4-AN ACT concerning civil law.
5-Be it enacted by the People of the State of Illinois,
6-represented in the General Assembly:
7-Section 5. The Code of Civil Procedure is amended by
8-adding Section 21-106 as follows:
9-(735 ILCS 5/21-106 new)
10-Sec. 21-106. Judicial order; findings of fact.
11-(a) Legislative intent. Residents of this State who were
12-born in another state or in another country may have
13-difficulty in securing a birth certificate with the correct
14-information. It is the intent of the General Assembly that
15-Illinois should have a legal process available for these
16-residents to seek a judicial order making findings of fact so
17-that they may petition the issuing jurisdiction to change a
18-birth certificate.
19-(b) An Illinois resident may file a petition in the
20-resident's county of residence asking for a court to issue a
21-finding of fact or facts to correct or update a birth
22-certificate issued by another state or country.
23-(c) The petition must contain the following information:
24-(1) the petitioner's name and current address;
25-(2) the change that is sought; and
26-(3) the reason for the change.
