services
137137 26 of non-governmental entities whose personnel have expertise in

148148 1 life-saving techniques to instruct teachers and other school
149149 2 personnel in these techniques. Each school board is encouraged
150150 3 to have in its employ, or on its volunteer staff, at least one
151151 4 person who is certified, by the American Red Cross or by
152152 5 another qualified certifying agency, as qualified to
153153 6 administer first aid and cardiopulmonary resuscitation. In
154154 7 addition, each school board is authorized to allocate
155155 8 appropriate portions of its institute or inservice days to
156156 9 conduct training programs for teachers and other school
157157 10 personnel who have expressed an interest in becoming qualified
158158 11 to administer emergency first aid or cardiopulmonary
159159 12 resuscitation. School boards are urged to encourage their
160160 13 teachers and other school personnel who coach school athletic
161161 14 programs and other extracurricular school activities to
162162 15 acquire, develop, and maintain the knowledge and skills
163163 16 necessary to properly administer first aid and cardiopulmonary
164164 17 resuscitation in accordance with standards and requirements
165165 18 established by the American Red Cross or another qualified
166166 19 certifying agency. Subject to appropriation, the State Board
167167 20 of Education shall establish and administer a matching grant
168168 21 program to pay for half of the cost that a school district
169169 22 incurs in training those teachers and other school personnel
170170 23 who express an interest in becoming qualified to administer
171171 24 cardiopulmonary resuscitation (which training must be in
172172 25 accordance with standards of the American Red Cross, the
173173 26 American Heart Association, or another nationally recognized

184184 1 certifying organization) or in learning how to use an
185185 2 automated external defibrillator. A school district that
186186 3 applies for a grant must demonstrate that it has funds to pay
187187 4 half of the cost of the training for which matching grant money
188188 5 is sought. The State Board of Education shall award the grants
189189 6 on a first-come, first-serve basis.
190190 7 No pupil shall be required to take or participate in any
191191 8 class or course on AIDS or family life instruction or to
192192 9 receive training on how to properly administer cardiopulmonary
193193 10 resuscitation or how to use an automated external
194194 11 defibrillator if his or her parent or guardian submits written
195195 12 objection thereto, and refusal to take or participate in the
196196 13 course or program or the training shall not be reason for
197197 14 suspension or expulsion of the pupil.
198198 15 Curricula developed under programs established in
199199 16 accordance with this Act in the major educational area of
200200 17 alcohol and drug use and abuse shall include classroom
201201 18 instruction in grades 5 through 12. The instruction, which
202202 19 shall include matters relating to both the physical and legal
203203 20 effects and ramifications of drug and substance abuse, shall
204204 21 be integrated into existing curricula; and the State Board of
205205 22 Education shall develop and make available to all elementary
206206 23 and secondary schools in this State instructional materials
207207 24 and guidelines which will assist the schools in incorporating
208208 25 the instruction into their existing curricula. In addition,
209209 26 school districts may offer, as part of existing curricula

220220 1 during the school day or as part of an after-school after
221221 2 school program, support services and instruction for pupils or
222222 3 pupils whose parent, parents, or guardians are chemically
223223 4 dependent. Curricula developed under programs established in
224224 5 accordance with this Act in the major educational area of
225225 6 alcohol and drug use and abuse shall include the instruction,
226226 7 study, and discussion required under subsection (c) of Section
227227 8 27-13.2 of the School Code.
